AN ORDINANCE PRESCRIBING THE MANNER OF LETTING
CONTRACTS FOR PUBLIC WORKS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CAPE GIRARDEAU ,
MISSOURI AS FOLLOWS :
SECTION 1 : The following sections of this ordinance shall
apply to the letting of contracts for public works under the pro—
visions of Chapter 88 , Revised Statutes of Missouri , unless other—
wise provided by statute or ordinance.
SECTION 2: 1�hen the City Council shall have acquired the right
to proceed with a public improvement as provided in Chapter 88 ,
Revised Statutes of Missouri , it sha11 cause the city clerk to
advertise for bids for the doing of the improvement according to
the plans and specifications adopted by the council and filed with
the city clerk which advertisement shall be published by two con—
secutive insertions in a weekly paper or seven consecutive issues
in a daily paper in some newspaper published in the city, and in
other papers if the council so orders , and which advertisement shall
state the nature of the work to be done , the place at which the
plans and specifications may be seen and that tax bills will be
issued in payment therefor.
SECTION 3: Every bid shall be accompanied by a certified check
in the sum of One Hundred Dollars , drawn on some bank in the City
of Cape Girardeau , Missouri , and payable to the Mayor of the City
of Cape Girardeau , which check shall become the property of the City
of Cape Girardeau , in case such work shall be awarded to any bidder
who shall fail , refuse , or neglect within ten days after the acceptance
of his bid by the council , to enter into a written contract to do
the work according to the plans and specifications and his bid , and
also to execute a sufficient bond , acceptable to the Mayor and con—
ditioned as herein provided for, and in case of failure or refusal
on the part of the successful bidder to perform any of the require—
ments required of him by law, the Mayor shall endorse said check and
deliver it to the Treasurer, who shall credit the same to the General
Revenue Fund.
SECTION 4: Each bid and the check accompanying it shall be
enclnsed in a sealed envelope and addressed to the City Clerk and
the er�velope shall be plainly marked so as to indicate the work bid
for. �11 checks of unsuccessful bidders shall be returned to them
as soon as the contract and bond with the successful bidder are signed ,
and filed with the City clerk , and if he fails to enter into same
as required by law, the council may award the contract to the next
bidder or it may re—advertise for bids and proceed as before , in
which case it may cause the plans , specifications or estimate , to
be modified. If a satisfactory bid or bids shall be received , the
council shall Iet the work to the lowest and best bidder, but all

the bids shall be on the same material and character of work, so
that such bids will be competitive , and no bid shall be accepted at
a price exceeding the estimate made by the City Engineer and filed
with the City Clerk. The Council may reject all bids , if it sees
fit , and may accept and adopt any such bid by motion or resolution
and direct the Mayor to sign the contract on behalf of the city.
The Council may , by resolution or ordinance , extend the time fixed
in the contract for the completion of the work , but such extension
shall be made before the time fixed has expired. And the Council
may, if it desire , require any contractor to guarantee that such
improvement will last for a specified term of years , and during
such term will be kept in repair, and may also require the contractor
to give to the City an approved bond for the faithful performance
of any obligation.
SECTION 5 : Before the contract for the performance of such
work shall be signed by the Mayor , the successful bidder shall enter
into a good and sufficient bond in the amount of the bid, which
bond shall be approved by the Mayor. If the surety given on said
bond is personal , then the sureties shall be residents of the County
of Cape Girardeau , Missouri and free tniders of said County.
SECTION 6t This ordinance shall take effect and be in force
from and after ten days after its passage and approved.
