SECTIOT3 1. That the portion of Fourth Street, from the existing asp:�alt
pavement at the west side of t�iain Street to the existing concrete pave-
ment at the e�,.st side of Big Bend P�cad, in the City of C�,pc �i.r��:.r•de��.u,
Missouri , the same being in District i�o . l, in the City of Cape Girarctea.u,
I�'Iissouri, as laid out and designated by Commission F'orm Ordinance ido . 800,
passed and approved on the 23rd day of July, 1937, and Commission �orm

be repaired and resurfaced in accordance with said Commission Form
Ordin�,nees �tos . g00 and 1253, as Project i�io . 5-54 in saici District i�1o . l.
SECTION 2 . That the following work shall be done: Shape the existing
gravel roadway, with the addition of gravel or crushed stone if necessar�,
and place a penetration asphalt surfacing, 20 feet in width, having a
thickness of approximately 1 inch, and compact same by rolling.
SEC^lI�TJ 3 • Saicl repairing and resurfacing of said streets shall be done
by the Department of Public Works of the City of Cape Girardeau, l�iissouri ,
under the direction of the City �onsulting �ngineer, so that the cost of
such repairing and resurfacing shall not exceed an amount eaual to sixty
(60) cents per front foot of property fronting and abutting on said
portion of said street so improved.
SECTIOid 4. That an accurate account shall be kept by the City Consulting
En�ineer of the cost of said work, including payment at contract prices
for any portions thereof done by co�tract, and such cost shall be aefr�;�ed
by a special tax to be assessed in favor of the City of �ape �irardeau,
Missouri , against the property fronting �.nd abutting on said portion of
said street in proportion that the linear feet of each lot or tract
fronting and abutting on said portion of said street bears to the total
number of linear feet of all the property fronting and abutting on that
portion of said street so repaired and resurfaced.
SECTION 5 • Upon completion of said work the said City �onsulting
Engineer shall report to the council the total cost of said repairing and
resurfacing of said portion of said street, the total number of linear
feet of property fronting and abutting thereon, and the proportionate
share of such total cost chargeable against eacn lot� tract, and parcel
of land fronting and abutting on said portion of sa.id street, in accord-
ance with the provisions of this ordinance.
SECTION 6 . Upon the filing of such report by the said Engineer, the
City Council shall examine the same, and if said report be found correct,
and the total cost of said repairing and resurfacing does not exceed 6U
cents per front foot on all of the property fronting and abutting upon
the said portion of said streets, the Council shall levy and assess a
special tax against said property in accordance witn said report. Said
tax bills shall be sold for not less than their face value, and assigned
by the City Clerk to any purchaser or purchasers thereof.
SECTION 7. All ordinances and parts of ordinances in conflict with
the provisions hereof are hereby repealed.
SECTION 8. This ordinance shall take effect and be in force from and
after ten days after its passage �nd approval .
