AN ORDINANCE AN'�ENDING COMNISSION FORM ORDINANCE N0 . 566 ,
PASSED AND APPROVED ON THE 25th DAY OF APRIL, 1929 , BY
CHANGING THE ZONING OF THAT P;�RT OF SURVEY 3091 , IN
FRACTIONAL SECTION 29 IN THE CITY OF CAPE GIRARDEAU,
T�4ISSOURI , LO�ATED AT 1827 BEND ROAD FROM CLASS "A" ,
ONE FAMILY DISTRICT, TO CLASS " E" , COMMERCIAL DISTRICT ,
WITH THE USE RESTRICTED TO BARBER SHOP .
WHEREAS , the City Council has received an application from
the owner of the following described property requesting that the
zoning of the same be changed from Class "A" , one family district ,
to Class " E" , commercial district, in an area described as follows :
All that part of Survey 3091 in Fractional Section 29
located at 1827 Bend Road in the City of Cape Girardeau ,
Missouri ,
and ,
WHEREAS, public notice of such application for such change
was given as provided by Commission Form Ordinance No. 566 , and
a public hearing was held by the City Council on September 8 , 1959 ,
and
WHEREAS , said application has been submitted to the Citv Planning
and Zoning Commission for its recommendation and said City Planning
and Zoning Commission recommended that said property be rezoned from
Class "A" , one family district, to Class "E" , commercial district ,
and that the use of said property be restricted to barber shop, and
WHEREA5 , no property owners owing property adjacent or near to
the property included within such proposed change have protested
such change ;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI , AS FOLLOWS :
SECTION l . Section 2 of Commission Form Ordinance No, 566
passed and approved the 25th day of April 1929 be amended to change
the boundary of the present Class " E" , commercial district , so as
to include the hereinafter described property which said property
is hereby rezoned from Class "A" , one family district , to Class "E" ,
commercial district , with the use permitted thereon restricted to
any use permitted in the Class "A" , one family district , and to
barber shop, to—wit :
All that part of Survey 3091 in Fractional Section 29
located at 1827 Bend Road in the City of Cape Girardeau ,
Niissouri .

SECTION 2. The City Council hereby finds and declares that the
property described in Section 1 hereof is at the present time par—
ticularly suited for the uses and purposes of Class "E" , commercial
district , provided such use is restricted to that of barber shop
and that such change authorized hereby is reasonable and in reason—
able conformity with the existing uses and value of the immediately
surrounding property.
SECTION 3, This ordinance shall take effect from and after
ten days after its passage and approval .
