AN ORDINANCE ACCEPTING AN EASEMENT FOR 5EWERS IN SEWER DISTRICT
N0. 12-00 FROM MARVIN J. ENGR.AM AND RUBY B. ENGRZ�M, HU5BAND AND
WIFE, IN THE CITY AND COUNTY OF CAPE GIR.ARDEAU, STATE OF MISSOURI
WHEREAS , Marvin J. Engram and Ruby B. Engram, husband and
wife, have'�s�ecuted an easement for sewers in Sewer District No.

12-00 conveying��o the City of Cape Girardeau, Missouri, land

all in the City of C�e Girardeau, �issouri , and all as more fully
described hereinafter in the Ordinance, and the City desires
to accept such easement and have the same recorded,
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE
CITY OF CAPE GIRARDEAU, MISSOURI, A5 FOLLOW5:
SECTION l. The City of Cape Girardeau, Missouri, hereby
accepts an easement for sewers , executed by AZarvin J . Engram and
Ruby B. Engram, husband and wife, conveying to the City of Cape
Girardeau, Missouri , an easement for sewers in Sewer District No.
12-00 on the following described real estate located in the City
and County of Cape Girardeau, Missouri:
Part of Outlot 78B, U..S.P . Survey 2199 , being a
strip of land 10 feet wide, described as follows:
Begin at a point on the East line of said Outlot 78B,
South 7° 30 ' West, 1,735. 8 feet from the Northeast corner
of said Outlot 78B; this �oint also being the Southeast
corner of a parcel of land as same is described in a deed
recorded in Book 84 at Page 429 of the land records of
Cape Girardeau County, Missouri; thence North 83° West ,
along the South line of said parcel of land, 893.0 feet
to the Southwest corner of said parcel of land; thence
North 5° 30 ' East, along the West line of said parcel of
land, l0 feet; thence South 83° East, parallel to the
South line of said parcel of land, 893 .0 feet to the East
line of said parcel of land; then ce South 7° 30 ' West,
along the East line of said parcel of land, 10 .0 feet
to the point of beginning.
Also, part of Block 6 , Rodney Vista Subdivision,
being a strip of land 10 feet wide, described as
follows:
Begin at a point on the West line of said Block 6 ,
being also the East line of Outlot 78B; U.S .P. 5urvey
2199 ; 5outh 7° 30 ' West, 1,735. 8 feet from the Northeast
corner of said Outlot 78B; this point also being the
Southeast corner of a parcel of land as same is described
in a deed recorded in Book $4 at Page 429 of the land
records of Cape Girardeau County, Missouri; thence
South 83° East, along the South line of said parcel of
land extended East, l28 feet to the South line of
Hawthorne Drive; thence North 30° 11 ' West, along said
South 1ine, 12.8 feet; thence North 83° West, 120. 1 feet
to the West line of said Block 6; therice South 7° 30 ; West,
along said West line, 10 .0 feet to the point of beginning.

and it is ordered that said easemerit be recorded in the Office
of the Recorder of Deeds of Cape Girardeau County, Missouri .
5ECTION 2 . The easement hereby conveyed as described in
Section 1 hereof is for the purpose of enabling the City, its
agents , servants and assigns , to install, lay, erect, construct,
maintain, operate and repair a certain sewer pipe or sewer main
which is to be placed in, on, upon, or across said described
property, together with all the useful, necessary and proper
adjuncts, appurtenances, manholes and appliances in connection
therewith.
5ECTION 3 . This ordinance shall be in full force
and effect ten days after its passage and approval.
