AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF THE
CITY OF CAPE G�R�,,RDEAU, MISSOURI, BY CHANG�NG THE ZONING OF THE
C-3 ZONING AS PRE5ENTLX EXTENDS TQ HENDERSON AVENUE BETWEEN THEMIS
STREET AND THE EX�STING C�2 ZONE WHICH FRONTS ON BROADWAY, BE
STOPPED AT HANOVER 5TREET, AND THAT THE AREA BOUNDED BY HENDERSON
AVENUE, HANOVER 5TREET, THEMIS 5TREET AND THE AREA SOUTH OF THE
C-2 ZONE WHIGH FRONT$ ON BROADWAY BE ZONED FROM C-3 T0 R-3, IN THE
CITY AND COUNTY OF CAPE GIRARDEAU, STATE OF MISSOURI

WHEREA5, the City Planning and Zoning Commissi,on Y�.as
recommended that all of the property described in Section 1 of
this Ordinance should be rezoned from C-3 Central Business District
to R-3 Two�k'amily Dwelling District; and,
WHEREA5, Public Notice of such change was given as
prescribed in Chapter 30 of the Code of Ordinances: of the City of
Cape Girardeau, Missouri, and public hearing was held on Wednesday,
July 1, 1970; and,
WHEREAS, the Council of the City of Cape Girardeau, Missouri,
has elected to rezone the �roperty described in Section 1 from
C-3 Central Business District to R-3 Two-Family Dwelling District;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GZRARDEAU, MISSOURI, AS FOLLOWS:
SECT�ON 1. Chapter 3Q of the Code of Ordinances of the
City of Cape Girardeau, Missouri, is hereby amended to change the
boundary of the present R-3 Two-Family Dwelling District so as to
include th.e following described property:
That the C-3 zoning as presently extends to Henderson
Avenue betweeri Themis Street and the existing C-2 zone
which fronts on Broadv�ray, be stopped at Hanov�r Street,
and that the area bounded by Hender�on Averiue, Hanover
Street, Themis Street and tY�.e area South of the C-2
zone whi;ch fronts on Broadway be zoned from C-3 to R-3.
SECTZON 2. The City Council hereby finds and declares
that the property described in Section 1 hereof is at the present
time particularly suitable for the purposes and uses of R-3
Two-Family D�relling District, and that such CY�anges authorized hereby
are reasonable and in reasonable conformity with the existing
uses and value of the immediately surrounding properties.
