HomeMy WebLinkAboutCityMgrForm.665.05-17-1972 � � 1 � • /� > CITY MANAGER FORM ORDINANCE NO. � � S AN ORDINANCE AMENDING 5ECTION 5-23 (c) OF THE CODE OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU, MISSOURI, TO ALLOW APPLICANTS TO SUBMIT STATEMENT5 FROM CERTIFIED PUBLIC ACCOUNT.ANTS IN LIEU OF A FINANCIAL STATEMENT WHEN THE NET WORTH OF SUCH APPLICANT5 EXCEEDS $100,000 IN THE CA5E OF WHOLE5ALERS AND DI5TRIBUTORS OR $10 ,000 IN THE CA5E OF ALL OTHER APPLICANTS FOR A LICENSE UNDER THE PROVISIONS OF THI5 CHAPTER _ _ NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MI550URI, A5 FOLLOW5: SECTION l. That Paragraph (c) of 5ection 5-23 of the Code of Ordinances of the City of Cape Girardeau, Missouri , reading as follows: " (c) Financial statement. All applications shall be accompanied by an exact financial statement for the preCeding calendar or fiscal year of the applicant. 5uch financial statement shall include a detailed statement of the assets and liabilities of the applicant. Such application shall also have attached to it the address or location of the place where applicant intends to sell alcoholic beverages . " shall be and is hereby modified, changed and amended to read as follows : " (c) Financial state:rient. All applications shall be accompanied by an exact financial statement for the preceding calendar or fiscal year of the applicant or a statement from a Certified Public Accountant. The statement from the Certified Public Accountant shall show that the applicant ' s net worth exceeds $100 ,000 in the case of wholesalers and distributors or $10 ,000 in the case of all other applicants for a license under the provisions of this Chapter. The financial statement shall include a detailed statement of the assets and ' "` r � �-Y ~ . - - 2 - liabilities of the applicant. The application shall also have attached to it the address or location of the place where applicant interids to sell alcoholic beverages. " SECTION 2. If any section, subsection, senten.ce, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and indeperident provision and such holding shall not affect the validity of the remaining portions hereof. SECTION 3 . This ordinance shall be in full force and effect ten days after its passage and approval.
