Thai� the City Council of the City oi Cape Ctirardeau, '.�issouri, has by resolution is writing, duly adopted at a meeting of said Council held on the /5�'" day of �����✓ , 19�2 , foun�, and declared it �o be necessary to improve that part of Barberry Stxeet and Hillview Drive� Fdgew�ood Higl�lands 3ixth Subdivision in the City of Cape Girardeau, i��iissouri, from the end of the existing GflTiCY'8� gavement at Barberry St�reet anci Quinae 5treet to the e�cisting concrete pavement at Hil7,view Drive and Quince Street by grading to the established grade and constructing thereon a Paa�tland Cement Conar�ete Pavemen.t, 6 3.nchea thick and 30 feet in width between the back of curbs� except at the various intersecting streets, where the pave�ent shall be constructed as shown on the plans, together with integra7. curb along the aides thereof and the neeessary pipe and inlets for remaval of' starm water, all as showa on the plans for said imprcrvement the total distanee of said improvement to be approximately 1599.4feet, and along which property sezbjeet to assessment for. said improvement totals approximately 3101�.8 feet. Said resolution further providecl that said work of improvement should be done by contract Zet in the usual and ordinary way as provided �y law and ordinance and further provided that special. ta: bills should be issued ir� pay- ment of the cost of said improvement based on an assessment a�ains-� the property fronting or abutting on said portion of said street so improved, as provided by law, and according to the plans, specifications and �stimate of cost therefor made and filed with the City Clerk an3 a�opted by the Council, and in accordance with this Ordinance. SECTION 2. That the Council finds and declares t'.lat said resolution has been published in the Southeast �,s�ourian� a daily newspaper printed and nu'�lished in the City af Cape Girardeau, Missou�i, for s�ven consecutive isGues, and that more than ten days have elapsEd since the last publication thereof in said paper, and that a majority of the resident o�aners of lands liable for the cost of said im�prove ment at the date of �the passage of said resolution and who also own a majority of the front feet fronting and abutting on said improver�ent did not within ten days a.fter the last date of publa�cation of said resolution, f ile with the City Clerk their protest a�ainst the improvement as rea1uired by law and ordinanees of the City The Council bein of the op�nion that t'.ze necessity still exists for the improve- ment of said ���� ��ge �roposed in said resolution, hereby rea�firms its previous action 1n ec ar�.ng said improvements necessarv. The Council further orders and directs that said work of improvc- ment on that part of Barberry Street & Hillview Drive above described be done by contract, and that it be done so that it wiZl in all respec�cs comply �rith the said plans and specifications therefor, and t;ha�t thE cost �hereof zai�l not exceed thc; estimate of cost for snid work prrpareu b� the City ��;i.leer �:nd on file in the office oi the City Clerk and heretofore approved by the Counc�l, exccpt such ite��s of work necessary to the proper construction of the im�roven�nt and unf.orseen und not included in the catimate o.f. cost, and sai:� urork of improvcnient s�a�.1 he d.one in such manner as to comply with all applicable statutes and or�ir.ances. ?�10 cc:��,raci� sha11 b� entered into under authority of this ordinance that exceeds th�: estimate of the whole cost of the improvement previously made by the City I�igineer and above referred to. The Council further finds and declares that ir_ its jud�ement the condition of the General Revenue Fund of the City is such that no part of' the cost of sa,id improvement shall '�e paid therefrom. SECTION 5. That the Frevail�ng �-iourly G�agc Rate as d�termined by th� Depart- ment of Labor and Industrial Re1a.Lions fc�r -the nuhlie works project in ?�Ta•�Te Determi.nation 1Vo. �b�lfto,�� is attache� herc:to and zna.de a part of th�.s Crdinar_ce by refcrence. Trat the City of Cape Girardeau is authorized to contract for this public works project �rith a Coiltractor 41Y1� will pay his workmen the Prevailing I�iourly Rate of �.�iages for each type of wor��man as deter�nined in Ida�e Determination Ido. IG�6o A , who wi.11 a�ree to cornply with all provisions of the Prev�iling T�1a�e Law, and who is not prohibited by the pro�visions of the I'revailing Wage Law from contracting with the City on a public works project. That prior to the final payrnent to be m�ade to the Contractor, the City of Cape Girardeau will require that the Contractor file an Affidavit stating that the Contractor and all his Si�bcon- tractors have fuZly complied with the provisions and requirc�ments of the Prevailing Wage Law. SECTIO��d b. The City Clerk is hereby authorized �nd directed to advertise for bids in the newspaper doing the City printing for the construction of said improve- ment according to the plans, specific�tions �nd estimate of cost therefor, and in accordance with law and this ordinanc�, and the clerk in advertising for such bids sha11 advise bidders of the depos3.t ana bond required by latir to be given, nnd f'tzrther advise bidders tha� no contract will be awarded the successful bidder unless he stipulates in his proposal that b.e will acc�pt speca_�1 tax bills in. payment therefor, and that he will in no event hold the City li�ble i'o.r the cost of the work or any part t'nereo.f. SECTIOV 7. The v�ayor of t�e "ity is he-reby authorized ant� directed to enter into a contract £or the City urith the Contractor who shall here�fter �e ��aardcd the contraet for s�lch i:��rove���ent in accordance with the law and or��inances of i�he City, and said contract sh<�+11 provide that such work of improvement shall be done in acaordance with the said plans, specificati.ons, estimate of cost, and this or.dinance.
