AN ORDINANCE �MENDING COMNNUSSION FORM ORDINANCE N0. 566,
PASSED AND APPROVED ON TiIE 25TH DAY OF APRIL, 1949, BY
CHAidGING THE ZONING ON TH� SOUTHWEST PART OF OUTLOT 80
IN THE CITY OF CAPE GIRARDE�U, MISSOURI� FROM A CLASS
A, ONE FAMILY DISTRICT TO A CLASS I, LIGHT IiVDUSTRY.
WHEREAS, The City Council of the City of Cape Girardeau' ?�ii.ssouri,
has received an application from the owner of the hereinafter described
property requesting that the zoning of the same be changed from a Glass A,
One Famil� District to a Class I, Light Industry District in an area de-
scribed as follows:
That part of the southeast Quarter (SF�) of Outlot
Eighty (80), from a point on the Northeast corner of
a 1-acre tract of land described in Warranty Deed to
one William M. Robinson and wife recorded in Book 110
at Page 124 of the Cape Gir�rdeau County Deed Records,
which said Northeast corner is South 82° 22" East, 807.5
feet to a point; and South 8° West 525.8 feet from the
ATorthwest corner of the 5outheast Quarter of said Outlot
g0; thence run South 82° East for a distance of 70 feet
to a point; thence South 8° West 267 feet to the North
line of the Cape Girardeau-Jackson Gravel Road for a
beginning corner; thence North 8° East 79 feet; thence
South g2° East 150 feet; thence Sbuth 8° West to the
North line of the Cape Girardeau-Jackson Gravel Road;
thence 150 feet more or less� along the north line of
the Cape Girardeau-Jackson Gravel Road to the point of
beginning.
and
WHEREAS, public notice of such application for such change was
given as was provided by Commission rorm Ordinance No. 566 and a public
hearing was held by the City Council on December 8� 195g; and
WHEREAS, said application has been submitted to the City Planning
and Zoning �ommission for its recomm�ndation and report� and said City
Planning and Zoning Commission reported and recommended that said property
be rezoned in accordance with said application; and
WHEREAS, no property owners owning property adjacent or near to
the property included within such proposed change have protested such
change; and
WHER�AS, the Cit,y Council fi�ds t�at it would be to the best
in-terest of all property owners concerned for said property to be rezoned
to a Class I, Light Industry District, NOW THEREFORE,
BE IT ORDAIPdED BY THE CITY COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI AS FOLLOWS:
SECTION l: That Section 2 of Com.mission Form Ordinance No. 566,
passed and approved on the 25th day of april, 1949, shalZ be, and the
same is hereby amended to change the boundary of the present Class I,
Light Industxy District so as to include therein the hereinaf'ter described

property, which said property is hereby rezoned from its present zoning
to a Class I, Light Industry District, to wit:

a 1-acre tract of land described in Warranty Deed to
one William M. Robinson and wife recorded in Book 110
at Page 121,, of the Cape Girardeau Count.y Deed Records�
which said Northeast corner is South 82° 22" East, g07.5
feet to a point; and South 8° West 525.8 feet from the
Northwest corner of the Southeast Quarter of said Outlot
g0; thenee run South g2° East for a distance of 70 feet
to a point; thence South 8° West 267 feet to the North
line of the Cape Girardeau-Jackson Gravel Road for a
beginning corner; thence North g° East 79 feet; thence
�outh 82° East 150 feet; thence South 8° West to the
Atorth line of the Cape Girardeau-Jackson Gravel Road;
thence 150 feet more or less, along the north line of
the Cape Girardeau-Jackson Gravel Road to the point of
beginning.
SECTION 2: The City Council hereby declares that the property
described in Section 1 above is at the present particularly suited for
the uses and purposes of a Class I, Light Industry District and that the
changes authorized hereby are reasonable and in reasonable conformity with
the existing use and value of the immediately surrounding property.
SECTION 3: All ordinances and parts of ordinances in confliet
with the provisions hereof are hereby repealed, but all other provisions
of Commi.ssion Form Ordinance No. 566 not amended or repealed heraby shall
remain in full force and effect.
SECTION 4: This ordinance shall take effect and be in force from
and after ten (10) days after its passage and approval.
