Triat th� Cit� Council ot the City of Cape Girardeau, Niissouri, has by resolutio�z in writing, duly opted at a meeting of the said Council held on the -�j��j day of , 195(r , found and declared it necessary to improve that part of Sheridan t�rive and the Relocation of Sheridan �rive in the City of Cape Girardea�u, i'rom the e�.sting concrete in�:vement at the south side of I.nc:te��endence �treet to �he center line of Good Hope Street, b�r gradin� to the esta'�lished grade and cons��uctin� thereon a Portland Cement Concrete Pave�ent, 6 inches thick and 30 feet wide between the baci�s of curbs, except at the various intersections where the p2,vement shall be carried ou-t as shokrn or. the plans, to�ether with iniegral curbs alon� the sides thereof, a11_ as shoVm on the nlans for said ii:ir�rove:�;�nt the total distance of said improvement to be approYima.tel,y 16�1� feet, and along which property subject to assessment for said improvement totals approximately 305 i.�feet. Said resolution further provided tha.t said work of improvement should be done by contract let in the usual and ordinary way as provided by law and ordinance and further provideci that special tax bi11s should be issued in payment of the cost of saica improvement based on an assess- ment against the property fronting or abutting on said 1�OT"t10I1 of said street so improved, as provided by law and by Comr.lission Form Urdinance No. 32g, passed and approved on the Sth dayr of N�ay, ].9z5, anc� accordi�Zg to the plans� specif'ications and estimate of cost therefor inade a�1d filed with the City Clerk and adopted by t.'ne Council, and in accorda.zce v;ri�th this ordinance, SECTION 2.. The Couricil finds anci dec]_ares tY:at said resolution has been published in tl.e Southeast I�.issourian, a dail�r newapaper x�rinted and published in the City of Cape Girdrdeau, ::issouri, a�id doin�; the Cit jr printing for seven consecutive issves, a.�:d that m��re than ten da;�rs :ia.ve elapsed since the last publication thereof _n said pZ.pe?�� and tha.t a majority of the resident owners of lands liable for the cost �f' said i::x�rovement at the date of �?assage of said resolution and who also o�m a r.iajorit�r of the fz�ont feet fron+�ing and abutting on said impr•ovement czid not withiiZ ten days after said last date of publication of said resolution, file wi�h the City �le-rk tr.ieir protest against the improvement as required by law and the ordinances of the City. The Council being of the opinion that the necessit3r ;;ti1.l exists for the improve- ment of said aheridan D�ive ancl �he 1?eloca�ion of Sileridan J;�ive as proposed in said resolution, hereby reaffirnis its prev�.ous action in declax- ing said improvement necessary. SECTION 3. The �ouncil further orders and directs that said work of ir:�brovement on that ��.rt of �heridan Drive : above described be done by contract, and that it be done so tnat it will in all respects co.n�ly with said plans and specifications therefor, and th�.t the cost thereof will not exceed the estii��ate of cost for said work prepared by the City Lngineer and on file ir� the oftice of the Ci.ty Clerit and here- tofore approved by the Council, atid that said work of in�pr�v�r��ent be done in such r�anner as to coi•i�ly ��ith the teri.ls and provisions of said Cor,�.r��iss- ion r'ornl Ordinance Ivo. 32� and of this ordinance. The Council further finds and declares that in its jucigment the condition of the General �tievenu2 iiur.d of the City is such that no �rt af the cost of said i;�proveinent shall be �aid therefror.i. SECTION 5. The City �:;leric is hereby authorized and directed to advertise for bids in the newspaper doin�r the r.iL f printinr; for i;he construction ai said im��rover�ent ;;yccordin� to the plans, s��ecifications a;�d estirnate of cost therefor, and in �,ccordancc; with said Cor�rission For;t� �rdinance Pao, 32�, ar.d this o�•di.iance, and the clerk in advertising �or such bids shall advise bidde:r of th< d.enosit and 'oozid reruir�d bv law to be �iven, and further advisc; bidder Ghat .no e�nt'r�ct, wi1.l..bc �4�.,.rded the successful bidder unless he sti;�ul��i;es in his nroposal that he will acce;�t s�ecial tax bills in pay;_Zent therefor, and that he will in no event hold the City liable for the cost of i,h�: work or any part thereof, and will further, u;�on conl�letion of the work, pay the engineer' s services and any ot7ier cost accruin� in cor..pleting his contract.
