BE ST ORDAINED BY THE COUNCIL OF THE CITY QF CI�PE GIRA�.DEAU, MISSOURI, AS
FOLLOWS:
S�CTIOI+1 1. That the plans and specification� for the construction of a
system of Sa,nitary Sewers for the removal of sanitary sewage from Sew�er District
Puumber 12-X, a subdivision of Sewer District ido. 12, as �an�e is described in
Co�.$sicn For� Ord3nance No. 191�,2, paased and approved on the 25th day c� August,
1958, by the terns of which ordi�ance the territory embraced within the Citg of
Cape Girardeau, Misgouri, was subdivided into thirteen �ewer districts, n�bered
1 thra 13, respectively, �aid plans having bean prepared by John R. Walthmr, and
heretofore submitted to the City Council, be and the same are hereby approved and
adopted as the plans for the construction af aaid sanitary sewers in Sew�er District
No. 12-X.
SECTION 2. That the Council hereby deems and declares tiza,t a public necessit�
exista for the consi:ruction and maintenance of a systen of sanitary s�wera in Sewer
District No. 12-X, a subdivision of Sewer District No. 12, as defined in said Con�rnis�ion
Form Qrdinance No. 191+2, ss �hown on said plans and hereinafter described, will, e.xclusive
of ar�y public streets, be benefitted by th� con$truetion of �uch sewers a: provided for
in gaid 5ew�er District No. 12-X, the boundasies of which �hall be as foLlows:
All of that part of L�. S. P. Surv�:y iUo. 2198 and �art of Frl. Section 25, in
T. 31 N., R. 13 E., includir.�.g a part of Suburban Heights, in the City and County of
Cape Girardeau, i+�issouri, described as followg:
Begin at the southwest corner of Lot 4, Block 15, Suburban Heights; thence east
along the 5. line af Lot i�, to the S.E. corner of Lot 4; thence in a N.E. direction
to the S.WT. Eorner of I,ot 7, Blcck 1k, �.iburban Heights; thence E. alon�; the S, line

�EC:'ION 3. �'hat the Riverside Tr-4i-'�-�-�--`�- "-�--� � •-���.-r::�., is herebp authorized
to secure a competent contractor for the purpoae of constructing said system of
sanitary sewera and in doing so shall indemni#� the City of Cape Girardeau, Missouri,
from ar�y and all clsim� which may arise from the acts of said contractor or hia agents,
or from ar�y costs whatever which may pertain to the construction of said �ero�er system.
That said work shall be done in accordance with the current specifications for the
construction of said sew�ers, under the supervision of the City Engineer and the Departm�nt
of Public v�orks, and all ordinar.ces of the City pertain��g thereto, and that upon the
completion of the work it shall be approved by the Water Pollution Board of the State
of Missouri.
That the partie� involved in doing the work of constructing said sys�em of
sew�rs sha11 furnish the City of Cape G3.rardeau, N',issouri, satisfactcr� evidence
that insurance of all typss required by said City will be in effeat throughout
the entire period of such construction.
That further satisfactory eviden,ce be furriished upon the compYetion of the
work and its acceptance by the City of Ca.pe Girardeau, A�issouri,� that the Contractor
doing the work has been paid in full for the coet thereof, that the City shall not
be held responsible for the cost of any part thereof, and that all costs for material,
e�uipment and labor have been paid in full,
SECTION k. That this ordinance sha11 taks effect and be in fu]1 foree from
and after ten days following its passage and approval.
