AN ORDINANCE AMENDING COMMIS�ION FONM ORDINANCE
N0. 1189, PASSED AND APPROVED ON FEBRUARY 28, 19l�9,
BY ADDING TWO NEW SECTIONS THERETO TO BE DESIGNA TED
AS S:ECTIONS 2 (y) a�nd 34A, DEFINING COMMERCIAL
MO TOR VII3I CLES AND PROHIBI TING THROUGH C OMMERCIAL
VEHICLE TRAFFIC IN CITY PARKS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS :
SECTION 1: That Commission Form Ordinanee No. 1189 paased
and approved on Februar� 28, 19I�9, be and the 3ame hereby� is
�mended by adding �. new pr�ragraph to Section 2 thereof to be
designated aa Section 2(J) which said paragraph shall read a�
follows:
Section 2(T) . Commercial Motor Vehicle - A motor
vehicle designed or regularl� used i'or carrying freight
and merchandise or more than eight passengers.
SECTION 2: That Commisaion Form Ordinance No. 1189
pasaed and approved on Februar4 28 , 1949� be and the same hereby
ia amended b adding a new section thereto to be designated
as Section 3�A, which said section sha�ll read as follows :
Section 34A. No commerci�.l motor vehicle haning a
manufacturer�s rated eapacitf of one ton or mor� shall be
driven or opersted in, over, or through any public park
in the municipalitg of Cape Girardeau, Missouri , unless
such operation is required in connection with work being
done in such public park or fbr the loading or dischrsrging
of pa.ssengers in auch public park.
SECTION 3: Th�t this ordinanee is neces�ary 1'or the immediate
pre�ervation of the public peace , health and sa2'etT and shall take
effect and be in force from and after its pas�age and approval.
