AN ORDINANCE AMENDING CHAPTER 25 OF THE GENERAL
ORDINANCES OF CAPE GIRARDEAU BY CHANGING THE
ZONING OF PART OF LOTS 85 AND 86 IN RANGE "H"
FROM CLASS "A" TO CLASS "C " , APARTMENT DISTRICT ;
BY CHANGING THE ZONING OF INDEPENDENCE STREET
FROM KELLER AVENUE TO SUNSET BOULEVARD TO A DEPTH
OF 150 FEET FROM CLASS "A" TO CLASS "E" , COMMERCIAL
DISTRICT; BY CHANGING THE ZONING OF THE SOUTH SIDE
OF INDE PENDENCE STREET FROM PAC IF IC TO NORTH WEST
END BOULEVARD TO A DEPTH OF 150 FEET FROM CLASS
"B" TO CLASS "F " , COMMERCIAL DISTRICT ; AND BY
CHANGING THE ZONING OF THE NORTH SIDE OF MERRI-
WETHER STREET FROM PLAZA DRIVE TO SHERIDAN DAIVE
TO CLASS "F '" , COMMERCIAL DISTRICT.
WHEREAS , The City Planning and Zoning Commission has recommended
that all the prope;rty described in Section 1 of this ordinance should
be rezoned to Class "C" , that all the property described in Section 2
of this ordinance should be rezoned to Class "E" , and that all the
property described in Section 3 of this ordinance should be rezoned
to Class "F " , and
WHEREAS , public notice of such proposed changes in zoning was
given as prescribed by Chapter 25 of the Gen�al Ordinances of Cape
Girardeau and public hearing was held , in conformity with such
notice , by the City Council on the 6th day of May, 1963. Now therefore ,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU ,
MISSOURI , AS FOLLOWS :
Section 1 . Chapter 25 of the General Ordinances of Cape Girardeau
is hereby amended to change the boundary of the present Class "C" ,
Apartment District , so as to include the hereinafter described property:
The East part of Lots 85 and 86 , Range "H" , described as follows :
All of sixty-six ( 66) feet fronting on the Bloomfield Gravel
Road by depth South extending to Morgan Oak Street and more
particularly described as follows : Commencing at the North-
east corner of Lot Eighty-six ( 86) in Range "H" in City of
Cape Girardeau ; thence east on Bloomfield Gravel Road six-
teen ( 16) feet ; thence south to Morgan Oak Street ; t�nce
west along said Morgan Oak Street sixty-six ( 66) feet ;
thence north to Bloomfield Gravel Road; thence east fifty
(50) feet to the place of beginning , being the East 50
feet of Lots 85 and 86 in Range "H'" and a strip of ground
16 feet wide lying immediately East of Lot 85 and 86 in
Range "H" , Cape Girardeau , Missouri .
Section 2. Cha�ter 25 of the General Ordinances of Cape Girardeau
is hereby amended to change the boundary of the present Class "E" ,
Commercial District , so as to include the hereinafter described property:
All of the North side of Independence Street from Keller
Avenue to Sunset Boulevard by a depth of 150 feet .
Section 3 . Chapter 25 of the General Ordinances of Cape Girardeau
is hereby amended to change the boundary of the present Class "F " ,
Commercial District , so as to include the hereinafter described property:
( a ) Al1 of the land on the south side of Independence
Street from Pacific Street west to North West End
Boulevard .
( b) Commence at the northwest corner of Outlot 57 ; thence
83° 45 ' east along the north line of Outlot 57 501 . 2
feet to a point of beginning on the east line of Spring
Avenue , extended ; thence south 82° 30 ' east , 516. 8
feet for a corner on the west line of Sheridan Drive ;
thence in a southerly direction along the west line
of Sheridan Drive with the north line of Merriwether
Street ; thence North 82° 30 ' West along the north
line of Merriwether Street to the east line of Spring
Avenue , extended; thence north 0° 26 ' West along the
east line of Spring Avenue extended 123 feet more or
less to tne point of beginning .
Section 4 . The City Council hereby finds and declares that the
property described in Section 1 hereof is at the present time particu-
larly suited for the uses and purposes of Class "C" , Class "E" and
Class "F " , as indicated , and that suc1� changes authorized hereby are
reasonable and in reasonable conformity with the existing uses and
values of the immediately surrounding property.
Section 5 . This ordinance sha11 be in full force and effect ten
days after its passage and approval .
