That the City Council of the City o�' Cape Girardeau, ;�;issouri, has by resolution is ting, duly adopted at a meeting of said Council held on the � 1 �-`' day of �C,�.e_ , lq%�/, foun� and declared it to bP necessary to iinprov� that part of She ood I?rive in the City of Cape GirArdeau, ��iissouri, from the end of the existing concrete pavenent� 10 feet east of' th,e east line of 4Jestwood Drive, east 7��.6 £eet to the existing concrete pavement by grading to the esta�lished grade and constructing thereon a Portland Ceraent Concrete Pavement, 6 inches thick and 3� feet in width between the back of curbs� except at Weissinger Lane, where t�e pavenent shall be constructed as shown on t�e plans� together with integral curb along the sides thereo_t' and the necessary �lt�@ and inlets for the reroval of storm water, all as showm on the plans for said imnrovement the total distance of sa.id improvement to be approximately 7�8.55feet, and along which property subject to assessment for said improvement totals ap�roximately 1365.1 feet. Said resolution further provided that said work of improvement should be done b3� contract let in the usual �3d ordinary way as provided �y law and ordinance and further provided that special ta� bills should be issued in pay- ment of the cost of said improve�nent based o.z an assessment af ainst the property fronting or abutting on said gort3.on of said stre�:t so improved, as provided by law, and according to the plans, speci.fi.cations and estiinate of cost therefor made and filed with the City Clerk and a�opted by the Council, and in accordance witl� this Ordinance. SECTIOI�1 2. That the Council finds and declares tizat said resolution has been puhlished in tYie Southeast M3.ssourian� a dail.y newspaper printed and ��iblished in the City of Cape Girardeau, Missott�i, for seven consecutive issues, and that more than ten days have elapsed since the last publication thereof in said paper, and that a majarity of the resident owners of lands liable for the cost of said improve ment at the date of the passage of said resolution and who also vwn a mejority of the front feet fronting and abutting on said improver�ent did not within ten days a.fter the last date of publication of said resolution, file with the City Clerk their protest a�ainst the improvement as required by law end ordinances of the City The Council being of the opinion that t'�e necessity still e.xists for the improve- ment of said Sherwooct Ur�ive proposed in said resolution, hereby reaffirms its pravious action in declaring eaid improvements necessary. SECTIOI� 3. The Council further finds and declares that in its judg�ement the condition of the General Rovenue Fund of th� City is such that no part of the cost of said improvement shall. be paid therefrom. SECTION 5. That the Preva�ling Hourly Wagc Rate as deterrninc:�1 by th� Depart- ment of L�bor and Industrial Rela.tions �'ar thE �ublic workw p�O jPCt in ?�,rane Determination No.%�7�, is attache� hereto and rnade a pal t of' t}zis Crd3nar_ce by refcrence. That the City of Cape G�rardeau is authorized to contract for this public worka project with a Contractor who will pay his worl�nen the Prevailing Hourly Rate of ?�Iages for each type of worim�an as determined in Wage Determination I�o./6��f+�f-�, who will a�ree to comply with all provisions of the Prevailing '-ia�e Law, and who is not prohi�ited by the provisions of the Prevailing Wage Law from contracting with the City on a public works project. That prior to the final payment to be made to the Contractor, the City of Cape Ctirardeau will require that the Contractor file an Affidavit stating that the Contractor and all his Subcon- tractors have fu11y complied with th� provisions and requirernents of the Prevailing Wage Law. SECTIO��? 6. The City Clerk is herebjr authorized and directed to advertise for bids in the newspaper doing the City printing for the construction of said improve- ment according to the plans, specifications �nd estimate of cost therefor, and in accordance with 1aw and this ordinance, and the clerk in advertising for such bids shall advise bidders of the depoGit and bond required '�y law to be given, and further advise bidders that no con�,ract will be awar�ed the successful bidder unless he stipulates in his proposal that he wiil accept speci�l tax bills in paymcnt therefor, and that he wi.11 in no event hold the City liable for the cost of the work or any part thereof. SErTION 7. The ��:ayor of the City is he-reby authoriz��d and directed to cnter into a contract :for thc City �•�ith the Contractor who shall here�f'tcr �he acaarded the contract for such i:i�roveraent in accordance with the ].aw �nd ordinances of the City; and said contract sh��ll provide that such wor!: of improvement shall be done in accordance with the said plans, specificatioils, Estim��te of cost, and this ordinancc.
