AN ORDINANCE DECLARING A NECEBSITY FOR THE CITY OF CAPE GIRA.RDEAU,
MISSOURI, TO ACQUIRE, EITHER BY PURCHA5E, GIFT OR CONDEMNATION,
LAND A.LONG NEW MADRID STREET, BETWEEN HENDER50N AVENUE AND ILLINOIS
AVENUE, FOR STREET IMPROVEMENTS; AUTHORIZING .AND DIRECTING THE
ACQUISITION OF LAND ALONG NEW MADRID STREET, BETWEEN HENDERSON
AVENUE AND ILL:CNOIS AVENUE, FOR 5TREET IMPROVEMENT5, EITHER BY
PURCHASE, GIFT OR CONDEMNATION; AUTHORIZING THE M1�.YOR TO EXECUTE
ALL INSTRUMENT� AND DOCUMENTS NECE5SARY OR REQUIRED FOR THE
ACQUISITION OF 5AID LAND, CONTAINING AN EMERGENCY CLAUSE

NOW, THEREFORE, BE IT ORDAINED BY THE COLTNCIL OF THE CITY
OF CAPE GIRARDEAU, MI550URI, AS FOLLOWS:
SECTION 1. The City Council of the City of Cape Girardeau,
Missouri, does hereby declare and find that a public necessity
exists for the acquisition by the City of Cape Girardeau, Missouri,
of land along New Madrid Street, between Henderson Avenue and
Illinois Avenue, for street improvemerits.
SECTION 2 . It is he:reby ordered that the City of Cape
Girardeau, Missouri shall acquire property along New Madrid Street,
between Henderson Avenue and Illinois Avenue, for street improvements,
said property and property rights to be acquired being more
particularly described as follows:
Part of Block 1, McLaureri Heights Sub division,
City and County of Cape Girardeau, State of Missouri ,
being the south 50 feet of Block l of said McLauren
Heights Subdivision.
AL50, a temporary construction easement for placing
roadway fill and adjusting drainage over:
Part of Block l, McLauren Heights Subdivision,
City and County of Cape Gixardeau, 5tate of Missouri,
described as follows:
Begin at the northeast corner of Illinois Avenue
and New Madrid Street; thence north along the east
line of Illinois Avenue, 20 feet; thence east, parallel
to the north line of Normal Heights 5ubdivision and
said line extended west, 95 feet; thence north, parallel
to the east line of Illinois Avenue, 20 feet; thence
east, parallel to the north line of Normal Heights
5ub division, l00 feet; thence north, parallel to the
east line of Illinois Avenue, 10 feet; thence east,
parallel to the north line of Normal Heights, 200
feet; thence south, parallel to the east line of
Illinois Avenue, l0 feet; thence east, parallel to
the north line of Normal Heights 5ubdivision, l75
feet, more or less, to the west line of Henderson
Avenue; thence south along the west line ot Henderson
Avenue to a point which is 50 feet north of the north

line of Normal Heights Subdivision; measured normal
thereto; thence west, paralleT to the north line of
Normal Heights 5ubdivision, 590 feet, more or less,
to the point of beginning.
ALL RIGHT5 of the City in the temporary construction
easement to forever cease upon completion of the
construction of New Madrid Street from Henderson
Avenue to Illinois Avenue.
5ECTION 3. It is hereby ordered that the land descrihed
in Section 2 hereof shall be acquired by the City of Cape Girardeau,
Missouri, either by purchase, gift or, if in any edent said City is
unab le to agree with the owners of said real estate as to the value
thereof, then it is ordered that condemnation proceedings be
instituted in the name of the City of Cape Girardeau, Missouri, in
the proper court in order to acquire said land by the exercise of
the right of eminent domain, in the manner as provided for in the
laws of the State of Missouri .
5ECTION 4. The Mayor of the City of Cape Girardeau, Missouri,
is hereby authorized and directed to enter into on behalf of said
City any agreement, contract, option or deed with any person
whatsoever in connection with the acquisition of said interest in
land for said City, and he is hereby authorized to execute on behalf
of and in the name of said City any instrument or document which
may be necessary in the acquisition of said land.
5ECTION 5. Th'is Ordinance is necessary for the immediate
preservation of the public peace, health and safety and shall go
into effect immediately upon its passage and app val.
