Tha�L the City Council of the City of Cape Cirardeau, i�iissouri, has by resolution is iting, duly adopted at a meetin� o£ said Council held on the �� day of ��-s-� , 19 7/ , founc, and declared it to be necessary to improv{ that part of Glenridge �rive in the City of Cape Girnrdeau, �iissouri, from a point 20 feet ?aest of the East line of ?3andol Avenue to the existing concrete pavement at the end of the turnout at �destwood Drive by grading to the established gra�e and constructing thereori a Portland Cen�ent Concrete Paverr�nt, 6 a.nches thick and 3� feet in width between hack of curbs� together with integral curb along the sides thereof, except at the intersectian at Ra.ndol Avenue �4*here it sha11 be canst„ucted �.n a.ecor.d_ance ��r;_th tre plans, �.nc7udi.n� necessaxv drain�ce f�c�.lit�.es, ass �s sho�,m on tre nl�ns for. s��d ��r.nrovement. the total distance of said improvement to be approximately 7�53 feet, and along which property subject to assessrnent for said ir.�provement totals approximately 1/�7�.6 feet. Saici resolution further provided that said work of improvement should be done by contract let in the usual and ordinary way as provided �y law and ordinance and further provided that special ta� bills should be issued in pay� ment of the cost of said improvement based on an assessment a�ainst the property fronting or abutting on said portion_of said street so improved, as provided by law, and according to the plans, specifications and estim.ate of cost therefor made and filed with the City Clerk and a�opted by the Council, and in accordance with this Ordinance. SECTION 2. That the Council finds and declares t'Zat said resolution has been puhlished in the Southeast A�I�ssourian� a daily newspraper printed and p��'alished in the City of Cape Girardesu� Missot�i, for seven consecutive isGues, and that more than ten days have elapsed si.nce the last publication thereof in said paper, and that a majority of the resident owners of lands lia?�le for the cost o�' said improve ment at the date of the passage oi said resolution and who also own a majority of the front feet fronting and abutting on said improvement did not within ten days after the last date of publication of said resolution, file with the City Clerk their protest against the improvement as required by law aild ordinances of the City The Council being of the opinion that tre necessity still exists for the improve- ment of said Glenridge Drive proposed in said resolution, hereby reaffirms its previous action in declaring eaid improvements necessary. SECTIOII 3. That the Council further fin�s that all rer.,uirements imposed by law and ordinance for said improver:ient have been complied with and that it thereby acquired authority to order said impr.ovement an� now herehy orders and directs that tt1�.t part of Glenridge Drive in the City of Cape Girardeau, Missouri ccmmencing at � a, point 2�J f`eet West of the Ea.st line of Randol �venue to the existing eoncrete z�avement at the end of the turnout at l�Iestwood �rive be improved by grading to t�e established grade and construc�ing tnereon a Port- land Cement Concrete Pavement, 6 znches thick and 3� feet in width between oack of curbs, together with integral curb alon� the sides thereof, except at the inter- section at Randol Avenue where it shall be constructed 3n accordance with the plans, including necessary drainage facilities, all as shown on the pla.ns for said improvement, all in accordance with the plans and specif ications fer said improvement previousl� adoptod and on file in the office of th� City Clerk, with Chapter 88, R. The Council further finds and declares that in its jud�ement the condition of the General Revenue Fund of the City is stzch that no part of the cost of said improvement shall 'ae paid therefrom. Sl,CTTOTd 5. That the Prevailing r�ouxly' �ntagc R�te as d�terminc� by the Depart- ment of Labor and Industrial Rela.�ions rc>r t:he n�ablic works project in !�ra.�*e Determination No. l�/7sq�, is attache� her��to and made a part of t}zis Crd�nance by refcrence. Trat the City of Cape Girardeau is authorized to contract for tY;is public works project with a Contractor who will pay his Grorl�nen the Prevailing Hotzrly Rate of ?�dages for �ach type of workman as determinod in taage Determinai'�ion IQo. is/7SA, who wi11 ��ree to comply 4T1tYi a17. provisions of the Prevailing 'Fiage Law, and who is not prohibited by the provisions of the I'revailing Wa�e Law from contracting with the City on a public wo-rks project. That prior to th� final payment to be made to the Contractor, the City of Cape Gi.rardeau will requirc tlzat the Contractor file an Affidavit stating that the Contractor and all his Subcon- tractors have fully complied with the provisions and requirements of the Prcvailing Wage Law. SECTIO��i 6. The City Clerk is hereby authorized and directed to �dvertise for bids in the newspaper doing the City p_rinting for the construction of said improve- ment according to the plans, specifications and estimate of cost therefor, and in accordanee with law and this ordinance, and the clerk in advertising for such bids shall advise bid�ers of the deposit and bond required by law to be givon, nnd further advise bidders that no contract will be aw�r��d the �uccessful bidder unless he stipulates in his proposal that he will accept special tax bills in p�yment th�refor, and that he w3.11 in no event hold the City liable for the cost of the work or any part thereo.f. SECTI011 7, The vayor of the City is hereby authoriz��d and dirccted to enter into a contract £or the Cit,y with the Contractor who shall h�rcaftcr be Atiaarded the contract for su.ch i:l�:rover.:ent in accordance with the law �nd ordinances of the City; and said contract sh�l1 provide that such wor� of improverrent shall be done in acaordance with the said plans, specifications, estimate of cost, and this ordinanec.
