F7HE�tEA.S, the City Council of the Cit�� of Cape Girardeau, Cape Girardeau
County, Missouri, by Ordinance Ido. 1823, cluly and regularly adopted at a meeting
of said Council duly and regularly held on the llth day of July, 19S'7, did direct
that a special election be held in said City on Tuesday, the 2`7th day of August,
1957, for the purpose af submitting to the qualified electors of said City the
followin� proposition, to-wit:
PROPOS�TION
"Proposition to issue the bonds of the City of Cape
Girardeau, Missouri, in the amount of Two Hundred
Ninety-five Thousand Dollar.s ($295,000) to provide
funds for the purpose of equipping and improving
the municipal airport of said City."
and
WHEREP.S, the said Ordinance did direct that the aforesaid election be
held at the pollin� places in said City therein set out; and
WltEREAS, due and regular notice of said election was given as directed
by said Ordinance and as required by law, by publication in The Southeast Missourian,
a daily newspaper published and of general circulation in the �ity of Cape Girardeau;
said newspa�er having previously been admitted to the Post Office in saa.d City of
Cape Girardeau as second class matter and having been published regularly and con-
secutively for a period of more than thre� (3) years prior to the publication of
said notice, and said newspaper having a list of bona fide subscribers, voluntarily
engaged as such, who have paid or agreed to pay a stated price for subscriptions
thereto for a definite period of time; and

WHEREAS, said notice was published in said newspaper on the 2�+th day
of July, 1957, and on the 7th, 14th, and 21st days of August, 1957, three (3) of
the aforesaid publications in said newspaper having been ma.de for at least three
(3) consecutive weeks and �he first of the aforesaid publications in said newspaper
havin� occurred at least twenty-one (21) days before and the last one within two
(2) weeks of the date of said election; a.nd
WHEP�E'.AS, the aforesaid Ordinance adopted on the llth day of July, 1957,
dicl make provision for the use at said electian of ballots in the form provided by
said Ordinance; and
WHEREA,.S, the said ballots used at said special election were in the form
as set forth in the aforesaid Ordinance; and
WHEREA,.S, thereafter the City CoLmcil did appoint judges and clerks of
said election; and
WHEREAS, the said election was duly and regularly held in all respects
as required by the Statutes of the State of Missouri; and
WHEREAS, the judges af said election, immediately upon the closin� of
the polls on said 27th day of August, 1957, did make out, certify, and transmit
to the City Council the returns of sa�d election; and
WHEREA,S, this City Council, on the 29th d.ay of August, 1.957, did canvass
said r�turns and did then find, and does TiOW a�ain find, determine, and declare that
a� said election �hree thousand, thirty-file (3,035) votes were cast on the afore-
said proposition, of which two thousand, two hundred forty-seven (2,247) votes were
cast in favor of the proposition and sevexi hundred eighty-eight (788) votes were
cast against the proposition; and
WHEREA,S, this Council daes now further find and determine that at the
said election more than two-thirds of the qualified electors votin� on the said
proposition assented th�reto; and
WHEREA�, the City Council of said City is now fully and legally authorized
and empowered to issue the bonds of the said City of Cape Girardeau in the principal
amount of Two Hundred Ninety-five Thousanci Dollars (�297,000) for the purpose herein-

WHEREA.S, the amount of bonds authorized to be issued at the aforesaid

five Thousand Dollars ($295,000), together with the aforesaid outstanding indebted-
ness, did not and does not now exceed any limit of indebtedness prescribed under
the Constitution and Statutes of the State of Missouri; and
WHEREAS, heretofore, to-wit: on the llth day of September, 1958, pur-
suant to notice given as directed by this Council, the said bonds were �,warded
and sold to the highest and �est bidders i�herefor; and
WHEREAS, the purchasers of said bonds have requested that said bonds be
made pay�.ble as to principal and interest at the Mercantile Trust Company, in the
City of St. Louis, State of Missouri; and
WHEREAS, this Council does now *'ind and determine that the aforesaid re-
quest should be approved; and

WHEREAS, this Council does now find that it is necessary and desirable
to proceed forthwith to provide for the isauance of said bonds: NOW, THEt`tEFORE,
BE IT ORDAINED BY THE C ITY COUNCIL OF THE CITY OF CAPE GIRARDEAU, CAPE
GIRARDEAU COUNTY, MISSOURI, AS FOLLOWS:
SECTION 1. That there are hereby authorized and order to be prepared
and issued bonds a� the City of Cape Girardeau, Missouri, in the amount of Two
Aundred Ninety-five Thousand Dollars ($295,000) to provide funds for the purpose
of equippin� a,nd improving the municipal �.irport of said City. Said bonds aha11
be of the denomination of One Thousand Dollars (�1,000} each; shall be numbered
from One (1) to Two Hundred Ninety-five (2�5), inclusive; shall bear date of
September l, 1958; and shall bear interest from date thereof at the rates per
annum hereinafter set forth, payable semi-.�,nnually on March 1 and September 1 in
each year until the principal of said bonds, respectively, shall have been fully
paid. Interest accruin� on and prior to t:ae respective maturity dates of said bonds
shall be evidenced by appropriate interest coupons to be attached to each of said
bonds. Both principal of and interest on said bonds shall be payable in lawful
money of the United States of America at the Mercantile Trust Company, in the City
of St. Louis, State of Missouri. The said bonds shall be executed by the signature
of the Mayor of said City, under the seal of said City, attested by the si�nature
of the City Clerk, and the �nterest coupons to be attached to said bonds shall be
executed by the facsimile signature of said City C1erk. The said bonds shall bear
interest at the rates and shall mature, without option of prior payment, in the
amounts and at the times following, to-wit:

itself indebted and, for value received, hereby promises to pay to bearer

semi-annually on March 1 and September 1 in each year until the principal hereof shall
have been paid. Interest accruing on this bond on and prior to the maturity date
hereof shall be payable upon presentation and surrender of the annexed interest
coupons as they severally become due.
Both principal of and interest on this bond are payable in la�rful money
of the United States of America at the Mercantile Trust Company, in the City of
St. Louis, State of Missouri, and for the prompt payment of this bond and the
interest hereon, the full faith, credit, and resources of the City of Cape Girardeau,

duly had by the City Council of said City.
It is hereby cer'cified and recit�3d that all acts, conditions, and things
required to be done, precedent to and in the issuance of this bond, in order to
rna.ke the same a lawful and binding obligation of said City, have been done, have
happened, and have been performed in regul�,r and due forcn, time, and manner, as
required by law; that provisian has been inade for the levy of a direct, con�inuing,
annual tax upon all taxable, tangible prop�rty in said City for the payment of the
principal of and the interest on this bond; and that the total indebtedness o�'
said City, including this bond and the issue of which it is one, does not exceed
any statutoxy or constitutional limit.
IN T�TIMONY W�iEREOF, the City of Cape Girardeau, in the State of Missouri,
has executed this bond by causing it to be signed by the Mayar of said City, under
the seal of said City, attested by the City Clerk, and has caused the annexed inter-
est coupons to be executed by the facsimile signature of said City Clerk, which
signature �;he said City Cl�rk, by the execut:i.on of this bond, adopts as and for her
own proper signature, and this bond to be dated September 1, 1958.

And provision to meet the requirements of this Ordinance shall in due time, manner,
and season annually be made.
SECTION 5. That said tax shall be extended upon the tax rolls and shall
be collected in the same ir�,nner and at the same time as otner city taxes are extended
and collected, and the rate of tax which shall be so extended sh�.11 be suificient 1n
each year iully to produce the su�s set otit above, respectively, after due allowance
shall have been made for probable delinquencies in the payment of taxes and the
customary costs of collection, and the proceeds derived from the collection of such
tax sr,.all be credited to �, special fund hereby created in the treasury of said City
and designated "AIRPORT 7MPROVEMENT BONDS, INTEREST AND SINKING FUND," and shall be
used exclusively for the purposes herein required.
SECTION 6. That the City Treasurer of said City be and he is hereby
authorized and instructed to remit for deposii in the place of pa,yment hereinanove
named, not less than five days prior to t he accruing of the interest and to the
rilaturity of the said bonds, tYze au�ounts which will then respectively become due.
The said Trea,surer is further directed to include with each such remittance tne
usual and customary fee o� the paying agexit for its services and responsibili;�y
in connection with tize payment of said coupons and bonds.

SECTION 7. That the Mayor and �;he City Clerk are hereby authorized and
directed to cause the bonds herein described to be prepared and to execute the same
as herein directed, to cause the same �co be registered in the office of the State
Auditor, and thereupon to deliver the said bonds to the purchasers thereof.
SECTION 8. That the proceeds received upon sale and delivery of the
bonds herein authorized to be issued, immediately upon receipt thereof, shall be
set aside in a separate fund to be used onl3r for the purpose for which said bonds
were authorized. The accrued interest and premium received upon sale and delivery
of the aforesaid bonds shall forthwith be deposited in and credited to the AIRPORT
INIt'ROVEMENT BONDS, INTEREST AND SINKING FITND created in Section j of this Ordinance.
SECTION Q. Th�,t all ordinances or parts of ordinances in confliet with
the provisions of this Ordinance shall be and the same are hereby re�ealed, insofar
as they may so conflict, and tnis Ordinance shall be in full force and effect from
and after its passage and approval.
