CITY MANAGER FORM ORDINANCE NO. 52 �
AN ORDINANCE ACCEPTING EASEMENTS FOR SEWER5 IN SEWER DISTRICT
NO. 12-AA-3 FROM L. FT. LANDGRAF REAL ESTATE AND DEVELOPMENT
COMPANY, INC. , A MZSSOURI CORPORATION; AUGUST C. HEISLER AND
CATHELINE HEI5LER, HTS WIFE, TN THE CTTY AND COUNTY OF �APE
GIRARDEAiJ, STATE OF MT5SOURI
WHEREAS, L. H. Landgraf Real Estate and Development
Company, Inc. , a Missouri Corporation; and August C. Heisler and
Catheline Heisler, his wife, have executed easements for sewers
in Sewer District No. 12-AA-3 conveying to the City of Cape
Girardeau, Missouri, land all in the City of Cape Girardeau,
Missouri, and all as more fully described hereinafter in the
Ordinance, and the City desires to accept such easements and
have the same recorded,
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MIS50URI, A5 FOLLOW5:
SECTION 1. The City of Cape Girardeau, r�iissouri, hereby
accepts easements for sewers, executed by L. H. Landgraf Real Estate
and Development Company, Inc. , a Missouri Corporation; and August
C. Heisler and Catheline Heisler, his wife, conveying to the
City of Cape Girardeau, Missouri, easements for se`nrers in Sewer
District No. 12-AA-3 on the following described real estate located
in the City and County of Cape Girardeau, Missouri:
Part of Lot 10, Block 1, Hildale Estates described
as follows: A strip of land l0 feet wide the center
line of said strip being described as follows:
Begin at a point on the south line of said Lot 10,
160. 0 feet west of the southeast corner of said lot;
thence north parallel to the east line of said Lot to
the north line of said lot, and there terminating, also,
A11 of the north 5 feet of yot 3, Block 2, Hildale
Estates Second Subdivision, also,
All of �the south 5 feet of Lot 4 , Block 2, Hildale
Estates Second Subdivision, also,
All of the north 5 feet of Lot 4, Block 1, Hildale
Estates Second Subdivision, also,
Al1 of the south 5 feet of Lot 5, Block 1, Hildale
Estates Second Subdivision, also,
All of the south 5 feet of Lot 6, Block l, Hildale
Estates: Second Subdivision.

Part of Outlot No. 78-A, in U.S. Private Survey
No. 2199, being a strip of land 10 feet wide, the center
line of said strip being described as follows:
Begin at the Northwest corner of Lot 3, Block 2,
Hildale Estates Second Subdivision; thence West with the
North line of said Lot 3, extended, 160. 0 feet; thence
S. 5° 06 ' Ti�. , parallel to the t�Test line of Hildale
Estates Second Subdivision, 636 feet, more or less, to
the North line of Lot 10, Block l, Hildale Estates,
and there terminating.
and it is ordered that said easements be recorded in the Office of
the Recorder of Deeds of Cape Girardeau County, Mi.ssouri.
SECTION 2. The easements hereby conveyed as described in
Section 1 hereof are for the purpose of enabling the City, its agents,
servants and assigns, to install, lay, erect, construct, maintain,
operate and repair a certain sewer pipe or sewer main which is to be
placed in, on, upon, or across said described property, together with
all the useful, necessary and proper adjuncts, appurtenances,
manholes, and appliances in connection therewith.
5ECTION 3. This ordinance shall be in full force and effect
ten (10) days after its passage and approval.
