WHF,'REAS� the City Council of the City of Cape Girardeau, Ca,pe Girardeau
County, Missouri, by Ordinance No. 2180, dultiy and regularly adopted at a meeting
of sa,�.d Council duly and regularl.y held on the 7th day of June, 1961, did direct
that a special election be held in said City on Tuesday, the llth day of July,
1961, for the purpose of submitting to the quali�ied electors of said City the
following proposition, to-wit:
PROPOSITION
"Proposition to issue the bonds of the City of Cape
Girardeau, M3.ssouri� to the amount of One Million�
Five Hundred Ninety-eight �liousand Dollars
($1,598�000) to provide funds for the purpose of
improving :k.he sewerage system of said City by and
through the add3tion thereto of a sewage treatment
plant."
and
WHERF�S, the said Ordinance did direct that the aforesaid election be
held at the pollin� places in said City therein set out; and
WHEREAS� due and regular notice of sa3d election was given as directed
by said �rdinance and as required by law� by publication in The Southeast Missourian,
a daily newspaper published and of general circulation in the C3ty of Cape Girardeau;
said newspaper having previously been admitted to the Post Office in said City of
Ca,pe G3rardeau as second class matter and ha.ving been published regulaxly and con-
secutively for a period. of more than three (3) years prior to the publication of
said notice, and s aid newspaper having a list of bona fide subscribers, voluntarily
engaged as such, who have pa.id or agreed to pay a stated price for subscriptions
thereto for a definite period. of time; and

W�iEREAS, said notice was published in said newspaper on the lgth and 26th
days of June, 1961, and on the 3rd and lOth days of July, 1961; and
T�H�EREAS� said notice was published in said newspaper once a week for at
least three (3) consecutive weeks prior ta the date of said election, the first of
said publications having occurred at lea,st twenty-one (21) days before and the
last one within two (2) weeks of the date of said election; and
WHERF�S, the afoxesaid Ordinance adopted. on the 7th day of June, 1961,
did make provision for the use at saa.d election of baLtots in the form provided by
said Oxdinance; and
WHEREAS, the said ba].lots used at said special election were in the form
as set forth in the aforesaid prdinance; and
�IEREAS, thereafter the City Council did appoint judges and clerks of
sa3.d election; and
WHEREAS, the said �lection was duly and regularly held in all respects
as required by the Statutes of the State of Missouri; and
WfiEFiF'•AS, the �udges of said election, immediately upon the closin� of
the polls on said 1].th day of July, 1961, did make out, certif'y, and transmit
to the City Council the returns of said election; and
WHEREAS, this City Council, on the 13th day of July, 1961, did canvass
said returns and did then find, and does now again find, determine, and declare
that at said election two thousa.nd, six hundred. th3rty-eight (2,638) votes were
cast on the aforesaid proposition� of which one thousand, eight hundred forty-
five (1,81+5) votes were cast in favor of the proposition and seven hundred ninety-
three (793) votes were cast age,inst the proposition; and
WHEREAS, this Council does now further find and determine that at the
said election more than two-thirds (2�3) of the qualified electors votin� on the
said propos3.tion assented thereto; and
WHEREAS, the City Council of said City is now f'ully and legally authorized
and empowered to issue the bonds oP the said City of Cape Girardeau in the principal
a,mpunt of One Million, Five Hundred Ninety-eight Thousand Dollars ($1,598,000) for
the purpose hereinafter set forth; and

4�iEREAS, the assessed valuation of taxable, tangible property within said
City, as shown by the last completed assessment for state and cownty purposes made
prior to the date of the aforesaid election, to-wit: the assessment made as of

WHEREAS, the amount of bonds authorized to be issued at the af'oresa3d
special election held on the llth day of July, 1961, to-wit: One Million, Five
Hundred Ninety-eight Thousand Dollars ($1.,598,000), together with the aforesai.d
outstanding indebtedness, did not and does not now exceed at�y limit of indebtedness
prescribed under the Constitution and Statutes of the State of Missouri; and
WHE�tFAS, the City Council of said City of Cape Girardeau has heretofore
determined to proceed at this time with the sale and 3ssuance o� One Million
Dollars ($1,000,000) in principal amount, of the aforesaid authorized issue of
One M3.11ion� Five Hundred Ninety-eight Thousand Dollars ($1,598,000), of Sewera�e
System Bonds, reserving and retaining unto itself' the power and authority, in the
discretion of the Council, to issue the remaining Five Hundred Ninety-eight Thousand
Dollaxs (�598,000) Sewera�e System Bonds at a later date as hereinafter prov3.ded;

WfiEREAS, heretofore, to-wit: on the 24th day of April, 1.g63, pursuant
to notice g3ven as directed by this Council, the afbresaid One Millian Dollars
($1.,000,000) in Sewerage System Bonds of the aforesaid authorized issue were
awarded and sold to the highest and best oidders therefor; and
4IIiEREAS, the purchasers of said bonds have requested. that said bonds be
printed in the denomination of One Thousand Dollars (�.1.,000) each, and that said
bonds be ma.d.e payable as to �7c3ncipal and interest at the Merchants�Produce Bank,
in the City o� Kansas City, State of Missour3.; and
WHEREAS� this Council does now find and determine that the aforesaid re-
quests should be approved; and
WHERF�AS, this Council does now �'ind that it is necessary and desirable
to proceed forthwith to provide for the issuance of said bonds: NOW� THERF�'ORE�
BE IT ORI)AAINED BY TfiE CITY COUI�CIL OF THE CITY OF CAPE GIRARDEAU� CAPE
GIRARDEAU COUNTY� MtSSOUR:C,� AS FOLLOWS:
SECTIOPT 1. That there are hereby authorized and ordered to be prepared
and issued bonds of the City of Cape Girardeau, M3.ssouri, in the amount of One
Mi.11ion Dollars (�1,000,000) (of an issue of One Mi7lion� Five Hundred N�:nety-eight
Thousand Dollars [$1,598,0�] authorized) to provide f�.nds for the purpose of improv-
ing the sewera�e system of aa3d City by and through the add�tion thereto of a sewage
treatment plant. Sa3d bonds shall be of the denomination of One 'I'housand Aollars
($1,000) each; shall be numbered from One (1) to One Thousand (1,000), inclusive;
shall bear date of May l, 1963; and shall bear interest from date thereof at the �
rates per annum hereinafter set forth, payable August 1, �963, and semi.-annually
thereaf'ter on February 1 and August 1 in each year until the principal of sa.i.d bonds,
respectively, shall have been Fully paid. Interest accruing on and prior to the
respective maturity dates of said bonds shall be evidenced by appropriate interest
coupons to be attached to each of said bonds. Both principal of and interest on
'I said bonds shall be payable in lawful money of the United States of America at the
iMerchants-Produce Bank, in the City of Kansas City, State of Missouri. The said

Provision to meet the requirements of this Ordinance shall in due time, manner, an
; season a.nnually be made•
j SECTION 5• '�at S�d t� shal]. be extended upon the tax rolls and shall
j'' be collected in the same manner and at the same time as other city taxes are ex-
tended and collected, and the rate of tax which shall be so extended shall be suf-
f'icient in each year fully to produce the sums set out above, respectively, a,�ter
due allowance sha11 have been made for probable delinquencies in the payment of

taxes �.nd the customary costs of collection, and the proceeds derived from the col-
; lection of such tax shall be credited to a special fund hereby created. in the
� treasury of said City and designated "SEW�'�RAGE SYSTEM BONDS� INTEI�T A� �I�NG
F�TD�" and shall be used exclusively for the purposes herein required.
i SECTION 6. That the City Treasurer of said City be a.nd he is hereby
authorized and instructed to remi.t for deposit in the place of payment herein�,bove
naro.ed., not less than five days prior to the accruin� of the interest and to the

The said Treasurer is further directed to include with each such remittance the
usual and customary fee of the paying agent for its services and responsibility

SECTION 7. That, in ord.er to make provision for the payment of interest
in the amount of $7,379•20, which will accrue on said bonds on August l, 1963,
which date is prior to the date when the first taxes to be levied hereafter can be
collected and become available, there is hereby appropriated out of the
��� g���� Fund of said City to the payment of said interest the
a�oresaid sum of $7,379•20� a�d said sum shall be restored to the Fund from which
it is appropriated out of the first taxes collected hexeunder.
SECTION 8. That the Mayor and the City Clerk are hereby authorized. and
d3rected. to cause the bonds herein described to be prepared and executed as herein
directed., to cause the same to be registered in the office of the State Auditor of
� Missouri, and thereupon to deliver the said bonds to the purchasers thereof.
i SECTION 9• That the proceeds received upon sale and delivery of the
� bonds herein authorized. to be issued� i�n.ediately upon receipt thereof, shall be

SECTION 10. That the right shall be and is hereby expressly reserved
� unto the City of Cape Girardeau, in the discretion of the City Council thereof,
� hereafter to issue and se11 all or any Part of the remaining Five Hundred Ninety-
