SF.CTT�N l. mhat the Council of the Ci.ty of Cape G:irardeau, Migsouri, deems
and declares that a pu'alic necEssity exists for t!�e construction of sidewallcs, on
the north and south sides of Normal Avenlxe, from the west curb line of Sprigg Street
to the east ourb 13ne of Alta V3.sta I3�rive, and from the vrest curb line of Sprig�
in the City o.f_ "ape Gi.rar�caiz, �-iiGsou.ri, a11 as de�cribe�� in th� plans and specifi- �
cations an� estimate of cost therefor, heretofore approve� �n�� a�opte� by thc City
Council and now on file in the office of t�e Ca.ty �le-rk, and that ;=aid sidew�lks
shall b� constructed as set out in said plans an:? speca..ficati_ons and estimate of y�
cost.
SECTION 2. 7'hat sai� sidewalks as describ�d in �he plan� and specifications
and estimate of cost shall be construeted in accor�ance w�.th �cl1e provisions of
Chapter $$, and all modifications thereoi, �visea �tatut�s of Miaaouri, 1�59, and
all Ordinances of the "vity of Cape Girardeau, Nlissouri, pertaining ther-r,to.
SECTIO� 3. That the said work of constructin�; said sidewalks shrall be donQ by
contract, and the City Clerk is hereby authorized and directed to advertise for
bids in the newspaper doi.n� the City printing in accordance with law and ordinance,
a�vising bidders oF 1;h� deposit and bond required bv law l�e �;iven, and that no
contraet will be awarded the succes�ful bidder unless he stipulates in his prono�al
that he will accept special tax bills in payment thereior, and that he will in no
event hold the City liable for the cost of the work or �n�;- part ther.eof.
SECTION 4. ThaL the cost of constructing said si��.c�taa]_ks sha11 not e<:cef_:d th�
estimate of cost for said work prepared �y ttze Cit�r r�gineer an� on fil� in the
office of the City �1crk, excc�t s��?ch items of work nec� ssary for the prope.r
construction and not inclu�e� in said estir��ate.
I�?o con�;ract shall be entered into which excee�s the estir.��te of cos� heretofor
referred to. The Co�ancil fin��s and declares that in i_t^ judgmont �the condit3.on of
t'�e general revemae fUnd of tt�e City is suc'� that no part of �he cost of said
i:nprovement shall be naid therefrom.

ment of L��bor and Industrial Relations for the r�,_i�lic worl�s pr.ojec� in T.�acrE;

Law, and who is not prohibited by the provisions of the i'reva�.ling t.1a�,re Lat,r from
contracting with the City on a p:?blic worl�s p:.�ojact. �'hat prior to the £inal �ay-
ment to be rnade �o the Contractor, the City of Cape �'i:r���°deau will reruire that the
Contractor file an Elffidavit stating tha ;, tl:.e Contractor and all his Subcontractars
have full�T complied with the p.rovisions and requirements of the �'revail in�� tiage La�a
;£CTTON 6. Th�t the �iayor of thc Citj� is herebTr authorized and directed to
enter into a contract ior the City an� the Contractor whic}i shall provide that the
�rork be done iri accordance ��rith the s�i:� plans, specifications and estimate of

`3LCTIOid 7. That an accurate account shall �e kept by f;he Ci-cy ?�hgineer of the
cost of the work, under eontract prices, and such cost including en�;ineering Fees
shall be assess�d against �he property fronting and �'�uttin� an sai� strect alon�
�;hich said improvement is mr�de.
Upon the completion of said caork the City IlZgineer shall report to the Council
�ch� tatal cost oF said sidewallcs, the total number of lineal feet o� pr.operty
frontin€ and abutting thereon9 and the sha.re of such total cost ehargeable agains�t
c��ch lot, tract and parcel of land fronting and a'�uttin; tlzer�on.
SECTIOid 8. That upon filin�; of the report o.� t'zc; City T��ineer of the tot�l
cost of the construction o� said sidcwalks, the City Council shall examine t'��

same and if said report is found correct, the Council sha11 levy and aesess a
special tax a�ainst the property in accordance with said report. Such tax biZls
shall be assigned to the contractor� as shall be payable from and after b� days
from the date of issue, and said tax bills shall provide that if they are not paid
when due they �hall bear interest at the rate of eight per cent ($�) per annum,
and shall becon�e imme�iately due and payable.
SECTION `�. That this Qrdinance shall take effect and be in force from and
after 1Q days following its passage and approval.
