�IISSOiJRI, AND PROVIllING FOR THE ISSUANCE OF SPECIAL TAX BILLS IN PAYMETdT
OF THE COSZ' OF SANIE. ,-
BE IT ORDAIiVED BY THE COUNCIL OF TH� CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS;
SECTION 1. That the portion of Second and Third 5treets, from the
existin� asp'r�alt pavement at the west side of Main Street to the exist-
ing concrete pavement at the east side of Big Bend Roaci, and Spanish
Street from the center line of �econd Street to the center line of
Fourth Street, in the City of Cape Gir.ardeau, Missouri, the same being
in District No . l�, in the City of Cape Girardeau, Missouri, as laid out
and aesignated by Commission Form Ordin�.nce 1Vo . �00, passed and ap-
proved on the 23rd day of July, 1937, and Commission Forr� Ordinance No .
1253, passed and approved on the 29th day of May, 1950 , shall be re-
paired and resurfaced in accordance with said Commission Form Ordinances
Nos . g00 and 1253, as Project No . 4-54 in said District iVo. 1.
SECTIUN 2 . That the following work shall be done: Shap�e the existing
gravel roadway, with the addition of gravel or crushed stone if necessar,y,
and plac� a penetration asphalt surfacing, 20 feet in width, having a
thickness of approxima.tely 1 inch, and compact same b�y rolling. .
SECTIUI� 3 . Said repairing and resurfacing of said streets shall be done
by the Departmsnt of Public �orks of the City of Cape Girardeau, �issouri ,
under the direction of the City Consulting Engineer, so that the cost of
such repairing and resurfacing shall not exceed an amount equal to sixty
(60) cents per front foot of property fronting and abutting on said portion
of said street so improved.
SECTION 4. That an accurate account shall be kept by the City Corisultin�
Engineer of the cost of said work, including payment at contract prices
for any portions thereof done by contr�ct, and such cost shall be defrayed
by a special tax to be assessed in favor of the Gity of �ape Girardeau,
T�iissouri , against the property fronting and abutting on said portion of
said streets in the proportion that the linear feet of each lot or tract
fronting and abutting on said portion of said street bears to the total
number of linear feet of all the property fronting and abutting on that
portion of said streets so repaired and resurf�ced.
SECTION � . Upon completion of said work the sa.id City Consulting Engineer
shall report to tne council the total cost of said repairing and resurfac-
ing of said portions of said streets , the total number of linear feet of
property fronting and abutting thereon, and the proportionate share of
such total cost chargeable against each lot, tract, and parcel of land
fronting and �.butting on said portion of said streets, in accord�nce with
the provisions of this ordinance.
SECTIOTI 6 . Upon the filing of such report by the said Engineer, the
City Council shall examine the same, and if said renort be found correct,
and the total cost of said repairing and resurfacing d.oes not exceed 60
cents per front foot on all of tne �roperty f'ronting and abutting upon
the said portion of sa.id streets, tn�= Council shall levy and assess a
special tax against said property in accordance with saici report. Said
tax bills shall be sold for not less than their face value, �.nd assigned
by the City Clerk to any purchaser or purchasers thereof.

SECTION 7 . Al1 ordinances and parts of ordinances in conflict with
the provisions hereof are hereby repealed.
SECTION g. This ordinance shall ta.ke effect and be in force from and
after ten days after its passa�e u.nd approval.
