AN ORDINANCE AMENDING CITY MANAGER FORM
ORDINANCE NO. 109 RELATING TO THE GENERAL
5ALE AND USE OF INTOXICATING LIQUOR5
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE
GTRARDEAU, MI5SOURI, as follows:
SECTION 1. City Manager Form Ordinance No. 109 is hereby
amended as follows:
Section 33. 06 (C) and Section 33. 12 af said ordinance are hereby
amended by deleting any portion of such sections setting out 8:00 A. M.
and substituting therefor 6:00 A. M.
5ECTTON 2. City Manager Form Ordinance No. 109 is further amended
by adding Sections 33. 21, 33. 22, 33. 22 (1), 33. 22 (2)a 33. 22 (3) as follows:
"33. 21. No person between the age of 17 years and 21 years shall
represent that he ar she has attained the age of 21 years for the
purpose of purchasing, asking for or in any manner receiving any
intoxicating liquor or non-intoxicating beer.
33. 22. No per son between the age of 17 year s and 21 year s sha.11 pur-
chase or attempt to purchase or have in his possession intoxicating
liquor or non-intoxicating beer.
33. 22 (1). No person or corporation licens.ed under the provisions
of City Manager Form Ordinance No. 109 and the general ordinances
of Cape Girardeau, nor any employee of such person or corporation,
shall permit or suffer any child ta enter, visit or remain upon any
licensed premises where intoxicating liquor or non-intoxicating beer
is served or is sald to be consumed on the premises, unless such child
is accompanied by one of his parents or by his legal guardian. For the
purpose of this ordinance "child" is defined as a person under the age

33. 22 (2). No child ahall enter, visit or remain upon the
premisea described in 5ection 33, 22 (1) hereof unless such
child is accompanied by one of his parents or by his legal
guar dian.
33, 22 (3). The pravisions of this ordinance shall nat apply to
public picnic�, fairs or bawling alleys.
33. 22 (4). The provisians of Section 33. 22 (1) and 5ection 33. 22
(2) sha.11 not apply to those establiahments whose primary purpose
far being in business is the sale of food, and when the sale of intox-
icating liquor or non-intoxicating beer is incident ta the primary
purpose of the sale of food, a child may enter and remain upon such
premises solely for the purpoae of purchasing food. "
SECTION 3. This ordinance shall be in full force and effect ten
days after its passage and approval.
