AN ORDINANCE CONV�YING PROPERTY TO MISSOURI UTILTTIES; ASSIGNING CONTRACTUAL
RIGHTS AND INTEftEST TO MISSOURI UTILITIES COMPANY; WITH AUTHORITY TO EXECUTE
A DEED AND ASSIGNI�NT
WHF;REA.S, the City of Cape Girardeau, Nfi.ssouri, entered into a franchise
agreement with Nhssouri Utilities Company to pro vi.de the citizens of Cape
Girardeau, Missouri, with water and
WHEftEAS, such franchise duly approved and adopted by the citizens of
Cape Girardeau, Missouri, at an election pro'v'ides that the City of Cape
Girardeau can construct water lines and sell such water lines to Missouri
Utilities Company, and
WHEFtEAS, such a water line system was constructed pursuant to law and
in accordance with the franchise agreement now therefore:
BE IT ORDAINED BY TH� COUNCIL OF THE CITY OF CAPr: GIRARDr�AU� MLSSOURI,
AS FOLLOWS:
SECTION 1. That the City of Cape Girardsau, Ma.ssoura., in consideration
of one dollar and other good and. valuable consideration, to it paid by
NS.ssouri Utilities Compar.�y, of the County of Cape Girardeau and State of
Missouri, does grant, bargain and sell� convey and confirm unto Missouri
Utilities Compat�y the following described property lying, being and situate
in the County of Cape Girardeau and State of Nfi.ssouri, to wit:
A six inch cast iron pipe which is 6,212 lineal feet in
length with mechanical joints, glands, gaskets, valves, con-
nections all as built per perposal, specifications and plans
for Water Line U�.strict No. 1 NW which are on file in the City
Clerks Office of the City of Cape Girardeau, Missouri. Starting
at a point on the South side of Kage Road across from Kage
Hills drive, thence in a Northeasterl,y direction along the
South sid.e of Kage Road. to a point North of U.S. Route 61,
adjacent to Three Mile Creek ftoad all as shown on the plans
for F�tension of Kage Water Line Facilities� Water District
No. 1 NW which are on file in the City Clerks Office.
SECTION 2. In consideration of one dollar and other valuable consider-
ation, to it paid by Missouri Utilities Compar�y of the County of Cape Girardeau
and. state of Missouri, the City of Cape Girardeau, Missouri, does hereby
se11� assign, set over and transfer unto Missouri Utilities Company, all of

its rights and interest arising out of, incidential to and by virtue of,
a certain contract beween the City of Cape Girardeau and Jackson Excavating
Company, executed January 22, 1969, relating to the construction of Water
Line I}istrict No. 1 NW in the City of Cape Girardeau, Missouri.
SECTION 3. The Mayor of the City of Cape Girardeau, Missouri, is
hereby authorized and empowered to execute and deliver a deed for the described
property and. maKe an assignment of the described contractual rights to
Missouri Utilities Company, of the County of Cape Girardeau, State of Missouri.
SECTION !�. This ordinance shall be in full force and effect ten days
after its passage and approval.
