The excessive emission of dense smoke within the corporate 2imits af the City of Cape Girardeau and the resultant effect upon the public health and welfare require the adoption of a comprehensive and integrated plan of srnoke control; and WHEREAS, In conjunction with the smoke control program� iY is desirable to adopt appropriate regulations to r�duce air pollution caused by excessive aoot� cxnders, fly aah� dus�t, noxious acids, fumes and gases. the ernission of which is detrimental to the health and welfare of the residents of the city; NOW, THEREFQZ E. BE IT ORDAINE� �Y T� CITY OF CAPE GIRARDEAU: SECTION 1. Definition of Te�rns. (a) "Dense Smo�Ce" as used in this ordinance shall mean that srr�oke which has a density of 170. 2 ox greater as esta.blished by the Ringlemann chart� h�xeina£ter refe�red to and adopted; (bj "Cinders; "d�st". "fly ash", "noxious acids". (i) "Existing": Things. sucr, as zquipment. machines� devices� articles. contrivances or inatallations which are in beind at the time these regulations become eifective except that any sucn existing equipment� machine device. article. contrivance or installation which ig altered. repaired or re- built at a cost of 30 percen� or more of its replacement cost shall be re- clasaified as "new", as defined in this regulation. (j) "Open Burning": The bu.r.fn� of a:�y :�a�ter in such manner that the products of� combustion a e sui�ing fro:: ti:>� e�::ir.b are emitted direction into the open at<nos�,here without passing throu;n a stack, duct. or chimney. (lc) "Particu2ate matter": Any material. exce�t uncombined water� which exiata in a finely divided form as a liquid or solici at stan�ard condition s. (1) "�'-.o�e�s weight": the total weight of all materials introdkced into a source operation. including �olid fuels, but excluding liqui�is and gases - page three � used solely as fuols, and e�:cluding air introduced for purposea of combuation. (m) "Refuae": Ar.y combustibl� waste material containin� carbon in a free or combined state. other than liquids or gases. (n) "Smoke": Small gas-borne particles resulting from combustion. consisting of carbon. ash. and other material. (o} "Source Operation": Th� last operation preceding the emission of an air contaminant. wlzich opera��o:z {a} results in the �eparation of the air contaminant from the pr�a�ss rnaferiais or lYl t�1� conversion of the procees materials into air contaminants. as in the case of combustion fuei; and (b) is not solely an air pollu�ion abatement operation. SECTION 2. �estrz�ticr_ af �.:.;.�s�ion af P4rticulate Matter From Industrial Processes. ! A. General Provisions: 1. Tr.is regulation applies to any op�ration, process. or activity except the buring of £uel for indirect heating in which the products of com- bustion do not come into direct contact with process materials and except the buaing of refuse and except the processing of salvageable material by burning. 2. Process w+eight means the total wei�ht of all znaterials introduced into a source operation. includin� sclid fuels. bu� excluding liquids and gases u�ed solely as fuels. and excluding air intro3uced for purposea of combusti�n. Procees wei;�:t �-�c� _��eans a ra�e established as follows: . . y � . , - page four - a. For continuous or long-run steady-state source operations. � the total process weight for the entire period of continuoua operation or for a typical portion thereof. divided by the number of hours bf such period or portion thereof. b. For cyclical or batch source operations, the total process weight for a period whfch covers a complete operation or an integral � number of cycles� divided by the hours of actual process operation during euch period. Where the na.ture o� any procegs or ogrer;�tion or the design of any equipr�ent is such as to perma� more than one interpretation of this section. that inter�reta�ion which �esults in fihe minimum value for allowable er.zissio:� shall zpply. 3. Emission tests relating to tnis re;ulation shall be made following the standarde in American Society of IVTechanical �ngineers Power Test Codes - PTC-27 dated 1957 and entitled Determining Duet Concentration in a Gas Stream. � B. Emission Limitationa: 1. Except as prov3ded for in Section B (2), no person ehall cauae. suffer. allaw. or permit the emission of particulate matter in any one hour from any source in excesa of,the amount ehown in Table 1 for the process weight allocated to such source. 2. The limitations established b�r Section B (1) ehall not require the reduction of particulate matter concen�ration, based on the source gae volume. below the concentration specified in Table 2 for such volume; provided that� for the purposes of this section the person responsible for the emisaion may elect to sub�titute a volume determined according to the provisions of Section B (3); and provided further that the burden of showin�; the source gas volume - page five - or other volume substituted therefor, including all the factors which determine such volume and the methoda of determinging and computing such volume� aha.11 be on the person seeking to come within the provisions of this Section. 3. Any volume of gases passing through and leaving an air pollution abatement operation may be aubstituted for the source gas volume of the source operation served by auch air pollution abatement operation, for the purposes of Section B (2), provided such air pollution abatement operation emits no more than 5�0 per cent of the weight of particulate matter entering thereto; and provided further that such substituted volume shall be corrected to atandard conditions and to a moisture content no greater than tha.t of any gas stream entering such air pollution abatement operation. 4. No peraon shall cause, suffer, allow or permit the emisaion of particulate matter from any source in a concentration in exceas of 0. 30 grain per standard cubic foot of exhaust gases. If provisions of this sub- section would permit a greater emission of particulate matter per hour than allawed by aubsection B (1) , the provision of this subsection (B-4) ahall not 1 apply. . a. Exception. The foll.owing exceptions to the provisions of Regulations IV shall be permitted: (1) When building a new fire, and (2) During the start-up, an ope ration breakdown. or while cleaning air pollution control equipment for any process. � ` , . . . The provisions of Section A of this regulation shall not apply to the following: a. Transfer of molten metala b. Emissiona from transfer ladles c. Water quenchirig of coke on discharge from ovena , d. Existing grey iron jobbing cupolas as defined in Regulation IV. D. Methods of Measurement 1. The itinglemann Chart published and described in the U. S. Bureau of Mines Information Circular 7718 or the U. 5. Public HeaTth Service Smoke Inspection Guide as deacribed in the Federal Register, Title 42, Chapter 1� Subchapter F, Part 75, shall be used in grading the shade or opacity of visible air contaminant emissions. The Executive Secretary may specify other meana of ineasurement which give comparable result.s or resulta of greater accuracy. The two publications described in this subsection are hereby made a part of this regulation by reference. SECTION 6. Emission of Dense Smoke Prohibited. It shall be unlawful for any person, firm or corporation to permit the emission of any smoke from any source�whatever of a density equal to or greater than that density described as No. 2 on the Ringlemann Chart, published by the United States Bureau of Mines, the standards of which are hereby fully adopted by the enactment of this Ordinance and set forth in full in Section herein. The emission of such dense smoke is declared to be a public nuisance and may be summarily abated by the Superintendent� or by anyone whome he may designate for such purpose. - p�;e eleven - SECTION 7. .�.1'xcc�tian� - Priva�e Resic�enccs - Periods for Re:cindlin� o£ Firea. It shall b� unla�:.ul for any person� firm or corporation to permit or cause the escape of such qua:�tities of soot� cinders. noxious acids. fu�nes, and gases in such pla�ce or mar.ner as to be detrimental to aiiy person or to the public or to endanger the health� co�nfort and safety of any such person or of the public. or in such manner as to cause or have a tendency to cause injury or damage to propsrty or busi:��;s. 2'he escape of such matter is declared to be a public nuisance and may be sum,maril•� abated by the Super- intendent� or by anyone whom he xnag% c1�s:�rLate icr such:purpose. SECTION 9. SECTI4N 12. Use of Smokeless colid Fuel. It sha12 be un2awful for any person, firm or corporation L-o use or consume in any solid fuel-burning equipme�t any solid fuel which doea not m�et the standards of a smokeless solid fuel as set forth in this section. If it appears that such propoaed work will � not be inconsistent with the purpoaes of this ordinance� the superintendent shall issue the permit� otherwise it shall be denied. Compliance with this section of the ordinance ahall not be deemed to be compliance with any city requirementa with reapect to the construction or repair of buildings. SECTION 14. Annual Inspections. It shall be the duty of the superintendent to make an annual inspection of each fuel consuming device, industrial process and incinerator in operation within the city to which this ordinance appliea and to issue a certificate of inspection to the owner of each such devise ho inspected providing that it meets the atandarda establsihed in this ordinance. Such certificate shall be authorization for the continued op�ation of fuel consuming devices. Failure to poasesa a proper certificate of inspection shall be considered to be a violation of this ordinance. Provided� however� that all fuel consuming devices not inapected at the time of the passage of this ordinance are authorized to continue in operation until such time as the superintendent may make his annual inspection of such device s. ! SECTION 15. Hearings by Superintendent. Any peraon aggrieved by any ruling rendered by the superintendent shall have the right to require the auperintendent to conduct a full and complete hearing prior to actual and final decision. Such hearing ahall afford the person aggrieved with a full opportunity to pre sent any evidence which :he may de sire to support his position. Yt shall be the duty of the,superintendent to promptly notify all parties concerned of his ruling in such hearings. 5ECTION 16. Creation of Board of Appeals. The Mayor of the City � . of Cape Girardeau shall appoint a Board of Appeals to be compoaed of at least three members who will serve as a body to which appeals may be made . Tize members of this board shall serve for a period of one year, without rcrnunexatian. 'T'hey shall be citiz�ns and taxpayers of the city and shall not have any interest in the salo or control of any smoke prevention oquipment or appar�.tua which mi�ht be usecl effectively to reduce the emission of dense smoke. The Bo�,rc3 of Appe als may prepare such rules and :egulation� as may Ue deemed neces�ary for them in the diacharge �. of their dutieg. They shall decide ail appeala properly before thern. and shall either affirm. modify or overrule the uccision of the superi�tendent which they may be called upon to review. Or. aIi a�p�als taken to the �oard, appropriate hearings shall be held after due notice thereof to the pa:ties c�ncerned. All pertinent papers in the files of the Buareau shall be made available to the Board in each case. SECTIOIV 17. "�i�� Sciz�c:�z?� i�r �,om�liance.
