AS FOLLO�1S:
SECTIOi�1 l. That the City Council of the City of Cape Cirardeau, ;�iissouri, has
by resolution is wr'ting, dul� adopted at a meeting of said Council held on the
�t i�`- day of �� , �9?Y� founc� and declared it to be necessary to iraprovc
that part of Belle dge ike
in the City of Cape Girnrdeau, :�iissouri, from t?�e center of �`ielrose Aver,ue, north,
to the north line of Be2leridge Subdivision,
by grading to the established �rade and constructing thereon a Portland Cernent
Concrete Paveri�ent, o inches thick and 3� feet in width between the back of curbs,
exce�t at the var�ous interseeting streets, where the pave*nent s'�a11 be constructed
as shotim on the plans, together with integral curb along the sides thereof and
the necessary pipe and inlets for removal of storm water, all as shown on the
plans for said i.mprovernent�
the total distance of said improvement to be approximately 197l�.7feet, and along
whieh property subject to assessment for said improvement totals approximately
3737.7 feet. Said resolution further provided that said work of improve:nent
should be done by contract 1et in the usual and ordinary' way as provided �J law
and ordinance and further provided that special ta: �ills shouid be issued in pay-
ment of the cost of said improvement based on an assessm�nt a�ains�t the property
fronting or abutting on said portion of said street so improved, as provided b�
law, and according to the plans, specifications and estimate of cost therefor made
and filed with the City C1erk and a�opted by the Council, and in accordance with
this Ordinance.
SECTIOT�1 2. That the Council finds and declares t'zat said resolution has been
published in the Southeast pv�,ssourian� a dazly newspaper printed and n�.�blished in
the City of Cape Girardeau, Missouri, for seven consecutive isGues, and that n�ore
than ten days have elapsed since the last publication thereof in said paper, and
that a majority of the resident otimers of lands liahle for t1�e cost o.f saicl ir.�prove
ment at the date of the passa�e of said resolution and who also own a rrajority of �
th� front feet fronting and abutting on said ir,�prove�ent did not within ten days
after the last date of publication of said resolution, f ile with the City CJ.erk
their protest a�;ainst the improvement as required by law and ordinances of the City
The Council being of the opinion that t'.ze necessity still exists for the improve-
ment of said Belleridge Pike proposed in said resolution, hereY�y reaffirms its
previous action in declari.ng said im}�rovements necessary.
SECTIOI�T 3. That the Council furth�r fin�s that all rec;uirements irnposed by
law and ordinance for said impr.ovement have been compl.ied with and that it thereby
acquired authority to order said improvement an� now hereby orders and �iirects that
t::��t part of 3elleridge Pike in the City of Cape Girardeau, i�iissour�
commencing at the center of i�ielrose Avenue, north, to the north 13.ne of Belleridge
Subdivision,
be improved by grading to tne established �rade and constructing thereon a Portland

S�CTIGIV L�. The Council further orders and directs that said work of improve-
ment on that part of Belleridge Pike above dc-,�scribed be done by
contract, and that it be done so that it will in ail respects cemply with th� said
plans and specifications therefor, and t;ha�c ���.e co�t t:�ereoi' tay�.l not �xcee:� the
estimate of cost for said w�rk p����arcd '��-� +'�e City 'h�9:�ecr �nU o� rile in the
office or the City C1erk and .l��retofore a2�;?r�vec3 by� the Counci�.., ex�cpt such items
of work necessary to the proper c�ns�x•uction of the improver��r.t a�,.d unforseen und
not included in the estim�atc of cost, and sai� urork of improvcn�ent s�all be done
in such manner as to comp�_y with all ap�licable statutes and or�inances. i`To
ce:�t�rae#� sha11 be .entered into t:�nder aut'r�ority of this ordinance that e:�ceeds thc
estimate of the whole cost of the improverr.ent previously made by the City I�gineer
and above referred to. The Council further finds and declares that in its jud�cment
the condition of the General Revenue Fund of th� City is such that no part of the
cost of said improvement shall be paid therefrom.
s�cT�oN 5. That the Freva;.ling '�iourly Wage Rate as deterrnined by the Depart-
ment of Labor and Industrial �,elat�or.s for the pu�lic works p��cject ir_ ?��ame
Determination No. ��p,is attache� here��o and made a paryt of t��is Crdi.riance hy
reforence. That the City of Cape G�rardc�u is authorized to contract for this
public works project with a Contractor who will pay his worlQnen the Prevailing
Hourly Rate of ?hlages for each t�rpe of workman as dctermined in tdage Determination
I�o. 167��A� who will agree: to comoly' with a11 provisions of the Prevailing T�•Ta�e
Law, and who is not prohibited by the provisions of the Prevailing Wage Law from
contracting with the City on a public works project. That prior to the final
payment to be made to the Contractor, the City of Cape Girardeau will require that
the Contractor file an Affidavit stating that the Contractor and all his Subcon-
tractors have fully complied with the provisions and requirements of the Frevailing
Gtage Law.
SECTIOi�d 6. The City Clerk is herebj� authorized �nd directed to advcrtise for
bids in the newspaper doing th� City printing for the construction of said improve-
nent according to the plans, specifications and estimate of cost therefor, and in
accordance with law and this ordinance, and the clerk in advertising for such bids
shall adviae bidders of the deposit and bond required by law to be given, and
further advise bidders that no con�cract w�_ly be awar�3cd the successful bidder unles:
he stipulates in his proposal that he w�ll ��cc�:pt special tax bills in p�ymcnt
therefor, and that he will in no event hold the City liable for the cost of the
work or any part thereof.
SECTION 7. The v��yor of t�e rity is he-reby authorize<d anc� directed to cnter
into a con�;ract for the City with the Contractor who shall hcreaftcr he awa.rde� the
contraeti for such i.�iprover.ent in accordance with the l�w and or�linances of the City,
and said contract sh�ll provide that such work of improven�ent sha11 be done in
accordance with the sai�? plaizs, specifie<�tiona, Estim:�te of cost, and this
ordinance.
