CITY MANAGER FORM ORDINANCE N0. ��
AN ORDTNANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES
OF THE CITY OF CAPE GIRARDEAU, MI5SOURI, BY CHANGING THE
ZONTNG OF PART OF THE NORTH HALF OF OUTLOT NO. 52, U.S.P.
SURVEY NO. 2199, CITY AND COUNTY OF CAPE GIRARDEAU, STATE
OF MTSSOURI, FROM R-2 TO C-1

WHEREAS, the City Planning and Zoning Commission
has recommended that all of the property described in
Section 1 of this Ordinance should be rezoned from R-2
Single-Family D�aelling District to C-1 Local Commercial
District; and,
v�HEREAS, Public Notice of such change was given as
prescribed in Chapter 30 of the Code of Ordinances of the
City of Cape Girardeau, Missouri, and public hearing was
held on Wednesday, December 23, 1970; and,
WHEREAS, the Council of the City of Cape Girardeau,
Missouri, has elected to rezane the property described in
Section 1 from R-2 Single-Family Dwelling District to C-1
Local Commercial District;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF
THE CITY OF CAPE GIR.ARDEAU, MISSOURI, AS FOLLOWS:
SECTION l. Chapter 30 of the Code of Ordinances of
the City of Cape Girardeau, Missouri, is hereby amended to
change th.e boundary of the present C-1 Local Commex'cial
District so as to include the following described propertyc
Part of the North half of Outlot No. 52,
U.S .P. Survey No. 2199 , City and Caunty of Cape
Girardeau, State of Missouri., descri.bed as follows:
Al1 of the land lying between the East line o�
West End Boulevard and the East line of an easement
for a storm v,rater channel and sanitary sewer
outfall line for Sewer Distri,ct Number 5, as said
easement. is described in Book 78, at Pac�e 81, 82 and _
83, i.n the land records of Cape Girardeau County,
Missouri, and a line dra�rn parallel to and 250 feet
East of the East line of West End Boulevard; between the
South line of Locust 5treet and the North line of
Linden Street as said streets exist, extended West
from Giboney Houck's Fourth Subdivision.

SECTION 2. The City Council hereby finds and
declares tI�,at the property described in Section 1 hereof
is at the present time particularly suitable for the
purposes and uses of C-1 Local Gommercial District, and
that such changes authorized hereby are reasonable and in
reasonable conformity with the existing uses and value of
the immediately surrounding properties.
SECTION 3. This ordinance shall be 9.n full force
and effect ten days after its passage a approval.
