SiCTIUiI l. �rr��t the City Cow�cil� of the City of Cape Girardeau,
P�iissouri, has by resolution .in ti�miti.�z", duly adopted at a nleetin� of the
saicl Council held on �;he f�'.�'- c:aJ of :_. ..- - - _• . � 4 , 195 j , found and
declared it to be necessaxy to improve that part of Sunse-t Boulevard .
in the Citf of Cape Girardeau, A�Iissouri, fron the north line of t�dilliam
Stre�;t to a point 1g.5 feet north of the south line of r2erriwether Street,
by gradirl� to the established grade and constructino thereon a Portland
Cernent Concre�e Pavement 6 inches thick and 30 feet wide between the backs
of curbs except at the intersection with iier•riw�ther Street, wi�ere �aid
paveinent shall be constructed as shotim oiz the plans, together vaith inte�ra.l
cur�� along the sides thereof
the tatal distance of said im�iovenz�nt to be apA�roxir�ately 292 feet, and
alon� which property subject to assessment for said improvement totals
approximately 5�6.7 feet. Said resolution further provided tha�t said work
of improvenent should be done by contract let in the usual and ordinary way
as provided by law anc? ordinance a.nd further provided that sl�s.ecial tax bills
should be issued in pa;�ment of the cost of said improvenent 'aasec� on an
assessment a�ainst the nroperty f-rontino or abutting o�7 said ;�ortion of said
street so ir.iproved, as �rovided by law and bJ Co�unission I'orm Ordinance �To.
32�3, passed and a��-�rovecl on the �th da�r of iia3r, 1925, and according ta the
plans, specifications and estinate of cost therefor made and filed with the
City Clerk and adopted by the Council and isz accordance with this ordinancey
and Cos�m�.ssion Form Ordinance Pdo. 18�1�.
S��CTION 2. That the Council finds and declares that said resolution
has been published i.n the Southeast ���issouria,n, a daily neti�rs�aper �rinted and
published in the City of Ca�e Girardeau, i:issouri, and doin� the City printing,
for seven consecutive issues, ancl that more than ten dafs have elapsed since
the last �ublication thereof in said ��aper, and that a ma,jority of the resident
owners of lanas 1i.able for the cost oi saicl improver.ient at the date oi' passage
of said resolution and who also oVrn a n�:.jority ai the front feet frontino a,nd
abutti�z� on said im,orover?�ent did not within ten days after said last date of
pubLication of said resolution, Yi1e with the City Clerk their protest a�ainst
the ir.�provernent �:s rerui�ed by law ancl ordiizances oi' the Cit f. The Council
being of the opinion that the necess�ty still exists for the improvement of
said Sunset Boulevard pro�osed in saic� resolution, hereUy
reaffir�s its previous action in declarin;; said i�.provement necessary.
S'�CTIdN 3. That the Council zurther finds that all reruire�nts imposed
by law and ordina.nce for sa,id iin-,�roveznent havc been complied with and that it
has tlieieby acruircd authority to order said im�rovement and it now hereby
orders and directs tha� that part of' ;;unset Bou7.evard in the
Cit;� of Capc Gira,rde�.u, Iviissouri, coruaenci.nb at �ho north line o�' tdilliam
Street and e.xtendial� to a point 13.5 feet north of the south line of Merriwether
Street
be irnproved by gradir� to the establ.ished grade and construc�ing thereo�l a
Partiand Cer;�ent Concrete Pavernent 6 inches thick and 30 feet wide between the
backs oi cur�s except at the intersection with �ierriwether Street, where said
pavement shall be cons�Lructed as shown on the plans, togetYier with integral
curb along the sides thereof
