Tha�, the City Counci2 of the City o� Cape Girardeau, :�;issouri, has by resolution is writing, dul� adopted at a meeting of said Cauncil held on the �'" day of 7"Y�� , 197� , foun� and declared it to be necessary to improvc that part o£ T,oui,s Street in the City of Cape Girardeau� ��3issouri, from the North end of the existing concrete pavement at :dilliam Street to the center of I�erriwether Street by grading to the established grade and constructing thereon a Portland Cement Concrete Pavement, 6 inches thick and 3� feet in width between the back of curbs, except at the in�ersection o� Merriwether Street where the pavement shall be constructed. as shown on the plans, together with integral curb along the sides tl�ereof, all as shown on the plans for said im�rovemont. the total distance of said improvement �o be approximately 215.'�eet, and along which property subject to assessrnent for said improvement totals approximately 39�.1 feet. Said resolution further provided that said work of improve:nent should be done by contract let in the usual and ordinary way as provided �� law and ordinance and further provided that special tax hills should b� issued ii� pay- ment of the cost of said improvement based oL� an assessment a�ains�t the property fronting or abutting on said portion of said street so improved, as provided by law, and according to the plans, speci£ications and estin?ate of cost therefor m�de and filed with the City Clerk and a�opte� by the Council, and in accordance with this Ordinance. SF�CTIOTd 2. That the Council finds and declares t'1at said resolution has been g published in the Southeast A�i,esouriani a daily newspaper printed and. ?�+�blished in the City of Cape Girardeau, Missouri, for seven consecutive iseues, and that more than ten days have elapsed since �che last �ublication thereof in said paper, and that a majority of the resident o�mers of lands liable for the cost of said improve ment at the date of the passage of said resolution and who also own a majority of the front feet fronting and abutting on said improv�ment did not within ten days after the last date of publication of said resolution, f ile with the City C1erk their protest a�ainst the improvement as reauired by law and ordinances of the City The Council being of the opinion that t'1e necessity still exists for the improve- ment of said Z�uis Street proposed in said resolution, hereby reaffirms its provious action in declaring said improvements neeessarv. SECTIOI�I 3. The Council further ordcrs and directs that said work of improvf,- ment on that part of Louis Street above descri�ed be done by contract, and that it be done so that it will in all respects comply with the said plans and specifications there£or, and that t1zE: cost th.cre�f' will not exce�;� th� estim.ate of cost for s�id work preparcd b�- the City ��ri:�err and o� file in the office oF the City Clerk and heretofore approved by t1:�e Counc�.l, exccpt such itexns of work nccessary to the proper c�nstruction of the improvcr��nt and unf.orseen uncl not i.ncluded in the estimata of cost, and sai� work of improverlent s�a11 be done in such manner as to comply with all applicable statutes and ordinances. �?o cc<ni�rac� sha11 be entered into under authority of this ordinance that e�ccecds thc estimata of the whole cost of the improvem.ent previously' made by the City I�gi.n�er and above- referred to. The Council further f�.nds and declares that in its judgement the condition of the General Revenue Fund of the City is such that no part of the cost of said improvement shall '�e paid therefrom. SECTION 5. That the Prevailing T-iourly Ula�c Rate as d�termine� by the Depart- ment of Labor and Industrial Rcl.atior.s .for the public works project in ?�ra�Te Determination No. /�oc?1A , is attache� hereto and Ynade a pa-rt of this Crd�nance by reference. That the City of Cape Girardcau is authorized to contract for this �ublic works project with a Contractor wh� will pay his workmen the Prevailing Hourly Rat� of ?�iages for each type of wor.kman as determined in Wage Determination l�to. {S'ool�4 , who wi11 a�!ree to comply Gaith all provisions of the Prevailing '�•laue Law, and who is not prohibited by the provisions of the I'revailing W�ge Law from contracting with the City on a public works project. That prior to the final payment to be made to the Contractor, the City of Cape Girard�au will require that the Contractor file an Affidavit stating that the Contractor and all his Subcon- trnetors have fully complied with the provisions and rec�uirements of the Prev�iling Wage Law. SECTIOi�d 6. Th� City Clerk ia hEreby authorized Und dirceted to advertise for bids in the newspaper doing the City printing for the construction of' said improve� �ent according to the plans, specifications and estimat�; of cost therefor, and in accordance with law and this ordinanc�, and the clerk in advertising for such bids shall advise b3dders of the deposit and bond required by la�� to be given, and further advise bidders that no contract ti�il1 be awar�c;d the successful biader un1Qs:. he stipulates in his proposal that he will accept special tax bills in payment therefor, and that he w3_ll in no event hold tkie City li�!ble for the cost of the work or any part thereof. SECTION 7. The i`�ayor of the City is hereby authorizE�d and direeted to cnter into a contraet for the City with the Contractor who sh.a11 hc�re�fter �he awarded the contract for such iiiiprover,lent in accordance with the ].aw �nd ordinances of the City; and said contract shall provide that such wor�: of improve��ient sha11 bc done in accordance with the said plans, specifications, estimate: of cos�t, an� this ordinance. SECTION 8. ?�1hen said laork of improvF:r�ent h�s been completed as herein provide� a�id has furth�r been approved Y�;� the Cit,y L.��inec:r in a writt�n report thereof, and whc�n said report has been app��ove� t�nd adoptcd by the �ity Council, the cost of said work shall. be paid for ��ith speci�l. tay bills issue� in favor of the contractox w'.no did the tiaork and a�;ai.nst ��he lots, t.racts and parcnls of land fronting and abuttin� on said improvement along the d�.stanc� rlentione� in proportion to the numb�r of front fect front�ng or abuttirg on said portion of said strect so improvee and in accordance with the law, and which sai� special tax bills shall be �3elivered to �ho said Contractor. Such speoial tax bills shall 'aear interest from 6� days after their date at eight (�) per ccnt, per annum.
