AN ORDINANCE ACCEPTING EASEMENTS FOR 5EWER5 IN 5EWER DISTRICT
NO. 12-H-2 FROM CLARENCE KLAPROTH AND EILEEN KLAPROTH; JERRY
SCHLEGEL; AND JERRY E. ERLBACHER AND CHARLE5 F. BLA.TTNER; IN
THE CITY AND COUNTY OF CAPE GIRA.RDEAU, 5TATE OF MISSOURI
WHEREAS, Clarence Klaproth and Eileen Klaproth; Jerry
Schlegel; and Jerry E. Erlbacher and Charles F. Blattner, have
executed easements for sewers in Sewer District No. 12,-H-2
conveying to the City of Cape Girardeau, Missouri , land all in
the City of Cape Girardeau, Missouri, and all as more fully described
hereinafter in the ordinance, and the City desires to accept such
easements and have the same recorded;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MIS50URI , AS FOLLOWS:
5ECTION l. The City of Cape Girardeau, Missouri, hereby
accepts easements for sewexs, executed by Clarerice Klaproth and
Eileen Klaproth; Jerry Schlegel; and Jerry E . Erlbacher and
Charles F. Blattner; conveying to the City of Cape Girardeau,
Missouri, easemerits for sewers in Sewer District No. 12-H-2 on
the following described real estate located in the City and County
of Cape Girardeau, Missouri:
The south 10 feet of Lot 19 , Caro1 Subdivision,
City and County of Cape Girardeau, State of Missouri.
Part of Lot 3, Outlot No. 78A, U.5 . Private
5urvey No. 2199 , City and County of Cape Girardeau,
� 5tate of Missouri, described as follows:
Begin at the intersection of the north line of
U.S. Highway No. 61 and the east line of said
Outlot No. 78A; thence in a northwest direction
along a 1° 58' curve to the left on said north
line, 134.5 feet; thence continue on said north
line, North 48° 36 ' West, 10 . 1 feet to the east line
of Kurre Lane; thence North 7° 04' East, along said
east line, 12. 1 feet; thence in a southeasterly
direction, parallel to and 10 feet north of the north
line of U.5. Highway No. 61, to the east line of said
Outlot No. 78A; thence South 7° 04 ' �nlest to the
point of beginning.

U.5. Highway No. 61 and the east line of said
Outlot No. 78A; thence in a northwest direction
along a 1° 58' curve to the left on s aid north
line, 134. 5 feet; thence continue on said north
line, North 48° 36 ' West, 70 . 7 feet to the west
line of Kurre Lane and the point of beginning;
thence continue along said north line of
Highway No. 61, North 48° 36 ' West, ?9 . 3 feet; thence
North 61° 3I' West, 80 .0 feet; thence North 28°
29 ' East, 15. 0 feet; thence in a southeasterly
direction parallel and 15 feet north of the north
line of U.S . Highway No. 61, to the west line of
Kurre Lane; thence 5outh 7° 04' West, along said
west line to the point of beginning.
and it is ordered that said easemerits be recorded in the Office
of the Recorder of Deeds of Cape Girardeau County, Missouri.
SECTION 2. The easements hereby conveyed as described in
Section 1 hereof are for the purpose of enabling the City, its agents,
servants and assigns , to install, lay, erect, construct, maintain,
operate and repair a certain sewer pipe or sewer main which is to be
placed in, on, upon, or across said described property, together with
all the useful, necessary and proper adjuncts, appurtenances,
manholes, and appliances in connection therewith.
5ECTION 3. This ordinance shall be in full force and
effect ten days after its passage and approval.
