AN ORDIIVANCE CONTRACTING WITH THE CITY OF CHAFFEE,
MIS:SOURI FOR AN INTERCHANGE OF SERVICE OF THE FIRE
DEPARTMENTS OF THE CITIES OF CAPE GIRARDEAU AND OF
CHAFFEE: PROVIDING THE TERMS AND PROVISIONS OF THE
A�REEMENT FOR SUCH COMMON SERVICE AND PROVIDING
HOW THE AGREEMENT MAY BE TERMINATED BY EITHER
PARTY ON WRITTEN NOTICE.
WHEREAS, it is deemed desirable that a contract be entered into
for an interchange of service of the fire departments of Chaffee and Caps
Girardeau, Missouri,' and
WHEREAS, 5ections 71, 370 to 71. 390, inclusive, of the Revised
Statutes of Missouri provides that municipalit� s may contract and cooperate
with each other for common services and interchange of service o.f their fire
depart�nents,
NOW THEREFORE, BE TT ORDAYNED BY THE CITY COUNCIL OF
THE CITY OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
Section 1. The City of Cape Girardeau hereby contracts with the
City of Chaffee, effective upon the passage and approval of a like ordinance
by the City Council of the City of Chaffee, for the interchange of service of
the firedepartments of the parties hereto upon the conditions and provisions
hereinafter contained.
Section 2. The fire department of the City of Cape Giraxdeau shall
respond to fire alaxms on call in any part of the City of Chaffee, and the fire
department of Chaffee shall respond to fire alarms on call in any part of the
City of Cape Girardeau, Missouri.
Section 3. This contract shall take effect and be in force as of the
first day of January, 1966, and end on the 31 st day of December, 1970.
Section 4. This contract may be terminated at any time during its
term on the passage of an ordinance to that effect by the legislative body of
either municipality and written notice thereof given to the other party hereto
by serving on the City Clerk of such other municipality a certified copy of
such ordinance terminating this agreemen� The termination shall take effect
sixty days from the date of service of such written notice.
Section 5. The consideration for the service of the fire department
of each municipality shall be the service given for the protection of the lives
and property in such municipality by the service of the fire depaxtment of the
other party hereto, and no compensation shall accrue or be paid by either
party for the service of the fire departments of the other party hereto.
Section 6. Neither municipality sha.11 be liable to the other for failure
to respond to any call by the ather of such municipa.lities, or for delay or neg-
ligence or mi stake in receiving or responding to any call, nor shall this ',
contract be tnterpreted as being an agreement for the benefit of any third
person.

Section 7. Neither municipality ahall be liable by reason of this
contract to any fireman, official or employee of the other, nor shall any
fireman, official or employee of either municipality be considered for any
purpose a fireman, official or employee of any municipality other than the
one by which he is regularly employed.
Section 8. In case of los s or damage to the equipment or prop-
erty of either municipality while responding to fire alarms, such loss or
damage shall be borne by the city owning such equipment ar property,
Section 9. In effectuating the purpose of this contract, the parties
hereto may rnaintain direct telephone lines between the fire stations of each
of them to be used exclusively for fire calls. In such event, the expense of
such lines shall be shared equally by the parties hereto.
Section 10. This ordinance shall take �ffect and be in force upon
the passage and approval of a like ordinance by the City of Chaffee as pro-
vided in Section 1 hereof, but not sooner than ten days after its passage and
approval by the City of Cape Girardeau.. �
