ORDINANCE N0. �y ?� AN ORDINANCE APPROVING A PROJECT FOR INDUSTRIAL DEVELOPMENT AND CALLING A SPECIAL ELECTION IN THE CITY OF CAPE GIRARDEAU, MISSOURI , FOR THE PUI�POSE OF SUBP�IITTIr?G TO THE aUALIFIED VOTERS OF SAID CITY THE PROP- POSITION TO ISSUE THE INDUSTRIAL R�VENUE BONDS OF THE CITY OF CAPE GIRARDEAU, T�[ISSOURI , IN THE AMOUNT OF $2 ,500,000 FOR THE PURPOSE OF PAYING THE COST OF PURCHASING AND CONSTRUCTING A PLANT TO BE LEASED OR OTHERWISE DISPOSED Or TO HWI BUILDING CORPORATION, AN INDIAI�A CORP- ORATION, FOP MANUF'ACTURING AND INDUSTRIAL DEVELOPMENT PURPOSES, IN- CLUDING REAL ESTAT�, BJILDINGS , FIXTL'RES APdD MACHINERY, SAID BOTuDS TU BE PAYABLE SOLEL•Y FROI�I THE REVENUES DERIVED FROM SAID PROJECT FOR INDUSTRIAL nF,VELOP��IENT, AND P10T TO BE A GENERAL OBLIGATION OF SAID CITY: DESIGNATING THE TIME OF HOLDING SAID ELECTION AND TH�' JUDGES AND CLERKS TO ACT AT SAID ELECTION, FIXING THE POLLING PLACES OF SAID ELECTION, PRESCRIBING THE FORM OF BALLOT TO BE USED THEREAT, AND AUTHORIZIr1G THE CITY CLERK TO GIVE NOTICE OF SAID ELECTION AP1D r�fAKING THE ELECTION T�iAT SECTION 103(c) (6) (D) OF THE IA?TERNAL REVENUF CODE OF 1954 SHALL APPLY TO SAID BOND ISSUF AND AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK OR OTHER APPROPRIATE CITY OFFICER TO FILE EVIDENCE OF SAID ELECTION WITH ANY APPROPRIATE OFFICER OF THE UNITED STATES, INCLUDII�� THE SECRETARY OF THE TREASURY OF HIS DELEGATE, AND TO TAKE SUCH OTHER ACTION AS MAY BE NECESSARY TO MAKE SUCH ELECTION EFFECTIVE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSaURI, AS FOLLOWS : Secticn 1. That the City Council of the City of Cape Girardeau, Misseuri, hereby approves the project for industrial development relating to purchasing and constructing a plant to be leased or otherwise .disposed of to HWI Building Corporation, an Indiana corporation, for manufacturing and indus�riai development purposes , including real estate , buildings, fixtures and machinery , at the estimated cost of $2,500 ,000, which �roject was duly approved by the Division of Commerce and Industrial Development of the De�artrnent of Business and Administration of the State of Missouri on August 27 , 1g70, and is more fully described in the application filed by said City with said Divdsion of Commerce and Industrial Development to secure such approval. Section 2. That a special election be , and the same is , hereby ordered to be held in the Cit,y of Cape Girardeau, Missouri , on Tuesday , September 22 , 1g70 for the purpose of submittin� to the qualified voters of said City the following proposition : Proposition to issue the industrial rev�nue bonds of the City of Cape Girardeau, P�fissouri , in the amount of $2,500,000 for the purpose of paying the cost of purchasin�; and constructing a plant to be leased or otherwise disposed of to HWI Building Corporation, an Indiana cbrporation, for manufacturing and industrial development pur�oses , including real estate , buildin�s , fixtures and machinery , said bonds to by payable solel,y fram the revenues derived from said pro�ject for industrial development , and not to be a general obligation of said City. Section 3. That the City Clerk of the City of Cape Girardeau, Missouri , be , and she is hereby authorized and directed to give notice of said election by causing to be published in The Southeast P�2issourian, a daily newspaper printed and published in the City of Cape Girardeau, Missouri , and of general circulation in the City of Cape Girardeau, Missouri , a notice of the time , places of holding and purpose of said election, said notice to be published once a week for three consecutive weeks , the first publication of said notice to be made at least twenty one days before , and the last publication to be within two weeks of, the date of said election. Said election shall be held and conducted and the results thereof shall be canvassed in all respects in conformity with the Constitution and lat�rs of the State of Missouri , and in accordance with all ord:i- nances adopted by the City Council of the City of Cape Girardeau , Missouri . Section 4 . That the ballot to be used at said election shall be in substantially the following form: OFFICIAL BOND BALLOT FOR SPECIAL BOND ELECTION IN THE CITY OF CAPE GIRARDEAU, MISSOURI ON Tuesday � September � 22 ,1970 Instructions to vote rs : To vote in favor of the proposition submitted on this ballot , place a cross (X) mark in the square opposite the word "YES" ; �o vote against the proposition submitted on this b allot , place a cross (X) mark in the square opposite the word "NO" . That the City Clerk is hereby directed to prepare and cause to be printed ballots as herein provided, and to prepare or procure the necessary poll books and tally sheets to be used at said election , and shall cause the same to be delivered to the �udges of said election. � Section 8. That said City hereby elects that section 103 (c) (6) (D) of the Internal Revenue Code of 195� shall apply to said bond issue and the Mayor and City Clerk or other appropriate City officer be and they are hereby authorized and directed to file evi- dence of said election with any appropriate officer of the United States , including the Secretary of the Treasury or his delegate , and to take such other action as may be necessary to make such electian effective.
