SECTTC'N 1. mhat the Council of the City of Cape Girardeau, I�J�.ssouri, deems
and declares that a public necessity exists for t?�e construct�.on of sidewallcs, on
the south �ide af Washington Avenue� between Frederick Street and Sprigg Street�
all as shown on the p7.a,r�s for such construct3.on, hereafter ref'erred to
in the City of i,ape G.irar�eau, ��ii_s5ouri, all as describel in the plana and specifi-
cations an� estimate of cost the:�^�for, heretofore approve�3 an� a�opte� �y th� City
Council and now on f.ile in the office of the: City Clerk, and that Gaid s�dewalks
shall be constructed as set out in said plans an�? spec�.ficat�.ons and estimate of
cost.
SECTION 2. That said sidewalks as describ�d in the plan� and specifications
and estin�ate of cost shaZl be constructed in accordance wi.th the proviai�ns of
Chapter 88, and all modifications t�lereof, Revi��d �tatut�s o_f Missouri, 1�59, and
all drdinances of the City of Cape C•irardeau, M3ssouri, pertaining thercto.
SECTION 3. That the said work of constructing said sidewalks shnll be doz�e by
contract, and the City Clerk is hereby authorized and directe� to �dvertise for
bids in the newspaper doing the Citv printing in accordance with law and ordinance,
aivising bidders of �;he deposit and bond required by law bE� �;iven, �nd that no
contract will be awarded the successful bidder tLnles� he stipula-�es in his proposal
that he will accept special tax bills in payment therefor, and that he will in no
evex�t hold the C,�_ty ?iable for the cost of the work or an�J� part thereof.
SECTSON 4. Tha�, the cost of constructing said si��c.faalks sh711 not e?ceed t!�e
estimate of cost for said work prepared by the Cit,y L�RineF:r an� on £ile in the
office of the Cit,y �lc-rk� exc�pt s��ch items of work nc�c ssary £or the proper
construction and not include� in said estir��ate.

referred to. The Council fin?G �n� �3ecl.ares that in it� jl�dgmont the condition of
t'�e general revenue- fun-� of t'1e City is suc'1 �hat no part of the cost of said
i:�rovement shall he paid �therefrom.

ment of Labor and Industrial Relations fo�° the ��_i�lic wori�s projec� in ?i�aae

Law, and who i� not pro�iibited by the p^ovisions of the I'revailing tiaa�e Law f.rom

SECTION 6. That the �'iayor of the City is hereb�T a,�thorized �nd directed to
enter into a contract for thc City an7 the Contractor whic?� shall providc that the
�:�ork be done in accordance ��rith the sai,� plans, spEc�fications and estimatE of
cost9 �,nd this Ordinance. >aid sidei�ral'tis sh�:ll be constructed ui�.der tlic� di.rection
an� supervision of the; City :h�;ineEr.
",ECTICN 7. That an acet;rate. account shall ��� kept i�y the Ci�c,y ��ineer of the
cost of the work, under eontract prices, and such co�� �_nclud�ng en�ineering fees
shall be aasessed ar;:�inst the propert,y fronting and ahutting on sai.-� strcct alon�
�:hich said improvement is ma�e.
Upon the completion of said work the City �gineer shall report to th� �ouncil
Lhe total cost of said sidewalks, the total nuinber of lineal feet o.� p.r.operty
f_rontin�; an� abuttin� ther�^�n, and the sha.r.e of such total cost char��able against
�ach lot, tract �nd parcel o�' 1�3nd fronting and a'�uttin� thereon.
S�CTIO�J g. That upon filin�; of th� report o.� the C:it� Fn�;inner of the tot�1
cost of t�ze construction of. said sidew�lks� the City Council shall examin� t':?�

same and if s�id report is found correct� the Council shall levy and assess a
special tax a�ainst the property in eccordance with said report. ,�uch tax hilis
shall be assigned to the contractor, as sha12 be payable from and after b�� days
from the date of issue, and said tax bills shall provide that, if they are not paid
when due they �hall bear i.nterest at the rate of eight per c�nt (��) per annu�,
and shall beconie immedia�ely due and paya'�le.
SECTIOI� ��. That this Ordinance sha.11 take effect and be in force from and
after ZO days following its passage and approval.
