AN ORDINANCE DECLARING A NECES5ITY FOR THE CITY OF CAPE GIRARDEAU,
MISSOURI, TO ACQUIRE, EITHER BY PURCHASE, GIFT OR CONDEMNATION,
ADDITIONAL LAND WE5T OF THE PRESENTLY EXISTING CAPE GIRARDEAU,
MISSOURI MUNICIPAL AIRPORT; AUTHOF.IZING AND DIRECTING THE ACQUI-
SITION OF ADDITIONAL LAND WE5T OF SAID AIRPORT, EITHER BY PURCHASE,
GIFT OR CONDEMNATION; AUTHORIZING THE MA:YOR TO EXECUTE ALL INSTRUMENTS
AND DOCUMENTS NECESSARY OR REQUIRED FOR THE ACQUISITION OF 5AID LAND;
CONTAINING .AN EMERGENCY CLAUSE

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MI5SOURI, AS FOLLOW5:
SECTION 1. The City Council of the City of Cape Girardeau,
Missouri does hereby declare and find that a public necessity
exists for the acquisition by the City of Cape Girardeau, Missouri
of additional property to the West of the existing Cape Girardeau,
Missouri Municipal Airport.
SECTION 2 . It is hereby ordered that the City of Cape
Girardeau, Missouri shall acquire property to the West of the
existing airport, said property and property rights to be acquired
being more particularly described as two (2) different tracts
as follows:
TRACT 1-1.
An avigation easement in accordance with F.A.A.
Standards .
Part of the Northeast 1/4 of Section 34, T. 30 N. ,
R. 13 E. , County of Scott, Missouri , described as
follows:
S�art at the Southeast Corner of the Northeast
1/4 of 5ection 34; therice North �° 28' West, with
the East line of 5ection 34, 253.9 feet; thence North
82° 44 ' West, 50 .5 feet to the West right-of-way line
of the Little River Drainage District Ditch No. l,
for a point of beginning; thence continue North 82° 44'
West, 2332 . 8 feet; thence North 15° 48' East, 1750 feet;
therice South 65° 40 ' East, 2006 .5 feet to the'�West
right-of-way line of Ditch No . 1, aforementioned; thence
South 0° 28' East, with said right-of-way line 321. 85
feet; therice North 68° 29 ' West, 1702 . 76 feet; thence
South 15° 48 ' West, 900. 0 feet; thence South 79° 55'
East, 1862.54 feet to the West right-of-way line of
said Ditch No. l; thence South 0° 28' East, with said
right-of-way line 262 . 84 feet to the point of beginning,
containing 41.000 Acres .

TRA.CT 1-2 (Alternate) .
The following desaribed property in fee simple.
Part of the Northeast 1/4 of Section 34, T . 30 N. ,
R. 13 E. , County of Scott, Missouri , described as
follows:
Start at a point on the center line, at the extreme
West end of the existing concrete pavement of the
East-West runway of the Cape Girardeau Municipal Airport;
thence North 74° 12 ' West, with the center line of said
runway, extended, 2200 feet for a paint of beginning;
thence North l5° 48' East, 50 .0 feet; thence North
74° 12 ' West, 900 .0 feet; thence 5outh 15° 48' West,
60. 0 feet; thence South 74° 12 ' East, 900. 0 feet;
therice North 15° 48 ' East, 10 .0 feet to the point of
beginning, containing 1.240 acres .
5ECTION 3. It is hereby ordered that the land described
in Section 2 hereof shall be acquired by the City of Cape Girardeau,
Missouri, either by purchase, gift or, if in any event said City is
unable to agree with the owners of said real estate as to the value
thereof, then it is ordered that condemnation proceedings be instituted
in the name of the City of Cape Girardeau, Missouri, in the proper
court in order to acquire said land by the exercise of the right of
eminent domain, in the manner as provided for in the laws of the
5tate of Missouri.
SECTION 4. The Mayor of the City of Cape Girardeau, Missouri,
is hereby authorized and directed to enter into on behalf of said
City any agreement, contract, option or deed with any person
whatsoever in connection with the acquisition of said interest in
land for said City, and he is hereby authorized to execute on behalf
of and in the name of said City any instrument or dodument which
may be necessary in the acquisition of said land.
SECTION 5. This Ordinance is necessary for the immediate
preservation of the public peace, health and safety and shall go
into effect immediately upon its passage and appro al.
