STREET LIGHTING CONTRACT

An Ordinance Authorizing and Providing a Contract �ietween Missouri
Utilities Company, its Successors and Assigns, and The City of Cape
Girardeau, for the Rendering of Street Lighting Service to Said City
and Specifyin$ the Terms and Conditions of Such Contract.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CAPE GIRARDEAU, AS
FOLLOWS:
Section 1. That the Missouri Utilities Company (also hereinafter
Ca11ed the "Campany") , its successors and assigns, hereby contracts with the
City of Cape Girardeau (also hereinafter called the "City") , to supply the City
with street lighting service, upon and su�ject to the terms and conditions
hereina£ter expressed in this ordinance.
Section 2. The Company agrees to furnish and maintain, and the City
agrees to use and pay for, street lighting service as follows:

The above rates are applicable to installations made on wood poles. Installations
on ornamental poles will be increased commensurate caith higher investment costs.
*This rate includes the lighting installed on the TJ.S. Highway 61 urban project
U-61-2 (2) according to an agreement between the City of Cape Girardeau and the
State of Missovri. Missouri Utilities Company has installed 86 - 400 watt Mercury
Vapor Iights on 86 concrete standards. The State Highway Department has installed
45 - 400 watt Mercury Vapor lights on 44 concrete standards, including the under-
ground cable for the entire lighting system of 131 lights. These 400 watt Mercury
Vapor lights shall be incorporated into this contract at the standard rate of $5.00
per month per 1�np.
Section 3. The Campany agrees, upon the request of the City in writing,
to install additional street lamps and to render service thereto, at the rates
hereinabove set out, provided that the Company shall nvt be obligated to install
additional street lamps after eight (8) years from the date of this ordinance, and
in no case shall the lauips be separated at a �reater distance than one standard
block, or approxirnately 400 feet, except at the option of the Company.
Section 4. The Company agrees to change the location of any street lamp
now in use or hereafter installed on the request of the City at the expense of the
CiCy.
Section 5. The Company will render a bill each month fa►r the service
rendered hereunder and the City agrees to nay said bill within one month from the
date thereof. It is understood that all bills not paid within the xnonth after
that in which service is rendered shall bear interest at the rate of 6% annually.
Section 6. This ordinance shall be in full force and effect from and
after its passage and approval and its acceptance in writing by the Company, said
accepCance to be filed within sixty days after the passage and approval of this
ordinance, and upon such acceptance shall r_onstitute a contract by and between
the Citq and the Company for a term of ten (10) years.

Section 7. The Company agrees to exercise reasonable care in maintaining
the facilities to be maintained by it and in rendering the service to be rendered
by it in the performance of this contract so that said service and said facilities
may be furnished and maintained in a satisfactory manner.

Acceptance of Street Lighting Ordinance No. 2457
WHEREAS, the City Council of the City of Cape Girardeau, County
of Cape Girard.eau, State of �vtissouri, on 5eptemb.er 14, 19b4, by proceed-
ings properly held and recorded, passed Orclinance No. 2457, and
WHERE�, Section 6 of Ordinance No. 245? provides that the
Missouri Utilities Co.mpany, if it desires to accept said ardinance, sha.11
file an acceptance within sixty (60) days after the passage and approval of
said ordinanc e;
NOW, THEREF�RE, S�IT KNOWN, that Miasouri Utilities Com�any
hereby accepts said Ordinance No. 2457 of the City of Cape Girardeau,
Missouri, duly passed and approved on September 14, 1964, and hereby
authoriz�s and d3rects the filing of this acceptance with the Clerk of the said
City of �"ape Girardeau.
IN TESTIMONY WHEREDF, said Missouri Utilities Company ha.s
caused this instrument to be executed by Ray W. Call, its President and
attes�ed by T. F. Waltz, Jr. , its Secretary, and the seal of said corporatian
to be hereunto affixed on this 24th day of September, 1964.
