ENTITLED,�tAN ORDIiVI�NCE PROVIDING rOR THE FRONTAGE
CONSEN'�S RE(�UIRED FOR THE CONSTRUCTION OF PUBLIC
GARAGES, UTL FTL�ING STATIOI�IS, BREWERIES, WAR�HUUSES,
BOTTLTNG WORKS, ETC.", BY ADDING THER�TO A NE'W
SECTION KNOWN AS SECTION /_��,,..- .

WHEREAS, �ection 1 of Commission Form Ordinance No. 177,
passed and approved on February 19, 1923, forbids the erection of
an oil filling station within 300 feet of any building used as and
for a hospital., church, or public or parochial school or in the
city in any block in which two-thirds (2/3) of the buildings on
both sides of the street are used exclusively for residential
purposes, or within 300 feet of any such street in any such block,
unless the written consent of a majority of the property owners
according to frontage on both sides of the street is secured; and
WHEREAS, said ordinance unduly restricts the development of
�organ Oak Street as one of the principal business streets of the
city;
NOW, THEREFORE, BE IT ORDAINED BY THE CI�I'Y COUNCIL OF THE CITY
OF CAPE GTRARDEAU, I��ISSOURI AS FOLLOWS:
SECTION 1. That Se�tion 1 of Commission Form Ordinance No„ 177,
passed ar.d approved February 19, 1923, entitled '�An Ordinance
Froviding for the Frontage Consents Required for Construction of
Public Garages, Oil Filling S�ations, Breweries, Warehouses,
Bottling Works, etc.", be and �he same is hereby amended by adding
thereto a new section to be known as Secti.on e �;;b , which nemr
section shall read as follows:
Section /- l.Z. . That the property located at the
Southeast Corner of the intersection of Morgan Oak Street
and Asher Street, fronting approximately 116 feet on
Norgan Oak Street and approximately 112 feet on �sher
�treet, sha11 be open to business and that the provisions
and conditions imposed by Commission Form Ordinanee No.
177 shall not apply to said property.
�ECTION 2. This ordinance shall be in full fprce and effect from
and after its passa�e.
