AN ORDINANCE AI��ENDING COMR�IISSION FORM ORDINANCE N0 . 566 ,
PA5SED AND �PPROVED ON THE 25TH DAY OF APRIL, 1929 , BY
CHANGING THE ZONING QF LOT TWO (2 ) OF BLOCI� ONE ( 1 ) OF
WULFERSt SUBDIVISION , CAPE GIRARDEAU, NiISSOURI FROM
CLASS °A" RESIDENTIAL TO CLASS "E" , COMh.FiERCIAL.
WHEREAS , the City Council has received an application from
the owners of the following described property requesting that the
zoning af the same be changed fram Class "A" , Residential , to Class
"E" , Commercial district , in an area described as follows :
Lot Two (2) of Block One ( 1 ) of Wulfers ' Subdivision ,
Cape Girardeau , A4issouri ,
and ,
WHEREAS , public notice of such application for such change
was given as provided by Commission Form Ordinance No. 566 , and a
public hearing was held by the City Council on December 14 , 1959 ,
and
WHEREAS , said application has been submitted to the City Planning
and Zoning Commission for its recommendation ar�d said City Planning
and Zoning Commission recommended that said property be rezoned from
Class "A" , Residential district , to Class "E" , Commercial district ,
and ,
WHEREAS , no property owners owing property adjacent or near to
the property included within such proposed change have protested
such change ;
NOW THEREFORE, BET IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI , AS FOLLOWS:
SECTION 1 : Section 2 of Commission Form Ordinance No. 566
passed and approved the 25th day of April 1929 is hereby amended
to change the boundary of tY�e �resent Class "E" , Commercial district ,
so as to include the hereinafter described praperty, which said prop—
erty is hereby rezoned from Class "A" , Residential district , to Class
"E" , Commercial district , to—wit :
Lot Two ( 2) of Block One ( 1 ) of Wulfers ' Subdivision ,
Cape Girardeau , Missouri .
SECTION 2: The City Council hereby finds and declares that the
property described in Section 1 hereof is at the present time par—
ticularly suited for the uses and purposes of Class "E" , Commercial
district , and that such cY�ange authorized hereby is reasonable and
in reasonable conformity with the existing uses and value of the
immediately surrounding property.
SECTION 3: This ordinance shall take effect from and after
ten days after its passage and approval .
Passed and approved this 14th day of December , 1959.
