AN ORDINANCE AMENDING COMMISSION FOftM ORDINANCE
N0. 566, PASSED AP1D APPROVED ON THE 25th DAY OF
APRIL, 1929, BY CHANGING THE ZONING OF A CERTAIN
ARE.A TN OUTLOT N0. 70� U. S. PRIVATE SURVEY
N0. 2199, LYING ADJACENT TO THE EAST LINE OF RED
STAR ADDITION, FROM AN "H" �ND "I" LIGHT INDUSTRIAL
DISTRICT TO A "J" HEAVY INDUSTRIAL DISTRICT.
WHEREAS, the City Council of the City of C�pe Girardeau�
Missouri, by its own motion� has propossd to change the zon3ng from
sn "H" and "I" Light Industrial D3strict to a "J" Heavy Industrial
District in an area described as follows:
A strip of land 200 feet wide extending from
the south line of a tract of land conveyed to
John P. Redwine and Anna M. Redwine� his wife� by
deed contained in Book 116, page 343, in the
Office of the Recorder of Deeds of Cape Girardeau
County, Missouri, to the north line of U. S.
Pr3.vate Sureey No. 2199, which said tract of land
is parallel and immediately west of the west right
of way line of the St. Louis and San Francisco
Railway tracks;
and
WHEREAS, public notice of such proposal and such change was
given as provided by Commission Form Ordinance No. 566 and a publ�c
hearing was held by the City Council on December 1, 1954; and
WHERE9S, said proposal has been submitted to the City Planning
and Zoning Commission for its recommendations and report, and said
City Planning and Zoning Commission reported and recommended that
said property be rezoned in accordance with said proposal; and
WHEREAS, certain citizens owning property adjacent or near
to the property included within such proposed change have protested
such proposed change, but none of whom prote�ted the zoning change
as set out hereinafter, NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI , AS FOLLOWS:
SECTION 1: That Section 2 of Commission Form Ordinance
No. 566, passed and approved on the 25th day of April� 1929, shall

be, and the same is hereby, amended to change the boundary of the
present "J" Heavy Industrial District so as to include therein the
hereinafter described property, which said property is hereby re-
zoned from an "H" and "I" Light Ind.ustrial District to a uJ" Heavy
Industrial District, to-wit:
Part of Outlot 70� in U.S.P. Survey No . 2199,
in The City end County of Cape Girardesu� State af
Missouri, described as foll,ows:
Begin at a point on the west right-of-way 1ir�e
of the St. I�ouis and San Francisco Railroad, same
being the northeast corner of a tract of land here-
tofore conveyed to J. P. Redwine and Anna P�. Redwine,
husband and �ife, as same is recorded in Book 11b
at page 343 in the land records of Cape Girardeau
County, riissouri, said point being 50 feet west of
the center line of the said railroad; thence west
perpendicular to the west right-of-way line of said
railroad, 2Q0 feet; thence north parallel to the
west right-of-way line of said railroad, 300 feet;
tY�ence e�st 200 feet to a point on the west right-
of-way line of said railroad, �hich point is 300
feet north of the point of beginning above described,
measured along the west right-of-way line of said
railro�d; thence south along the said west right-
of-way line, 300 feet to the point of beginning.
SECTION 2: The City Council hereby finds and declares that
the property described in Section 1 above is at present particularly
suited for the uses and purposes of a "J" Heavy Industrial District,
and that the changes authorized hereby are reasonable and in reason-
able conformity with the existing use and value of the immediately
surrounding property.
SECTIGN 3: All ordinances and parts of ordinances in
conflict with the provisions her�of are hereby repealed� but a11
other provisions of Commission Form Ordinance No. 566 not amended
or repealed hereby, shall remain in fu11 force and effect .
SECTION �: This ordinance shall take effect and be in force
from and after ten (10) days after its passage and approval.
