CITY MANAGER FORM ORDINANCE NO. ���
AN ORDINANCE AUTHORIZING THE AWARD OF A CONTRACT FOR SEWER
DISTRICT 12-EE-3 BY ACCEPTING A LATE FILED BID AND BY DECLARING
AN EMERGENCY CONDITION EXISTS SO AS TO AUTHORIZE THE MAYOR TO
ENTER INTQ A CONTRACT WITH JAMES F. 5TOVALL d/b/a SUPERIOR
CONCRETORS

WHEREA5, the City of Cape Girardeau passed City Manager
Form Ordinance No. 499 , so as to construct sewers in Sewer
District No. 12-EE-3; and,
WHEREAS, the City of Cape Girardeau has set bid dates
for the receipt of bids for this particular project on several
occasions but has not received bids on said dates; and,
WHEREA5, James F. 5tova1l d/b/a 5uperior Concretors ,
contracting company, submitted a late filed bid on October 21,
1971; and,
WHEREA5, there is a need to construct these sewers because
of public health, safety and welfare so as to provide a sanitary
system for disposal of sewerage;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE
CITY OF CAPE GIRARDEAU, MISSOURI, AS FOLLOW5:
5ECTSON l. The City Council finds that the bid submitted
by James F. Stovall d/b/a Superior Concretors on October 21,
1971, is a late filed bid which is within the Engineer' s
estimate. Having set several bid dates for receipt of bids
and having failed to receive any bid prior to the late filed,
the City Council declares that such bid by James F. Stovall d/b/a
Superior Concretors , is proper.
SECTION 2 . The City Council finds that an emergency
condition exists because of the need to construct sanitary
lateral sewers in 5ewer District No. 12-EE-3 because the
existing systems of sewerage disposal is no longer worki:ng
properly and there exists conditions in this sewer district
which are dangerous to the public health, safety, and welfare
to the Citizens of Cape Girardeau, Missouri.

SECTION 3 . The City Council having found that the late
filed bid is proper and that an emergency Condition exists
hereby authorizes the Mayor of the City of Cape Girardeau to
enter into a contract with James F. Stovall d/b/a Superior
Concretors, contracting company, under the provisions of City
Manager Form Ordinance No. 499 .
SECTION 4 . This ordinance shall be in full force and
effect ten days after its passage and approval.
