ADOrTING THE PLANS FOR THE CONSTRUCTION OF SANITARY SEWERS IN SAID SEWER DIS�RICT
N0. 12 M, AUTHORIZING THE (7WNERS OF PROPERTY TO PROCEED WITH THE CONSTRUCTION 0�'
SAID SANITARY SEWERS UNDER A PRNATE CONTRACT AND PROVII)IlVG THAT SAID CONSTRUCTION
BE SUBJECT TO INSPECTiON BY THE MISSOURI STATE DNISION QF HEE�LTH, SUBJECT TO THE
INSPECTION AND APPROVAL OF THE CITY �' CAPE GIRARDEAII, MISSOURI.
BE IT Q3DAINED BY THE COUNCIL OF THE CITY OF CA� GIR.ARDEAU, MISSOUR,I,
AS FOLLOWS:
SECTION 1. That the Council hereby deems and declares that a public necessity
exists for the construction and maintenance of a system of sanitary sewers in Sewer
Diatrict No. 12 M, a subdivision of Sewer District No. 12, as defined by Commissio�
Form Ord inance No. � � .�- , passed and approved on the %�-a day o£ <<< <�/T�,
1958, and that the boundaries of said Sewer District No. 12 M, shall be as fo2lows:
All of what is known as Dennis Scivally Park and all of Brookwood Hills.
SECTION 2. That the plans and specifications for the construction of a
system of sanitary sewers in said Sewer District No. 12 M, above described, and
previously submitted to the Council are hereby approned and adopted as the plana
and specifications for the constructi.on of said system of sanitsrq sewers in said
Sewer District No. 12 M, and axe hereby ordered filed in the office of the City Clerk
of the City of Cape Girardeau, Missouri.
SECTION 3. Tha.t the owners of property in Sewer District No. 12 M are hereby
authorized to have said sanitary sewers constructed in said Sewer District No. 12 M,
after having secured tentative approval and final inspection and approval of the
Missouri Division of Health; after having agreed in writing to pay to the City of
Cape Girardeau, Missouri, the cost of engineering and inspection; ha.ving ginen the
City of Cape Girardeau, Missouri, evidence satisfactory to said City that it will
not be held liable for any and all damage or loss which might in any way result by
failure of the Contractor to carry out the proviaions of the specifications, or by
negligence of the Contractor or any subcontractor, employee, servant or agent of
either.
SECTI�N 4. This ordinance ahall take effect and be in full force from and
after the effective date following its passage and ap�oval.
