AN ORDINANCE VACATING THAT PART OF MAPLE STREET FROM THE
EAS�'' LINE OF MINNESOTA AVENUE EXTENDING EASTNTARD A WIDTH
OF SIXTY FEET TO 'I'HE WEST LITdE OF T.�ISSOURI AVENUE; THAT
PART OF DAKOTA AVE1dUE FROM T��E NORTH LITdE OF WALISUT STREET,
A WIDTH OF SIXTY FEET EXTEIIDING NORTHW.ARDLY TO TN_E NORTH
LINE OF LOT OTdE OF BLOCK OIvTE AND LOT ONE OF BLOCK FOUR,
BOULEVARD I�EIGHTS; ALL OF THE ALLEY FROM THE NORTH LINE OF
WALNUT STREET TO THE SOUTH LINE OF NIAPLE STREET, A WIDTH
OF FIFTEEN FEET, LYIN� IN AND DIVIDING BLOCK FIVE AND ALL
OF THE ALLEY FROM THE NORTH LINE OF MAPLE STREET TO THE
NORTH LINE OF BLOCK FOUR, A WIDTH OF FIFTEEN FEET, LYING
IN A.ND DIVIDIIdG BLOCK FOUR, ALL IN BOULEVARD HEIGHTS ADDI-
TIOId, A SUBDIVISION OF OUTLOT FORTY-FOUR IN THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS DEDICATED AND DESIGNATED ON
THE PLAT OF BOULEVARD HEIGHIS, FILED OF RECORD IN THE
RECORDER'S OFFICE, FEBRUARY 9, 1925, IN PLAT BOOK 3 AT
PAGE 55.
WHEREA.S, the Board of Trustees of Osteopathic Hospital Corpo-
ration of Cape Girardeau, have acquired all of Block l, 2, 4 and 5
of Boulevard Heights Addition to the City of Cape Girardeau from
the record owners thereof, together with acreage to the north there-
of, �onsisting of a.pproximately 9. 94 acres for the purpose of a.
site upon WYL1C�l t0 erect and mainta.in buildings for use as a hospital,
and
WHEREA.S, certain streets and alleys adjacent to and within said
tracts are dedicated to public use and the existence of said streets
and alleys atrrill preventSthe full use of said real estate for the pur-
poses mentioned and the City Council has determined that the streets
and alleys therein located are not necessary or expedient for use
as public streets and alleys and that same are not necessary for
public use for ingress or egress to adjacent property and it is to
the public interest that same be vacated and the right, title and
interest of the City of Cape Girardea°u, Missouri, be conveyed to the
adjacent owners thereof.
NOW, THEREFORE, be it Ordained by the City Council of Cape
Girardeau, Missouri, as follows:

I . That from and after the effective date of this
Ordinance, that all that part of Maple Street from the
East line of Minnesota. Avenue extending eastward a
width of sixty feet to the west line of Missouri Avenue;
that part of Dakota Avenue from the north line of Walnut
Street, a width of sixty feet extending northwardly to
the north line of Lot One of Block One and Lot One of
Block Four, Boulevard Heights; a.11 of the alley from the
north line of Walnut Street to the south line of Maple
Street, a width of Fifteen feet, lying in and dividing
Block Five and all of the alley f rom the north line of
Maple Street to the north line of Block Four, a width
of fifteen feet, lying in and dividing Block Four, all
in Boulevard Heights Addition, a Subdivision of Outlot
Forty-four in the City of Cape Girardeau, Missouri, as
dedicated and designated on the plat of Boulevard Heights,
filed of record in the Recorder's Office, February 9,
1925, in Plat Book 3 at page 55, is by the City Council
ordered vacated as Public Street and Alleys and that the
Dedication in respect thereof as shown by the dedica.tion
of Boulevard Heights Addition is revoked and that the
owners of a_djacent property to said vacated streets and
alleys be and become entitlec'� to the reversion of said
streets and alleys.
Further, that the Mayor of the City of Cape Girardeau,
Missouri, be and is hereby authorized to execute and de-
liver unto said owners, to-wit, Osteopathic Hospital Cor-
poration, a Pro-Forma Decree Corporation of Cape Girardeau,
Missouri, a Quit-Claim Deed for and on behalf of said City
as to the right, title and ir,terest of the City therein and
as above described.
