AUTHORTTIES TN GTVTNG THE ST. LOUIS-SAN FR.ANCTSCO RAILWAY
COMPANY AND THE MISSOURI PACIFIC RAILROAD COMPANY NOTICE OF
THE NECESSTTX TO CONSTRUCT A CROSSING IN ACCORDANCE WITH
SECTION 389. 610 RSMo 1969 , STARTING AT A POINT JU5T WE5T OF
THE MIS50URZ PACIFIC RAILROAD LINE ON BOUNDARY 5TREET AND
EXTENDED TN AN EA5TERLY DIRECTION ACROSS THE MISSOURI PACIFIC
RA,ILROAD COMPANY TRACKS AND THE ST. LOUIS�SAN FRANCISCO R,A,ILWAY
COMPANY TRP,.CKS IN ACCORDANCE WITH PLAN5 FILED BY THE CITY
ENGINEER OF THE CITY OF CAPE GIR.ARDEAU, MISSOURZ.

NOW, THEREFOR�, BE IT ORDAINED BY THE COUNCIL OF THE
CITY OF CAPE GIRARDEAU, MISSOURI, AS FOLLOW5:
SECTION 1. The City Council of the City of Cape
Gi.rardeau, Missouri, hereby declares it necessary to open
BoundarX Street starti,ng at a poi,nt just West of the Missouri
Pacific Railroad la.ne extended in an Easterly direction across
the Missouri Paci.fic Railroad line and the St. Loui.s�San Francisco
Railway Company line in the Village of Girardeau, to a point �Test
of the Sanitary Landfill of City Sanitation, Inc. , all in
accordance with the plans filed with the Ci.ty Clerk by the City
Engineer o� the City of Cape Girardeau, Missouri.
5ECTION 2 . Having declared it necessary� to construct
Boundary Street, the City Council hereby authorizes the City
Manager to give notice in accordance wi,th Section 389 . 610 RSMo 1969 ,
for and on behalf of the Municipal Authori,ties of the necessity
for the constructi;on of Boundary Street and to order the
Missouri Paci.fi.c Railroad Company and the St. Louis-San Francisco
Railway Company to construct a crossing so that Boundary Street
can be constructed in accordance with the plans of the City Engineer.
SECTION 3. Upon the Missouri, Paci.fic Rai,lroad Company
and the St. Louis-San Franci,sco Railway Company failing to construct
the crossa.ngs, the City Manager is hereby authorized to order
the constructing of rai.lroad crossings in accordance with Section
389 . 610 RS.N�o 1969 , and to x'ecover double the amount expended

together with all costs in the name of the City of Cape Girardeau,
Missouri, together wi,th a11 damages resulting from the neglect
of the railroad companies to construct the crossing.
SECTZON 4. This Ordinance is declared to be an
emergency and shall become effective immediatelX upon its passage
and approval because of the need to construct a crossing to
serve the Sanitary Landfill with an all-weather road so that the
Citizens of Cape Girardeau can dispose of their garbage during the
high water season. The City Council finds that there is an
immediate danger o� high water which may prevent the Citizens from
disposing of their garbage at the Sanitary Landfill.
