AN ORDINANCE VACATING CERTAIN LAND IN SEWER DISTRICT NO. 6, 11 ,
12, 13 AND 14, WHICH WAS ACCEPTED IN CITY MANAGER FORM ORDINANCE
NO. 504, FOR 5EWER PURPO5E5, FROM ELMER HEUER AND GENEVA NADINE
HEUER, HIS WIFE, AND ACCEPTING NEW SEti'JER EA5EMENT IN SEWER DISTRICT
NO. 6 , 11, 12, 13 AND 14, FROM ELMER HEUER AND GENEVA NADINE HEUER,
HIS WIFE, FOR SEWER PURPO5ES, WITH AUTHORITY FOR THE MA.YOR TO
EXECUTE
WHEREAS, the City of Cape Girardeau, Missouri , accepted
in City Manager Form Ordinance No. 504, a certain sewer easement
from Elmer Heuer and Geneva Nadine Heuer, his wife, which was
filed in the Recorder' s Office of Cape Girardeau County , Missouri,
on June 19 , 1970 , in Book 281 at Page 572; and
WHEREAS, it has been determined by the City Engineer of
the City of Cape Girardeau, Missouri, that the legal description
of this sewer easement needs to be changed; and
WHEREAS, Elmer Heuer and Geneva Nadine Heuer, his wife,
have signed and executed a new conveyance granting to the City
the necessary sewer easement for Sewer District No. 6, 11 , 12,
13 and 14;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MI5SOURI, AS FOLLOWS:
5ECTION 1. The City of Cape Girardeau, Missouri , hereby
vacates that portion of land granted to the City of Cape Girardeau,
Missouri, by a sewer easement which was filed in the Recorder' s
Office of Cape Girardeau County, Missouri, on June 19 , 1970 ,
in Book 281 at Page 572; accepted by the City in City Manager
Form Ordinance No. 504, described as follows :
Part of Outlot Number 87 , 56 and 55 , and Part of
Rodney 400 Arpen Tract, U. 5. Private Survey No. 2199 ,
City and County of Cape Girardeau, 5tate of r�issouri ,
being a strip of land ten feet in width, the center
line of said strip being described as follows :
Start at a point on the West line of Outlot
Number 55, same being the East line of Outlot Number
87, said point being South 8° 30 ' ?aest, 67 feet from the
Northwest corner of Outlot Number 55, and in the center
of a 30 foot easement heretofore conveyed to the City
of Cape Girardeau, Missouri , for the construction of a
sanitary trunk sewer for 5ewer District Number 6; thence,
South 26° 30 ' East, with the center of said easement,
3I1.0 feet; thence, South 6° �lest, with the center
of said easement, 72. 4 feet; thence, South 41° 07 ' West,

240. 7 feet for the point of beginning; thence, North
41° 07 ' East, 240. 7 feet; thence, North 10° West,
80 .0 feet, to a point which is 20 feet South of the
center line of said 30 foot easement, measured perpendicular
thereto, thence, North 26° 30 ' West, parallel to and 20
feet South of the center line of said 30 foot easement,
640 .0 feet, more or less, to a point at which point
the Center line of said 30 foot easement assumes a
course of North 32° 30 ' East; thence North 32° 30 '
East, parallel to and 20 feet West of the center line
of said 30 foot easement, 350 feet, to a point at which
point said 30 foot easement assumes a course of North
8° 30 ' East; thence North 8° 30 ' East, parallel to and
20 feet West of the center line of said 30 foot
easement to the South line of Bloomfield 5treet and
there terminating.
Also, start at a point on the West line of Outlot
Number 55, same being the East line of 0utlot Number
87, said point being South 8° 30 ' West, 67 feet from the
Northwest corner of Outlot Number 55 and on the center
of a 30 foot easement heretofore conveyed to the City
of Cape Girardeau, Missouri , for the construction of a
sanitary trunk sewer for Sewer District Number 6; thence,
South 26° 30 ' East, with the center of said easement,
311.Q feet; thence, South 6° West , with the center of
said easement, 72.4 feet to the point of beginning;
thence, North 87° 29 ' West, 198.5 feet and there
terminating.
SECTION 2 . The Mayor of the City of Cape Girardeau,
Missouri , is hereby authorized and empowered to execute and
deliver a Release of the described easement in Section 1 above,
to Elmer Heuer and Geneva Nadine Heuer, his wife, who conveyed
the land to the City of Cape Girardeau, Missouri, or its successors
or assigns , for that portion of the land described in the above
mentioned easement Recorded in Book 281 at Page 572 and accepted
by the City in City Manager Form Ordinance No. 504.
SECTION 3 . The City of Cape Girardeau, Missouri , hexeby
accepts a new sewer easement executed by Elmer Heuer and Geneva
Nadine Heuer, his wife, conveying to the City of Cape Girardeau,
Missouri, the following described real estate located in the City
and County of Cape Girardeau, Missouri :
Part of Outlot Numbers 87 and 55 and the Rodney
400 Arpen Tract in U.S. Private Survey Number 2199 ,
in the City and County of Cape Girardeau, Missouri ,
being a strip of land ten feet in width, the center
line of said strip being described as followse
Start at a point on the [aest line of Outlot Number 55,
same being the East line of Outlot Number 87, said point
being South 8° 30 ' West, 67 feet from the Northwest
corner of Outlot Number 55 and on the center of a 30
foot easement heretofore conveyed to the City of Cape

Gixardeau, Missouri , for the construction of a
sanitary trunk sewex for 5ewer District Number 6;
thence , South 26° 30 ' East, with the center of said
easement, 3I1. 0 feet; thence, 5outh 6° West, with the
ceriter of said easement, 72 .4 feet; thence, 5outh
41° 07 ' West, 240 . 7 feet for a point of beginning;
thence, North 12° 58 ' West , 511. 1 feet; thence,
North 4° 14' West, 338.5 feet, thence North 6° 22'
East, 3I1. 1 feet to a point which is the intersection
of a line drawn 2 .5 feet, East of the West line
of Christine Street, extended South and a line drawn
10 feet South of the South line of the existing 20
foot concrete slab on Bloomfield Road, measured
perpendicular thereto; thence North 69° 40 ' East,
parallel to and l0 feet South of the South line of
the 20 foot concrete slab on Bloomfield Road, 192 .9
feet to the center of an existing 30 foot easement
for a trunk sewer in Sewer District Numbex 6, and
there terminating.
and it is ordered that said easement be recorded in the Office
of the Recorder of Deeds of Cape Girardeau County, Missouri .
SECTION 4. This ordinance shall be in full force and
effect ten days after its passage and approval.
