AN ORDINANCE AMENDING CHAPTER 16 OF THE GENERAL
ORDINANCES OF CAPE GIRARDEAU, MISSOURI, RELATING
THE THE PARK AND RECREATIONAL FACILI'IIES OF THE
CITY OF CAPE GIRARDEAU AND ESTABLISHING THE CAPE
GIRARDEAU PARK AND RECREATION BOARD
BE IT ORDAINED BY THE CITY C�UNCTL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, as follows:
SECTTC�N 1. Chapter 16 of tY�e General Ordinances of the
City of Cape Girardeau, Missouri, and general order of the City
of Cape Girardeau, dated October 26, 1964, are hereby amended
to read as follows:
16. O1 PARK AND RECREATION BOARD, CREATTON:
T here is hereby created a board consisting of
six (6) citizens of the City of Cape Girardeau, Misaouri,
and one (1) ex-officio member to be dete�mined as set
out in Section 16. 02 (c), which shall be known and desig-
na.ted as the Cape Girardeau Park and Recreation Board.
16, �2 PARK AND RECREATION BOARD, MEMBER5:
(a) Qualifications: A person appointed to the Cape
Girardeau Park and Recreation Board shall be a taxpayer
and qualified voter of the City of Cape Girardeau.
(b) Terms: The Council shall appoint the first
members of the Park and Recreation Board for terms
as follows: Two (2) members ahall aerve for a term of
six (6) years commencing May 1, 1967; Two (2) members
ahall serve for a term of four (4) years commencing May
1, 1967; and Two (2) members shall aerve for a term of
two (2) yeaxs commencing May 1, 1967. As the term of
a member expires, the council shall appoint a successor
for a term of six (6) years, beginning the first day of May
of the expiration year; except as provided below.
(c) Ex-officio Member: The Mayor or a Councilman
designated by the Mayor sha.11 serve as an ex-officio member
of the Park and Recreation Board and shall maintain liaison
with the City Council and City Mana.ger, but shall not have a
vote in the decisiona of the Park and Recreation Board.
(d) Removal: A member of the Park and Recreation
Board may be removed at an� time, with or �+ithout cause,
by the affirmative vote of three (3) members of the City Council.

(e) Vacancy: Tf a vacancy occurs on the Park and
Recreation Board, the Council shall fill the vacancy by
appointing a new member to serve the balance of the un.-
expired term.
16. 03 PARK AND RECREATION BOARD, MEETINGS:
T he Park and Recreation Board shall ha.ve regular
meetinga every three (3) montha and special zneetings as
often as they are required. The Park and Recreation
Board shall adopt by-laws to govern the conduct of its
busine s s.
16. 04 PARK AND RECREATION BOARD, OFFICII2S:
T he Park and Recreation Board ahall meet each
year between the first day of May and the fifteenth day of
May and elect a Cha.irman, Vice-Chairman and a Secreta.ry
to serve a term of one (1) year.
16. 05 POWERS AND DUTIES:
(a) The Park and Recreation Board may investigate
or study any problem or condition related to the construction,
operation, rnaintena.nce, or improvement of, or addition to
a City Park or related recreational facility. The Park and
Recreation Board may meet, confer or negotiate with any
individual, pa.rtnership, association, carporation, or local,
sta.te or federal agent or go�rernmental organization. The
Park and Recreatfon Board may present a proposed plan
or design to the City Council ar City Manager for iznple-
mentation or approval or adoption by ordina.nce where
necessary, as provided by law,
(b} The City Council shall notify the Park and Recreation
Boa.rd of a meeting at which major construction, operation,
maintenance or improvement of, or addition to a City Park or
Recreationa.l Fa.cility ia discussed in detail. The City Council
or City Manager shall relay to the Fark and Recreation Board
as �oan as practicable, material informatian perta.ining to
a City Park or recretatiQna.l facility.
(c) The Park and Recreation Board sha.11 repoxt the
condition of park and recreation development and progress
to the City Council the first week of February, May, August
and November of each year, or more frequently, as requeeted
by the Council.
(d) The Board may submit to the Council: in the
manner provided by law, a petition for the calling of a
special election on the proposition as to whether or not
bonds ahall be issued for the expansion, conatruction,
improvement, equipment, znaintenance, or operation of
park or recrea,tional land or facilities.

16. 06 PARK AND RECREATION BUDGET - PARK AND
RECREATION FUNDS:
(a) The Park and Recreation Board may, on or before
the fifteenth da.y of May of each year, submit to the City
Council for approval, a budget for park and recreational
facilities, setting forth the expected income and expenditures
for the following fiscal year,
(b) There is hereby esta.blished a Pa.rk and Recreation
Fund to be kept separate and apart from the other monies of
the City. Money received by the City from a park and recreation
levy or park and recreationa.l facility, prorata. sha.re of other
general revenue, or income and revenue �rom park and re-
creation operations shall be paid into thc Park and Recreation
Fund of the City; and all expenditurea for park az�d recreation
operation and maintenance shall be paid from the Park and
Recreation Fund of the City.
(c) Expenses for the operation and maintena.nce of
Park and R e creational Facilitfe a sha.11 be paid out of the
Park and Recreation Fund of the City upon purcha.ae orders
or work orders iasued by apprapriate persons designa.ted
by the City Manager in accordance with the purchasing
practicea of the City of Cape Girardeau, Miesouri.
SECTYON 2. This Ordi��.nce ahall be in full force and effect
ten (10) days after its passage and approval.
