WHEREAS, The City Council of the City of Cape Girardeau has
received an application from the owners of the following described property:
A part of the Rodney 400 Arpen tract, part of Outlots
87, 81 and 82 in U. S. Survey No. 2199, Township 30 North,
Range 13 East, City and County of Cape Girardeau, Missouri,
described as follows: Begin at the intersection of the West
line of Lot No. 1 of the Rodney 400 Arpen tract and the center
of Bloomfield Road; thence Northerly along the West line of
said Lot 1 and said line extended 3675 feet more or less to a cor-
ner in Outlot 87; thence N. 82 degrees 15 � W. 261.4 feet; thence
N. 7 degrees 151 E. , 740. p feet, more or less to a point in the
center of the Gordonville Road, Route SK; thence easterly along
Route SK, 1960 feet more or less; thence S. 14 degrees 31� W. ,
663. 3 feet to a point in the line between Outlots 81 and 87; thence
582 degrees 15' East along said line 396. 0 feet; thence IV. 32
degrees 01 E, , 66. 0 £eet thence N. 50 degrees 0� E. , 208. 0 feet
to a point in the West right-of-way line of U. S. Highwa.y No.
61; thence S. 79 degrees 231 E. , 120. 0 feet more or less to the
centerline of said Route No. 61; thence 5. 10 degrees 37' W. ,
along said centerline 2835 feet, more or less to an intersection
with the centerline of Bloomfield Road; thence southwesterly along
the centerline of Bloomfield Road, 1330 feet more or less to
the point of beginning.
requesting that the zoning of certa.in portions of said property be changed from a
Class "A" 4ne-Family District to Class "E" and "F" Commercial District arid
Class "H" and "I" Light Industry District and Class "J" Heavy Industry District
as follows:
NO. 1- Tract A to be zoned as a commercial zone.

City and County of Cape Girardeau, Missouri, described as follows:
Begin at the intersection of a line that is parallel to and 375 feet eas�
of the west line of Lot 1 said 400 Arpen Tract with the North line of
Bloom£ield Road; thence along said liz�e parallel to and 375 feet east
of said west line of Lot 1, Nortn 27 degrees 301 W. , 940 feet; thence
continue on a line that is parallel to and 375 feet east of said Lot 1
and said line extende:d, N. 3 degrees 30' W. , 2920 feet, more or less,
to a point that is 300 feet south of the south line of Gordonville Road; thence
West along a line parallel to and 300 feet south of the south line of the
Gordonville Road, 200 feet to a line that is parallel to and 175 feet east
of the West line of Lot 1 and said line extended; thence N. 3 degrees
301 W. , on said 1ine, 30Q feet to a point in the South li.ne of the Gordon-
ville Road; thence east along the south side of Gordonville Road, 525
feet, more or less; thence S. 3 degrees 30' �ast, on a line parallel to
and 700 feet east of the west line of said Lot 1 and said line extended,
3050 ieet; thence S. 27 degrees 301 E. , on a line parallel to and 700
feet east of the west line of said Lot l, 830 feet, more or less to a
point in the north line of Bloomfield Road; thence southwesterly along
said north line of Bloomfield Street to the point of beginning.
NO. 3 - Tract C to be zoned as heavy industry zone.
A part of the Rodney 400 Arpen Tract and part of Outlots 87, and 81,
in U. S, 5urvey No.2199, Township 30 North, Range 13 East, City
and County of Cape Girardeau, Missouri, described as follows:
Begin at the intersection of a line that is parallel to and 700 feet
east of the west line of Lot 1 of the 400 Arpen Tract with the North
line of Bloomfield Road; Thence North 27 degrees 30t West along
said parallel line, 830 feet; thence N. 3 degrees 30t West, parallel
to and 700 feet east of the west line of said Lot 1 and said line extended
3050 feet more or less to a point in the south line of the Gordonville
Road; thence east along the south line of the Gordonvil.le Road, 1120
feet, rnore or less to the northwest corner of the Mahy Lot; thence S.
14 degrees 30� W. , 663. 3 feet to a point in the south line of Outlot 81;
thence east along said south lin.e of Outlot 81, 540 feet, more or less
to a point in the west right of way line of U. S. Highway No. 61; thence
southwesterly along said west right of way line to an intersection with
the north line of Bloomfield Road; thence south westerly along said
north line of Bloomfield Road to the point of beginning.

WHEREAS, public notice of such application fpr such change was
given as wa.s provided by Commission Forxn Ordinance 1'�do. 566 and a public
hearing was held by the City Council on September 8, 1959: and,
WHERE,AS, said application has been submitted to the City Planning
and Zoning Commission for its recommendatian and report, and said City Planning
and Zoning Commission reported and recommended that said property be rezoned
in accordance with said application; and
WHEREAS, no property owners owning property adjacent or near to
the property included within such. proposed change have protested such change;
and
WHEREAS, the City Gouncil finds that it would be to the best in-
terest of all property owners concerned fox said property to be rezoned as
requested; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY GOUNCIL OF T'HE CITY OF CAPE
GIRAR.DEAU, MISSOURI, AS FOLLOWS:
S�CTION 1: That Section 2 of Commission Form Ordinance 566,
passed and approved on the 25th day of April, 1949, sha11 be and the same is
hereby amended to change the boundary of a portion of the present Class "E"
and "F" Gommercial District so as to include therein designa�ed property
hereinafter described, and to change tlie boundary of the present Class "H" and
"I" Light Industry District so as to include therein certain designated property
hereinafter described and to ch.ange the boundary of the present Class "J" Heavy
Industry District so as to include therein the designated property hereinafter
described, all of which said property is hereby rezoned from a Class "A" One-
Family District to, as follows:
NO. 1. - Tract A zoned as Class "E" and "F" Commercial District
A part of the Rodney 400 Arpen tract, and part of Outlots 87,
81. and 82, in U. S. Survey No. 2199, Township 30 North,
Range 13 East, City and County of Cape Girardeau, Mis s ouri,
described as follows: Begin at the intersection of a line that
is parallel to and 175 feet east of the west line of Lot 1 of said
400 Arpen Tract with the north line of Bloomfield Road; thence
along said parallel line, N. 27 degrees 30t W. , 970 feet; thence N.
3 degrees 30� W. , on said line 175 feet east of the West line of
said Lot 1, and said line extended 3070 feet more or less to a point
that is 300 feet south of the south line of the Gordonville Road;
thence east on a line, parallel to and 300 feet south of said Road,
a distance of 200 feet, tnence S. 3 degrees 30� East, on a line
parallel to and 375 feet east of the west line of said Lot 1 and said
line extended 2920 feet; thence S, 27 degreea 30j East, on the line
para11e1 to and. 3?5 feet east of the West line of Lot 1 of said 400
Arpen Tract,940 feet, more or less, to a point in the north line of
Bloomfield Road; thence southwesterly along said north line of
Bloornfield Road to the point of beginning.

W. , 940 feet; thence continue on a line that is parallel to and
375 feet east of said Lot 1 and said line extended, N. 3 degrees 30�
W. , 2920 feet, more or less, to a point that is 300 feet south of the
south line of Gordonville Road; thence West along a line parallel to
and 300 feet south to the south line of the Gordonville Road, 200
feet to a line that is parallel to and 175 feet east of the west line of
Lot 1 and said li.ne extended; thence N, 3 degrees 30� W. , on said
line, 300 feet to a point in th_e south line of the Gordonville Road;
thence east along the south side of Gordonville Road, 525 feet, more
or less; thence S. 3 degrees 30� E. , on a line parallel to and 700
feet east of the west line of said Lot 1 and said line extended, 3050

and County of Cape Girardeau, Missouri, described as follows:
Begin at the intersection of a line that is parallel to and 700 feet
east of the west line of Lot 1 of the 400 Arpen Txact with the North
line of Bloom.field Road; thence North 27 degrees 30t West along
said parallel line, 830 feet; thence N. 3 degrees 30� West, parallel
to and 700 feet east of the west line of said Lot 1 and said line ex-
tended 3050 feet more or less to a point in the south line of th.e
Gordonville Road; thence east along the south line of the Gordon-
vil.le Road, 1120 feet, more or less to the northwest corner of the
Mahy Lot; thence S. 14 degrees 30� W. , 663. 3 feet to a point inthe
Bouth line of Outlot 81; thence east along said south line of Outlot
81,540 feet, more or less to a point in the west right of wa.y line
of U. S. Highway No. 61; thence s outhwe s te rly along said we s t
right of wa.y li.ne to an intersectian with the north line of B1oom-
field Road; thence Southwesterly along said north line of Blooxnfield
Road to the point of beginning,
SECTION 2: The City Council hereby declares that the three tracts
of real estate described in Section 1 above are at the present particuiarly auited
for the use.s and purposes of Class "E" and "F" Comnzercia�. District, Class "H"
and "I" Light lndustry District and Class "J", Heavy Industry I3istrict respectively
and that the changes hereby authorized are reasona.ble and in reasonable confirmity
with the exi.sting use and value of the immediately surrounding property.

SECTION 3: A11 ordinances and parts of ordinances in conflict
with the provisions hereof are hereby repealed, but all. other provisions of
Commission Form Ordinance No. 566 not amended or repealed hereby shall
remain in full force and effect.
SECTION 4: This ordinance shall take effect and be in force from
and after ten (10) days after its passage and approval.
