CITY MANAGER FORM ORDINANCE NO. ���2,
AN ORDINANCE ACCEPTING A QUIT CLAIM DEED FROM CLA.RA U. BLATTNER,
WIDOW OF LOUIS C. BLA.TTNER, DECEASED, WHO DIED MARCH 3, 1970,
FOR PART OF OUTLOT NUMBER 85, U.S. PRIVATE SURVEY N0. 2199, CITY
AND COUNTY OF CAPE GIRARDEAU, STATE OF MIS50URI, FOR STREET RIGHT
OF WAY FOR MOUNT AUBURN ROAD BETWEEN ROUTE '°K" AND BLOOMFIELD ROAD.
WHEREAS, Clara U. Blattner, widow of Louis C . Blattner,
deceased, who died March 3, 1970, has executed a Quit Claim Deed,
conveying to the City of Cape Girardeau, Missouri, a portion of
Outlot Number 85, U.S. Private Survey No. 2199, in the City and
County of Cape Girardeau, Missouri, as more fully described
hereinafter in this Ordinance, and the City desires to accept
such deed and have the same recorded.
NO�d, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE
CITY OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
SECTION 1. The City of Cape Girardeau, Missouri, .hereby
accepts a Quit Cla�m Deed executed by Clara U. Blattner, widow of
Louis C. Blattner, deceased, who died March 3, 1970, dated the
lst day of October, 1970, conveying to the City of Cape Girardeau,
Missouri, the following described real estate located in the
City and County of Cape Girardeau, Missouri:
A strip of land for right of way for a public road
70 feet in uzidth, parallel with, adjacent to and 35 feet
on either side of the following descri,bed center line:
Beginning at the northvaest corner of Out Lot 85,
Survey 2199 in the City of Cape Girardeau, Missouri,
thence South 6° West 143. 8 feet; thence on the arc of a
1Q° curve to the left 244 . 5 feet; thence South 18° 27 '
East 2, 470. 4 feet to th.e north line of the Bloomfield
Road and there terminating; containing 4. 59 acres, being
4. 26 acres in Out Lot 85 and 0 . 33 acre in Survey 3090 .
[This deed is given for the purpose of confirming the intent
of the parties to the deeds filed for record October 23,
1967, and recorded in Book 262 at pages 248 and 250,
respectively, to vest in the City of Cape Girardeau,
Missouri, title to the right of way for public road
herein described. ]
SECTION 2. The Quit Claim Deed hereby conveyed as described
in Section 1 hereof is for the purpose of enabling the City, its
agents , servants and assigns to improve Mount Auburn Road between
Route "K'° and Bloomfield Road, in the City of Cape Girardeau,
Missouri, all as shown on the plans for said improvement.

SECTION 3 . Tt is ordered by the Council of the City
of Cape Giraxdeau that �aid deed be recorded by the City Clerk
in the Office of the Recorder of Deeds of Cape Girardeau County,
Missouri.
SECTION 4. Thi;s ordinance shall be in full force and
effect ten (10� days after its passage and approval.
