AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF
THE CITY OF CAPE GIRA.RDEAU, MISSOURI, BY CHANGING TFiE ZONING OF
ALL OF LOTS 1, 2, 3, 4 AND 7 OF BLOCK 4, OF VOGELSANG'S SECOND
SUBDIVISION TO THE CITY OF CAPE GIRARDEAU; AND PART OF OUT LOT
57 OF U.S.P. SURVEY 2199 ; .AND PART OF LOT 8 IN BLOCK 6 OF SECOND
SUNSET ADDITION TO THE CITY OF CAPE GIRARDEAU, SOUTH OF WILLIAM
STREET, CITY AND COUNTY OF CAPE GIRARDEAU, 5TATE OF MISSOURI,
FROM R-2 TO C-1

WHEREA5, the City Planning and Zoning Commission has
recommended that all of the property described in Section 1 of
this Ordinance should be rezoned from R-2 Single-Family Dwelling
District to C-1 Local Commercial District; and,
WHEREAS, Public Notice of such change was given as prescribed
in Chapter 30 of the Code of Ordinances of th:e City of Cape Girardeau,
Missouri, and pubTic hearing was held on Wednesday, October 6 , 1971;
and,
WHEREA5, the Council of the City of Cape Girardeau, Missouri ,
has elected to rezone the property described in 5ection 1 from
R-2 Single-Family Dwelling District to C-1 Local Commercial
District;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE
CITY OF CAPE GIRARDEAU, MI5SOURI, A5 FOLLOWS:
SECTION l. Chapter 30 of the Code of Ordinances of the
City of Cape Girardeau, Missouri, is hereby amended to change the
boundary of the present C-1 Local Commercial District so as to
include the following described property:
Al1 of Lots l, 2, 3, 4 and 7 of Block 4, of
Vogelsang' s 5econd Subdivision to the City of Cape
Girardeau, and,
Al1 that part of Out Lot 57 of U.5.P. Survey 2199 in
the City of Cape Girardeau, Missouri, described as
follows:
From the northwest corner of said Out Lot 57 run
5outh 82° 30 ' East with the north line of said Out Lot
for a distance of 1288.0 feet; thence South 7° West
for a distance of 703.56 feet for a point of beginning,
which point is on the northerly line of Lot 7 in Block 4
of Vogelsang' s 5econd 5ubdivision; therice North 7° East
for a distance of 86 . 8 feet more or less to the southerly
line of William Street; thence North 84° 59 ' West with
the southerly line of William Street to the easterly
line of Sheridan Drive as relocated; thence in a southerly

direction and along the easterly line of Sheridan
Drive as relocated to the northwesterly corner of
Lot 7 in Block 4 of VogeTsang's Second Subdivision;
thenCe East along the northerly line of said Lot 7
for a distance of 173. 1 feet more or less to the place
of beginning. Al1 as shown by plat showing relocation
of Sheridan Drive and the location of William Street,
which plat is recorded in Plat Book 5 at page 4.
ALSO, All that part of Lot 8 in Block 6 of
Second Sunset Addition to the City of Cape Girardeau,
South of William Street as shown by plat recorded in
Plat Book 5 at page 4.
SEGTION 2 . The City Council hereby finds and declares
that the property described in Section 1 hereof is at the
present time particularly suitable for the purposes and uses of
C-1 Local Commercial District, and that such changes authorized
hereby are reasonable and in reasonable conformity with the
existing uses and value of the immediately surrounding properties .
SECTION 3 . Th 'is ordinance shall be in full force and
effect ten days after its passage and approval.
