AN ORDINANCE AMENDING COMMISSION FORM ORDINANCE N0. 566,
PASSID AND APPROVID ON THE 25th DAY OF APRIL, 1929, BY
CHANGING THE ZONING OF AN AREA BEING THE NORTH SIDE OF
BROADWAY STREET� 150 FEET DEEP, BE�fEEN CARUTHERS AND FOREST
STREETS IN THE CITY OF CAPE GIRARDEAU, MISSOIIRI, FROM
A CLASS to "E" and "F" CO�CIAL DISTRICT.
WI�EREAS, the City Council of the City of Cape Giraxdeau,
Missouri, has been petitioneo2 to change the zoning of the
hereinafter described property f�om Class "A" to the "E" and
"F" Commercial Class, which property is described as:
An area being the North side of Broadway
Street, 150 feet deep, between Caruthers and .
Forest Streets in tbe City of Cape Girardesu,
Missouri.

WHEREAS� public notice as provided by Commission Form Qrdinance
No. 566 has been given by publication in the Southeast Missourian�
and a copy of such publication has been filed with the City Clerk�
as is by law required�and
WHEREAS, said proposal has been duly submitted to the City
Planning and Zoning Commission for its recommendation and said
commission has reported favorably and recommended sa3d rezoning,
and
W�IE�REAS, no property owners owning property adjacent or
near to the property included have protested said change in zoning�
and
WHEREAS, the City Council does declare that it would be to the
best int$rest of a11 property owners concers�ed for said property to bs
rezoned as herein stated� NOW THEREFORE,
BE IT ORDAINID BY THE CITY COUNCIL OF 'I'HE CITY OF CAPE GIRARDEAU,
MISSCAJRI, AS FOLIAWS:
SECTIOAI 1. That section 2 of Commission Form ardinance No. 566, passed
and approved by the City Council on the 25th day of April, 1929, shall be

described property f`rom "A" cla.ss to "E" and "F" class commercial
district and said property is described as:

SECTION �. The City Council hereby finds and declares that the property
described in Section 1 above is at the present particularly suited for the
uses and psmposes of s the "E" and "F" Class and that the changes
suthorized are reasonable and in reasonable conformity with the existing
uses and values of the i.m�ediately surrou�ding propert�.
SECTIOIJ 3. Al1 Ordinances or parts of Ordinances in conflict with the
provisions hereof are hereby repealed, but all other provisions of
Commission Form Ordinance No. 566 no� amended or repealed shall remain
in ftzll force and efrect.
SECTION 4. This ordinance shall take ef�ec-t anr': be in force and effect
from and after 10 days of its passage and approval.
