HomeMy WebLinkAboutCommForm.2399.12-09-1963 �� . . . . � , COMMISSION FORM ORDINANCE N0. �� � AN ORDINANCE AMENDING CHAPTER 25 OF THE GENERAL ORDINANCES OF CAPE GIRARDEAU RELATING TO ZONING BY EXTENDING THE PROVISIONS OF SAID CHAPTER 25 TO ALL TERRITORY WITHIN THE CITY OF CAPE GIRARDEAU ; REPEALING COMMISSION FORM ORDINANCE N0 . 2386 , PASSED AUGUST 26 , 1963 , RELATING TO ZONING; PROVIDING FOR OFF-STREET PARKING AND OTHER ZONING MATTERS ; CON- TAINING AN EMERGENCY CLAUSE. WHEREAS , Commission Form Ordinance No . 566 , passed on April 25 , 1929 , established an official zoning map for the City of Cape Girardeau azd territory has been added to said City since April 25 , 1929 , and WHEREAS, various ordinances have been passed to zone certain areas in said additional territory since said zoning map was drawn and it is not desiredto repeal any of said ordinances , except as specifically stated herein, and WHEREAS , the provisions of this orctinance have been considered by the planning and zoning commission of the City of Cape Girardeau and the passage thereof recommended by said commission, and WHEREAS , public notice of the proposed amendments , as they are set forth in this ordinance , was given as prescribed by law and by Chapter 25 of the General Ordinances of Cape Girardeau and public hearing was/ held , in con ormity with such notice , by the City Council on the � day of �(/EH ER � � . Now therefore , BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU , MISSOURI , AS FOLLOWS: Section l . The provisions of Chapter 25 of the General Ordinances of Cape Girardeau are hereby extended to include all of the territory presently within the city limits of said City. Section 2. All of the territoryadded to said City since April 25 , 1929 is hereby included in the "A . One-family District" , except that portion of such territory which has heretofore been zoned in a different district , which portion shall remain in the district in which it was heretofore zoned , and except the land described in Section 3 hereof . Section 3. The limits of the "D. Apartment District" are hereby amended so as to include the following-described land , to-wit: A parcel of land containing 13 . 966 acres , more or less a part of U. S. P. Survey No . 2198 and a part of Fractional Section 25 , all in Township 31 North , Range 13 , East , in the City of Cape Girardeau , State of Missouri , which is described as follows : Start at a stone at the intersection of the North and South centerline of said Fractional Section 25 ; thence South 88 degrees 39 ' East , along the south line of U . S. P. Survey No . 2198, 1160 . 8 feet to a stone in the West line of the Roland Weusinger tract for the point of beginning ; thence North 0 degrees 56 ' West , 188. 1 feet ; thence North 41 degrees 49 ' East , 321 . 3 feet; thence South 48 degrees 41 � East , 87. 0 feet to the point of a curve to the left ; thence along the arc of said curve , having a radius of 535 . 2 feet , a distance of 109 . 8 feet to the point of tangent ; thence South 60 degrees 27 ` East , 625 . 2 feet ; thence South 45 degrees 03 ' East , 30 . 7 feet to the Northeast corner of Block 4 of the Weissinger Subdivision; thence South 42 degrees 51 ' West , 576. 2 feet to the Northwest corner of said Block 4; thence South 24 degrees 11 • East , 130. 0 feet to a point in the North line of Sherwood Drive of the Southwest corner of said Block 4 ; thence along tne North line of Sherwood Drive along the arc of a curve to the right, having a radius of 46. 7 feet , a distance of 18. 7 feet to the point of tangent ; thence south 88 degrees 47t West 571 . 3 feet to an inter- section of the North line of Sherwood Drive and Roland Weissinger ` s West property line ; thence North 0 degrees 56 ° West , 588. 0 feet to the point of beginning . Section 4. Commission Form Ordinance No . 2386, passed and approved August 26 , 1963 , relating to zoning , is hereby repealed. Section 5 . In all zoning districts , off-street parking facilities for the temporary storage or parking of self-propelled passenger vehicles for the use of o�apants , employees and patrons of buildings erected after the effective date of this ordinance , and of such extension, altera- tions , additions or changes in use of such buildings , as specified in Section 6 , shall be provided in amounts of not less than hereafter specified and shall not subsequently be reduced below the requirements of this ordinance . Provided , that nothing in this ordinance shall pre- vent the reconstruction, repairing or rebuilding and continued use of any conforming building or structure existing at the effective date of this ordinance , which is damaged by fire , collapse , explosion or acts of God , subsequent to such effective date . Section 6. A "parking space" shall mean a permanently surfaced area , enclosed or unenclosed , sufficient of size to store one motor vehicle together with a permanently surfaced driveway connecting the parking space with the streetor alley or place and permitting ingress and egress of a motor vehicle . Section 7. Existing off-street parking facilities provided at the effective date of this ordinance and actually being used at that time for the parking of automobiles in connection with the operation of an existing building or use , shall not be reduced in an amount less than thereafter required under this ordinance for a similar new building or new use . Section 8. Off-street parking facilities shall be provided as follows : A . For dwellinqs , including single , tv�-family and triple residences and apartment houses and all other similar structures devoted to habitation : At least one off- street parking space for each dwelling unit . B. For hotels , including clubs , lod�ng houses , tourist homes and cabins , motels , trailer courts , camps and parks, boarding and rooming houses , dormitories , - 2 - sororities , fraternities and all other similar places offering overnight accommodations shall provide at least one off-street parking space for each three guest rooms. If , in addition to those spaces pro- vided for guests , patrons or residents of the above named place , assembly halls , restaurants , night clubs, retail shops or room for other shops, service establish- ments or businesses is provided , additional off-street parking spaces will be required in accordance with the regulations set forth herein for such uses. C . For hospitals , including sanitariums, asylums , orphanages , convalescent ho,nes , homes for the aged and infirm, and al =! other similar institutions : At least one off-street parking space for each three patient beds , plus at least one additional off- street parking space for each staff and visiting doctor , plus at least one additional off-street parking space per each three employees , including nurses. D. For retail establishments , one parking space for each 400 square feet of gross fioor area or fraction thereof over and above 1 ,000 square feet. Such parking space shall be provided within 1 , 000 feet of the premises they are intended to serve . E. For office buildinqs , one parking space for each 1 , 000 square feet of floor area . F . For structures or parts thereof principallv used as a theatre , auditorium or other similar place of public assembly, one parking space for each ten seats of the total audience seating capacity of the building or one parking space for each 100 square feet of gross floor space used or intended to be used for services to the public , whichever requires the greater number of park- ing spaces. Such parking space shall be located within 700 feet of the buil.ding they are intended to serve . G. For industrial plants , including wholesale , manufactur- ing warehouses , storage building and yards , public utilities building , contracting equipment and lumber yards , business service establishments , soft-drink bottling works , fabricating plants and all other structures devoted to similar mercantile or industrial pursuits : One off-street parking space for each three employees. Section 9 . The off-street parking facilities required for one- family, two-family and multiple dwellings not over two stories in height shall be on the same lot or parcel of land as the building they are intended to serve . For rooming houses , lodging houses , fraternities , dormitories , hospitals , convalescent homes , homes for the aged , and for other similar uses , the off-street parking facilities shall be within 100 feet of the building they are intended to serve , measuring from the nearest point of such off-street parking facility and the nearest point of the building . Section 10 . All territory which may hereafter be annexed to the City of Cape Girardeau shall be considered as being in the "A . One- family District" until otherwise changed by ordinance . - 3 - � d � . D Section 11 . Sections 5 , 6, 7 , 8 , 9 and 10 of this ordinance shall be known, respectively, as Sections 25 . 26, 25 . 27, 25 . 28, 25 . 29 , 25 . 30 and 25 . 31 of the General Ordinances of Cape Girardeau . Section 12_ . This ordinance is necessary for the immediate preser- vation of the public peace , health and safety and shall be effective upon its passage and approval .
