AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF
THE CITY OF CAPE GIRA.RDEAU, MI550URI, BY CHANGING THE ZONING
OF PART OF LOT NO. 4, RANGE "A" , �ND LOT N0. 1, RA.NGE "A" ,
CITY AND COUNTY OF CAPE GIRA.RDEAU, STATE OF MISSOURI , FROM
R-4 TO C-3
WHEREAS, the City Planning and Zoning Commission has
recommended that all of the property described in Section 1 of
this Ordinance should be rezoned from R-4 Multiple Dwelling
District to C-3 Central Business District; and
WHEREAS, Public Notice of such change was given as
prescribed in Chapter 30 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, and public hearing was held on
Wednesday, February 16, 1972; and
WHEREAS, the Council of the City of Cape Girardeau,
Missouri, has elected to rezone the property described in Section 1
from R-4 Multiple Dwelling District to C-3 Central Business
District;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE
CITY OF CAPE GIRARDEAU, MIS50URI, AS FOLLOWS:
SECTION 1. Chapter 30 of the Code of Ordinances of the
City of Cape Girardeau, Missouri , is hereby amended to change the
boundary of the present C-3 Central Business District so as to
include the following described pro�erty:
TRACT I
All of that part of Lot No. Four (4) , Range "A"
in the City of Cape Girardeau, Missouri, described
as follows: Commence at the Northwest corner of said
Lot Four (4) formed by the intersection of 5panish
Street and Merriwether Street; therice East along the
South line of Merriweth�r Street, 61 1/2 feet; thence
South parallel with Merriwether Street 61 1/2 feet to
Spanish 5treet; thence North along the East line of
5panish Street 50 feet to the place of beginning.
TRACT II
Part of Lot No. Four 4) in Range "A" in the City
of Cape Girardeau, Missouri, described as follows :
Commence at the Northwest corner of said Lot Four (4) ,
Range "A" , thence East along the South line of Merriwether
Street, 61 1/2 feet to a point of beginning; thence
East along the South line of Merriwether Street, 30 feet;
thence 5outh parallel with Spanish Street 50 feet;
thence West parallel with Merriwether Street 30 feet;
thence North parallel with Spanish 5treet 50 feet to the
point of beginning.

T RACT I I I
All that part of Lot Four (4) , Range "A" in the
City of Cape Girardeau, Missouri, described as follows:
Commence at the Northwest corner of said Lot No. 4 ,
Range "A", which is the point of intersection of the
East line of 5panish Street with the south line of
Merriwether Street; thence East along the South line
of Merriwether Street, 91 1J2 feet to a point of
beginning corner; thence South parallel with 5panish
Street 50 feet; thence East parallel with Merriwether
Street 38 1/2 feet, more or less , to the east line of
said Lot No. 4 , Range "A" ; thence North along the east
line of said Lot No. 4 , Range "A" , 50 feet to the
northeast corner of said Lot No. 4, Range "A" : thence ..
west along the South line of Merriwe:ther Stre�t; 38 1/2
feet, more or less , to the point of beginning.
TRACT IV
All of the 5outh Half of the Narth Half of Lot
No. Four (4) in Range °'A" in the City of Cape Girardeau,
Missouri, znore particularly described as follows :
Begin at the Northwest corner of Lot Four (4) in
Range "A" of said City and run 5outh along the East
line of 5panish Street, 50 feet for a beginning corner;
thence East, paralleT with Merriwether Street, 13O feet
to the East line of said Lot No. 4; theriCe South, along
the East line of said Lot, 50 feet; thence West, parallel
with Merriwether Street, 130 feet to 5panish Street;
thence North, along the East line of 5panish Street,
50 feet to the beginning corner.
TRACT V
Part of Lot One 1 in Range "A" in the City of
Cape Girardeau, Missouri, described as follows :
Beginning at the southwest corner of Merriwether
and Main Streets ; thence West along the north line of
said Lot 1 a distance of 84 feet to the northwest corner
of Lot 1; therice south along the west line of Lot 1 a
distance of l00 feet; thence east parallel with the
north line of Lot 1 a distance of 84 feet to the west
line of Main Street; thence North along the west line
of Main Street, 100 feet to the place of beginning,
said Lot facing l00 feet on Main 5treet and 84 feet
on Merriwether Street.
TRACT VI
The North part of the South half of Lot Number
One (1) in Range "A" in the City of Cape Girardeau,
Missouri, described as follows : Beginning at a point
in the West line of said Lot No. l in Range "A" ,
l00 feet South of the northwest corner thereof; thence
run East, parallel with Merriwether Street, 84 feet to
the West line of Main Street, as now widened and extended;
thence run South with the West line of Main Street, as
now widened and extended, 48 feet; thence West, parallel
with Merriwether Street, 84 feet to the West line of said
Lot No. 1 in Range "A" of said City, and thence North,
with the West line of said lot, 48 feet to the point
of beginning.
SECTION 2 . The City Counci7. hereby finds and declares
that the property described in Section 1 hereof is at the present

time particularly suitabTe for the purposes and uses of
C-3 Central Business District, and that such changes authorized
hereby are reasonable and in reasonable conformity with the existing
uses and value of the immediately surrounding properties .
5ECTION 3. This ordinance shall be in ful.l force and
effect ten days after its passage and approval.
