ADOPTING PLANS FOR �IE CON5TRUCTION OF 5ANITARY SEWERS IN SAID DISTRICT, AUTHORIZING
THE OWNERS OF LAND ENIDRACID IN SAID DISTRICT TO PRQCE�'�,D WITH THE CONSTRIICTION OF SAID
SEWERS SUBJECT TO Cr:RTAIN CONDITIUNS AI�ID SETTING OUT THE METHOD AND REQUIREMENTS FOR
SAID COPTSTRUCTIOAi AND PAYMENT OF SAME.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY CF C� GIRARD�AU, MISSOURI, AS
FOLLO��IS:
5ECTION 1. That the folyowing described line shall be the boundary for 5ewer
District No. 12 Q, a subdivision of Sewer District No. 12, in the City of Cape Girardeau,
Missouri, as said Sewer District No . 12 has been eatablished by Commission Form Ordinance
No. 1942, passed and appro�ed on the 25th day of August, 195�:
Begin at the S.W. corner of Lot 1, Block 16, Suburban Heights, on the N. boundary
line of Sewer District No. 12 G; thence N. along the west line of Suburban Heights, to
the N. W. corner of Lot 3, Block 15, Suburban Heights; thence E. along the N. line oF
said Lot 3, to the N. E. corner of Lot 3; thence in a N. E. direction to the N. W.
corner of Lot g, Block 14, Suburban Heights; thence E. along the N. line of Lots 8 and
l, Block 1/�., and the N. line of Lots 1, 2 and 3, Block 13, Suburban Heights, and said
line extended, to the center line of Delwin Street; thence S. along the center line of
Delwin 5treet, 85 feet; trence E. and with the AT. line of Lots 15 and 1, Block 11, and
the N. line of Lots l, 2 and 3, Block 10, 5uburban Heights, and said line extended, to
the center line of Randol Avenue; thence S. along the center line of nandol Avenue, to
the S. line of Suburban Heights and the N. line of Seiaer District No. 12 G; thence W.
along the N. line of Sewer District No. 12 G, as�d the S. line of Suburban Heights, to
the point of beginning.
SECTION 2. That the plans for the constructien of Sanitary Sewers in Sewer District
No. 12 Q, now on file in the office of the City Clerk, and the easements acco�anying
said plans for the construction of said sewers across private property, axe hereby
approved and adopted and ordered filed, and said easements ordered recorded in the
land records of Cape Giraxdeau County, Missouri.
SECTION 3. That the owners of property in Sewer District No. 12 Q are hereby
authorized to proceed with the construction of said sewers subject to the following
conditions:
Tha.t the ownera shall axrange for the construction of said sewer system with a
responsible contractor who shalt furnish bond, satisfactory to the City, for the
performance of said work in strict accordance with the plans therefor, and sub�ect to
the approval of the City and to the Missouri Division of Health, also, that said
contxactor shall furnish the City satisfactoxy evidence that the necessary insurance
of the various types required by the City, shall be in effect for the duration of the
contract. That the contractor shall agree to pay the prevailing wage for labor, as
provided by law and ordinance. That satisfactory assurance be given the City that
payment will be ma.de by the owners to the contractor for the full amount of the work
upon its completion and acceptance by the City and that payment will be made to the
City at that time for the cost of inspection of the work.
SECTION 4. That following the completion and acceptance of the work, the Citp
sha.11 incorporate said sanitary sewers into its existing sanitary system for future
ma,intenance and operation of same.
SECTION 5. This ordinance to take effect and be in full force from and after
the effective date following its passage and approval.
