AN ORDINANCE RE�IJI�ATIl� TfiE METHOD OF CONSTRUCTING DRIVEWAYS ON STREET
RIGHT-OF-WAY A1�ID PFRNIISSIBLE CURB QPEE[�TTTNGS FOR SAME .AND THE GRADII� OF AREAS
IN PUBI,IC STREETS IN THE CITY OF CAPE GIRARDEAU, MISSOURI.
BE IT ORDAINED BY THE COUI�CIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI,
AS FOLLOWS:
SECTION l. That in the i.m�ov�nent of streets or future alteration of
streets in the City of Cape Gixardeau, Missouri� curb may be omitted for
future driveways, or e�.sting drive�ays� or if curb is in plaee� may be re-
aoved for such drivexays� provided a m�a.aosmzm �ridth so omitted or removed
sha11 not exceed 16 feet for a single, nor 2!t feet �or a dpuble driveway.
9ny greater omission or removal of existing curb must first be approved by
the City Council or its delegated age�t. Similar apFaoval must be secUred
where a nwpber of curb ogenings are proposed for a service station or other
"drive-in" facility.
SECTION 2. That where new driveways are to be constructed, the owner
or builder sha11 construct same in such manner as will permit the future
oonstruction of sidewalks� so that the grade of the driveway across such
sidewalk shall not exceed one-half inch per foot of i,ndth of the sidewalk.
In the case where the driveway is constructed of P.C. Concrete, eontraction
joints shall be made at both sides of the future position of such sid�►,talk�
and proper expansion joints placed� all as directed by the City Engineer.
Where the dri�eway is to cross an existing sidexa].k the existing grade
of such walk sha11 not be changed, however, its sloge toward the street rnay
be modifi ed if so ap proved by the City Dn�C ne er.
SECTION 3. ��Thst in the event of a change in tre use of a property� or
the situation of a structure, which results in the abandonm�nt of an exis�t.ing
driveway from a street, it shall be the duty of the awner of such property to
proceed at once to restore or ac�just missing curb, or cUrb and guttar�� au�d if
the sidewalk across such drive�ray is not to the proper grade because of such
driveWa.y, to recons truct the sidewalk to a normal posit ion as is determined
by the grade of the curb so restored, so that the area previously occupied by
the drive�ray may be properly used by the public for paxking purposes and for
the proper protectior. of pedestrians using the sidewal.k. Such work of restor-
ation shall meet the approval of the City �h@�neer and confor� to all specific-
ations of the City of Cape Girardeau� NLissouri, pertaining to the ranrk,"
SECTION lt. That in no event sha11 the curb be renoved from the radius
porti.on of the curb at intersecting streets, where sidewalk now, or fhture
sidewalk �11 exist� for the purpose of constructing a drive�ay.
SECTION 5. That the owner or builder shall excavate the area between
the property line and the curb line in such manner that the toe of an�y pro�
posed terrace shall begin at the property line and at an elevation above
the curb as datermined by the City Engineer.
SECTION 6. That for the proposed construction of a building, parking
lot or other purpose, where the renoval of e�dstang curb is required� the
owner or builder shall first sub�nit to the Building Inspectar• a pl,an showing
the proposed work� giving the location and dimensions of such proposed curb
removal. Ido w�rk sha12 then be started until written approval ha.s beai obtained
from th� Building Inspector.
SECTIOAT 7. That any person who violates the provisi ons of Sectlon 1�
ar�td 2, 3, I�, or 5 of this Ordinance sha11 be subject to the payment of a firne
not to exceed � 100.00.

SDCTION 8. That this Ordinance sha7.1 take effect ten days after its
passage and approval.
